3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON
4 BEACH, FLORIDA, APPROVING A PURCHASE ORDER TO ATLANTIC
5 SOUTHERN PAVING AND SEALCOATING IN THE AMOUNT OF
6 $411,846.40 FOR TASK 225 FOR CHAPEL HILL RESURFACING PROJECT
7 IN THE AMOUNT OF $411,846.40, PLUS A 10% CONTINGENCY OF
8 $41,184.64, FOR A TOTAL NOT TO EXCEED $453,031.04; AND FOR ALL
9 OTHER PURPOSES.

11 WHEREAS, at the March 18, 2025, City Commission Meeting, the Commission reviewed
12 and approved the FY2025 Paving Plan. Among the approved tasks was the resurfacing of Chapel
13 Hill; and
14 WHEREAS, resurfacing is required due to the deterioration of the existing micro-surfacing
15 pavement treatment to restore the roadway to safe and serviceable standards; and
16 WHEREAS, the City Commission, upon the recommendation of staff, has deemed it in the
17 best interests of the City's citizens and residents to approve a Purchase Order to Atlantic Southern
18 Paving and Sealcoating in the amount of $411,846.40 for Task 225 for Chapel Hill Resurfacing
19 Project in the amount of $411,846.40, plus a 10% contingency of $41,184.64, for a total not to
20 exceed $453,031.04.

22 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON
23 BEACH, FLORIDA, THAT:
24 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as
25 being true and correct and are hereby made a specific part of this Resolution upon adoption.
26 SECTION 2. The City Commission of the City of Boynton Beach, Florida, does hereby
27 approve a Purchase Order to Atlantic Southern Paving and Sealcoating in the amount of
28 $411,846.40 for Task 225 for Chapel Hill Resurfacing Project in the amount of $411,846.40, plus a
29 10% contingency of $41,184.64, for a total not to exceed $453,031.04, as further detailed to that
30 attached as Exhibit A.
31 SECTION 3. This Resolution shall take effect in accordance with the law.

specified. Payment will be made as outlined. When signed, this document becomes a contract. E&OE
We understand that if any additional work is required different than what is stated in this proposal/contract, it must be in a
new contract or added to this contract. The parties also acknowledge that the time for performance of the work may be
impacted by market conditions beyond contractor's control in which event the contract time shall be extended.
Please see all attachments for special conditions that may pertain to aspects of this project.
This price of this contract is based upon completion of the work within thirty days from the date hereof, thus the price is good
for a period of up to 30 days from the date listed herein. If the work is not completed within thirty days, and the contractor
experiences price increases for materials in excess of those upon which the price of this contract were based as of the date
hereof, the contract price shall be increased by the amount of the documented price increase.
