R25-142 RESOLUTION NO. R25-142 2 3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON 4 BEACH, FLORIDA, APPROVING THE CONDITIONAL SETTLEMENT AND 5 RELEASE OF CLAIM IN THE MATTER OF CORYE H. READON, SR., AS 6 PERSONAL REPRESENTATIVE OF THE ESTATE OF JAYDEN CARLOS 7 ETHAN READON, FOR THE BENEFIT OF CORYE H. READON, SR., AND 8 MARISELLA READON, SURVIVING PARENTS; AND THE ESTATE OF 9 JAYDEN CARLOS ETHAN READON. V. CITY OF BOYNTON BEACH, ET 10 AL., TOTALING $300,000; AND FOR ALL OTHER PURPOSES. 11 12 WHEREAS, the Code of Ordinances of the City of Boynton Beach, Florida, provides that 13 the authority for settlement of all claims in excess of $50,000 shall require approval of the City 14 Commission by formal resolution; and 15 WHEREAS, Corye H. Readon, Sr., as Personal Representative of the Estate of Jayden Carlos 16 Ethan Readon, for the benefit of Corye H. Readon, Sr., and Marisella Readon, surviving parents; 17 and the Estate of Jayden Carlos Ethan Readon ("Plaintiffs") brought a claim stemming from an 18 alleged incident that occurred on or about February 13, 2016; and 19 WHEREAS, a Settlement and Release of Claim was reached with the Plaintiffs for $300,000 20 in exchange for a general release of all claims, which resolves all claims for damages between the 21 Plaintiffs and Defendants, City of Boynton Beach and Mark Sohn, as well as attorney's fees and 22 costs; and 23 WHEREAS, the City Commission, upon the recommendation of staff, has deemed it in the 24 best interests of the city's citizens and residents to approve the Conditional Settlement and 25 Release of Claim in the matter of Corye H. Readon, Sr., et al.v.City of Boynton Beach, et al., totaling 26 $300,000. 27 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON 28 BEACH, FLORIDA, THAT: 29 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as 30 being true and correct and are hereby made a specific part of this Resolution upon adoption. 31 SECTION 2. The City Commission of the City of Boynton Beach, Florida, does hereby 32 approve the Conditional Settlement and Release of Claim in the matter of Corye H. Readon, Sr., 33 et al., v. City of Boynton Beach, et al., totaling $300,000, in form and substance similar to that 34 attached as Exhibit A. 35 SECTION 3. SETTLEMENT AGREEMENT The Parties mediated this case before Gary S.Dickstein on 5/21/2025 and reached agreement under the following terms which the parties agree are binding and enforceable: 1) The Defendants, CITY OF BOYNTON BEACH,a Florida municipal corporation,MARK SOHN,individually, will pay the total sum of$300,000.00 payable to Sharmin & Sharmin, P.A. counsel's trust account F/B/O CORYE H. READON Sr. as personal representative of The Estate of JAYDEN CARLOS ETHAN READON and survivors(Plaintiff counsel's FEIN # 26-3867007 ) in exchange for a complete release of all claims arising out of this action, including any consortium claim, satisfaction of all related medical (including but not limited to Medicare, Medicaid and all other health insurance), attorney charging and other liens. Upon receipt of payment, plaintiff counsel shall file a dismissal with prejudice/stipulation for dismissal as to The City of Boynton Beach and Mark Sohn only. The above settlement is contingent upon The CITY OF BOYNTON BEACH commission approval. 2) Parties shall bear their own costs and fees unless stated otherwise below; electronic signatures shall have the same force and effect as original signatures; the mediator is scrivener only. The undersigned parties confirm and agree that the mediator is a neutral intermediary who has not served as legal counsel in this matter. Each party executing this Settlement Agreement should have it independently reviewed by his, her or its own counsel before signing. 3) Plaintiffs (s) authorize and plaintiff counsel agrees to hold all settlement funds in trust until fully executed closing documents have been returned to defense counsel or the carrier. Payor shall tender closing documents to plaintiff's counsel within five business days from the date of this agreement and shall have 20 days from receipt of the executed release and commission approval to tender payment or interest shall then begin to accrue at the effective Florida statutory rate.
