AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING CHAPTER 18, PENSIONS AND
RETIREMENT, SECTION 18-125. RE-EMPLOYMENT
OF MEMBERS RECEIVING BENEFITS, TO PERMIT
EMPLOYEES WHO ARE FULLY VESTED WHO
RECEIVE BENEFITS FROM A CITY PENSION PLAN
TO BE RE-APPOINTED AT THE OPTION OF THE
CITY, ON A FULL-TIME BASIS, AND TO JOIN
AS A NEW MEMBER OF THE CITY'S PENSION
PLAN FOR THAT POSITION PROVIDED HE/SHE IS
OTHERWISE ELIGIBLE TO JOIN THAT PLAN
PURSUANT TO THE PLANS' PROVISIONS;
PROVIDING FOR CONFLICTS, SEVERABILITY,
CODIFICATION AND EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Boynton
Beach, Florida deems it to be in the best interests of the
City to amend the that portion of the Code which relates to
re-employment of employees, who are fully vested who receive
benefits from a City pension plan to be re-appointed at the
option of the City on a full-time basis, and to join as a new
member of the City's pension plan for that position provided
he/she .is otherwise eligible to join that plan pursuant to the
plans' provisions.
NOW, THEREFORE, IT IS HEREBY ORDAINED BY THE CITY
COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1.
Chapter 18, Section 18-125 shall be
amended by adding the words and figures in underlined type and
by deleting the words and figures in struck-through type, as
follows:
Sec. 18-125. Re-employment of members
receiving benefits or full vested who
leave the City.
The city may at its option employ any person
receiving benefits under this chapter, except for
disability benefits.
(a) Re-employment Full-Time: A person
who leaves the employ of the City after
vestinq or receiving a pension from any
one of the City's pension plans can be
re-employed at the option of the City on
a full-time basis, provided they are no
longer a member of the plan they are or
will be receiving benefits from. A
person who is re-employed shall be
entitled to participate in the City's
pension plan for his/her position
provided he/she is otherwise eligible to
join that plan pursuant to the plans'
provisions.
(b) Re-employment on a part-time basisl
Said part-time employment shall not
exceed one thousand six hundred (1,600)
hours per year. During this period of
part-time employment, the employee shall
not be allowed to make contributions to
the pension fund nor shall such period of
service count toward credit for the
employee's credible service nor in
figuring the average final compensation
of the employee.
Section 2. That all ordinances or parts of ordinances
in conflict herewith be and the same are hereby repealed.
Section 3. Should any section or provision of this
ordinance or portion hereof, any paragraph, sentence or word
be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the remainder of this
ordinance.
