R25-139 2 3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON 4 BEACH, FLORIDA, APPROVING STAFF RECOMMENDATIONS FOR 5 USING $119,005 OF THE CITY'S STATE HOUSING INITIATIVES AND 6 PARTNERSHIP ("SHIP") PROGRAM FUNDS TOWARD THE 7 REHABILITATION OF THE PROPERTY LOCATED AT 235 S.W. 10 8 AVENUE, BOYNTON BEACH, FLORIDA 33435 AND USING $105,332.16 9 OF THE CITY'S SHIP PROGRAM FUNDS TOWARD THE 10 REHABILITATION OF THE PROPERTY LOCATED AT 404 N.W. 16 11 AVENUE, BOYNTON BEACH, FLORIDA 33435; AND FOR ALL OTHER 12 PURPOSES. 13 14 WHEREAS, the City of Boynton Beach's State Housing Initiatives and Partnership ("SHIP") 15 Program Local Housing Assistance Plan ("CHAP") offers income-eligible homeowners housing 16 rehabilitation assistance for necessary repairs, accessibility/architectural barriers, and hurricane 17 mitigation; and 18 WHEREAS, rehabilitation is defined as repairs and/or improvements needed for safe and 19 sanitary habitation, and/or correction of substantial code violations, including exterior and 20 interior; and 21 WHEREAS, the maximum award for the Owner-Occupied Rehabilitation Program is based 22 on income categories as $95,000 for Extremely Low and Low, $85,000 for Low, and $50,000 for 23 Moderate; and 24 WHEREAS, the assistance under the CHAP is provided as a zero percent (0%) interest, 25 deferred forgivable loan secured by a mortgage and promissory note, with the loan forgiven 1/15 26 per year over the fifteen (15) year term; and 27 WHEREAS, the property located at 235 S.W. 10 Avenue, Boynton Beach, Florida 33435 28 belongs to Marie Formille, who is eligible for the SHIP Rehabilitation program as an Extremely 29 Low-income individual, and has lived in the property for fourteen (14) years; and 30 WHEREAS, the scope of recommended repairs includes replacement of the roof, windows, 31 exterior doors, interior walls of the bathroom and hall, bedroom ceiling, interior electrical, 32 plumbing, interior door, air conditioning, and insulation; and 33 WHEREAS, the property located at 404 N.W. 16 Avenue, Boynton Beach, Florida 33435 34 belongs to Carolina Duncan, who is eligible for the SHIP Rehabilitation program as a Low-income 35 individual, and has lived in the property for fifteen (15) years; and 36 WHEREAS, the scope of recommended repairs includes replacement of the roof, 37 installation of impact windows, exterior electrical, exterior painting, utility room ceiling, kitchen 38 ceiling, SW bedroom ceiling, interior plumbing, interior electrical, smoke detectors, interior walls, 39 kitchen cabinets, interior doors, interior painting, air conditioning, and insulation; and 40 WHEREAS, the City Commission, upon the recommendation of staff, has deemed it in the 41 best interests of the City's citizens and residents to approve the use of $119,005 of the SHIP 42 Program funds to rehabilitate the 235 S.W. 10 Avenue property, with the entire amount of 43 $119,005 to be charged to SHIP; and 44 WHEREAS, the City Commission, upon the recommendation of staff, has deemed it in the 45 best interests of the City's citizens and residents to approve the use of $105,332.16 of the SHIP 46 Program funds to rehabilitate the 404 N.W. 16 Avenue property, with the entire amount of 47 $105,332.16 to be charged to SHIP. 48 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON 49 BEACH, FLORIDA, THAT: 50 51 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as 52 being true and correct and are hereby made a specific part of this Resolution upon adoption. 53 SECTION 2. The City Commission of the City of Boynton Beach, Florida, does hereby 54 approve the use of $119,005 of the SHIP Program funds to rehabilitate the 235 S.W. 10 Avenue 55 property,with the entire amount of$119,005 to be charged to SHIP,as further detailed in Exhibits 56 A and B, attached respectively hereto. 57 SECTION 3. The City Commission of the City of Boynton Beach, Florida, does hereby 58 approve the use of$105,332.16 of the SHIP Program funds to rehabilitate the 404 N.W. 16 Avenue 59 property, with the entire amount of $105,332.16 to be charged to SHIP, as further detailed in 60 Exhibits A and B, attached respectively hereto 61 SECTION 4. The City Commission of the City of Boynton Beach, Florida, hereby 62 authorizes the Mayor to execute any ancillary documents as may be necessary to accomplish the 63 purpose of this Resolution. 64 SECTION 5. This household of one (1 ) is income certified as Extremely Low. The annual household income is $9,552.00. Ms. Formille has owned her home for fourteen (14) years. The scope of recommended repairs included: Replace the roof, windows, exterior doors, interior walls (bathroom and hall), bedroom ceiling, interior electrical, plumbing, interior door, A/C and insulation. The contract was awarded to Built Solid Construction LLC the most responsible bid. Ms. Formille executed a $124,685.00 Mortgage and Promissory Note to include a small contingency for unforeseen repairs. The total cost of repairs was $113,350.00 with change orders totaling $5,655.00. The Corrective Mortgage and Note will be $119,005.00. Community Improvement originally requested that $95,000.00 of the State Housing Initiative Partnership (SHIP) funds be used with the balance to be CDBG Funds. Community improvement is requesting that the entire amount be charged to SHIP, an additional allocation of $24,005.00. There will be no CDBG funding spent. This rehabilitation meets the objectives of the City Manager's Office/Community Improvement Division's efforts to improve the City's housing stock.
