R25-157 2 3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON 4 BEACH, FLORIDA, APPROVING THE SOLE-SOURCE PURCHASE OF 5 SOFTWARE AND ISSUANCE OF A PURCHASE ORDER TO MAGNET 6 FORENSICS, LLC IN AN AMOUNT NOT TO EXCEED $100,000, 7 CONTINGENT UPON THE EXECUTION OF AN ADDITIONAL FUNDING 8 REQUEST SUBMITTED UNDER THE FISCAL YEAR 2024-2025 FLORIDA 9 DEPARTMENT OF LAW ENFORCEMENT ONLINE STING OPERATIONS 10 GRANT PROGRAM; AND FOR ALL OTHER PURPOSES. 11 12 WHEREAS, the Boynton Beach Police Department desires to purchase specialized forensic 13 software from Magnet Forensics, LLC in an amount not to exceed $100,000. This expenditure will 1.1 be fully reimbursed through the Fiscal Year 2024-2025 Online Sting Operations Grant Program 15 from the Florida Department of Law Enforcement ("FDLE"); and 16 WHEREAS, Magnet Forensics, LLC is designated as a sole-source provider of critical 17 software used in digital forensic investigations. Their platforms are essential for conducting 18 comprehensive and detailed forensic analysis necessary to support the Department's online sting 19 operations.The use of these tools will directly enhance the Department's investigative capabilities, 20 ensure compliance with FDLE operational standards, and improve overall efficiency in case 21 management and evidence processing; and 22 WHEREAS, this purchase is being made pursuant to the Sole Source Procurement 23 Exemption outlined in Section X, Alternatives to Formal Sealed Bids, of the procurement policy. 24 This section permits Sole Source Services and Purchases when it is determined that only one viable 25 source is available. Such circumstances may include, but are not limited to, repairs or additions 26 from the original equipment manufacturer, exclusive regional suppliers, franchised or licensed 27 distributors, or proprietary items. The vendor has submitted the required documentation to the 28 City, and the Procurement Division has affirmed that the documentation for this purchase meets 29 the Sole Source Procurement Exemption criteria. Accordingly, the Boynton Beach Police 30 Department seeks approval to proceed with this procurement in accordance with applicable policy 31 and grant guidelines; and 32 WHEREAS, the City Commission, upon the recommendation of staff, has deemed it in the 33 best interests of the City's citizens and residents to approve the sole-source purchase of software 34 and issuance of a purchase order to Magnet Forensics, LLC in an amount not to exceed $100,000, 35 contingent upon the execution of an additional funding request submitted under the Fiscal Year 36 2024-2025 Florida Department of Law Enforcement Online Sting Operations Grant Program. 37 38 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON 39 BEACH, FLORIDA, THAT: 40 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as 41 being true and correct and are hereby made a specific part of this Resolution upon adoption. 42 SECTION 2. The City Commission of the City of Boynton Beach, Florida, does hereby 43 approve the sole-source purchase of software and issuance of a purchase order to Magnet 44 Forensics, LLC in an amount not to exceed $100,000, contingent upon the execution of an 45 additional funding request submitted under the Fiscal Year 2024-2025 Florida Department of Law 46 Enforcement Online Sting Operations Grant Program. 47 SECTION 3. The City Commission of the City of Boynton Beach, Florida, hereby 48 authorizes the Mayor to execute any ancillary documents as may be necessary to accomplish the 49 purpose of this Resolution. 50 SECTION 4.
