3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON
4 BEACH, FLORIDA, FINDING THAT CITY OWNED REAL PROPERTIES
5 LOCATED AT PANDORA AVENUE, PCN #00-43-45-19-04-008-0200
6 (+/-0.8149 ACRE), NICKELS BOULEVARD, PCN# 00-43-45-19-04-006-
7 0260 (+1-5.7071 ACRE), JAVERT STREET, PCN # 00-43-45-19-00-000-
8 3010 (+/-1.6572 ACRE), AND NICKELS BOULEVARD, PCN # 00-43-45-
9 19-03-006-0080 (+/-6.8470 ACRE), TOTALING +/-15.03 ACRES, ARE
10 NOT NEEDED FOR CITY PURPOSES AND IS DECLARED TO BE SURPLUS;
11 DIRECTING THE METHOD OF DISPOSITION; AND FOR ALL OTHER
12 PURPOSES.

14 WHEREAS, according to Chapter 2, Article IV, Section 2-56 (c) of the City of Boynton Beach
15 Code of Ordinances, the City Commission can sell property, which is determined to be in the best
16 interest of the City; and
17 WHEREAS, before any improved or unimproved property owned by the City can be sold,
18 the City Commission must first declare the property to be surplus; and
19 WHEREAS, the City owns the following properties:
20 1. Parcel Control Number: 00-43-45-19-04-008-0200
21 Location: Pandora Avenue
22 Size: +/-0.8149 Acres
23 2. Parcel Control Number: 00-43-45-19-04-006-0260
24 Location: Nickels Boulevard
25 Size: +/-5.7071 Acres
26 3. Parcel Control Number: 00-43-45-19-00-000-3010
27 Location: Javert Street
28 Size: +/-1.6572 Acres
29 4. Parcel Control Number: 00-43-45-19-03-006-0080
30 Location: Nickels Boulevard
31 Size: +/-6.8470 Acres; and
32 WHEREAS, the subject parcels of land have not been used for City purposes; and
33 WHEREAS, the City desires to have the subject parcels of land declared surplus; and

35 WHEREAS, City staff is requesting guidance from the City Commission on the method of
36 disposition; and
37 WHEREAS, the method of disposition includes negotiating and entering into a sale and/or
38 development agreement with Mizner Development, an interested party who desires to purchase
39 the subject parcels; issuing a Request for Proposal for interested parties to submit proposals for
40 the acquisition and/or development of the property; or procuring a real estate broker to market
41 the property and solicit offers from potential buyers and/or developers; and
42 WHEREAS, the City Commission, upon the recommendation of staff, has deemed it in the
43 best interests of the City's citizens and residents to find that City owned real properties located at
44 Pandora Avenue, PCN #00 43 45 19 04 008-0200 (+/-0.8149 acre), Nickels Boulevard, PCN# 00-
45 43-45-19-04-006-0260 (+/-5.7071 acre), Javert Street, PCN # 00-43-45-19-00-000-3010 (+1-
46 1.6572 acre), and Nickels Boulevard, PCN # 00-43-45-19-03-006-0080 (+/-6.8470 acre), totaling
47 +/-15.03 acres, are not needed for city purposes and is declared to be surplus.

49 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON
50 BEACH, FLORIDA, THAT:
51 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as
52 being true and correct and are hereby made a specific part of this Resolution upon adoption.
53 SECTION 2. The City Commission of the City of Boynton Beach Florida, hereby finds and
54 determines that City owned real properties located at Pandora Avenue, PCN #00-43-45-19-04-
55 008-0200 (+/-0.8149 acre), Nickels Boulevard, PCN# 00-43-45-19-04-006-0260 (+/-5.7071 acre),
56 Javert Street, PCN # 00-43-45-19-00-000-3010 (+/-1.6572 acre), and Nickels Boulevard, PCN #
57 00-43-45-19-03-006-0080 (+/-6.8470 acre), totaling +/-15.03 acres, are not needed for City
58 purposes and hereby declares such properties to be surplus and available for disposition.
59 SECTION 3. The City Commission of the City of Boynton Beach, Florida, hereby approves
60 the method of disposition as agreed upon during the Commission meeting and authorizes staff
61 to dispose of the surplus properties as such.
62 SECTION 4. The Agreement shall be presented to the City Commission for approval.
63 SECTION 5. This Resolution shall take effect in accordance with the law.
