R25-196 2 3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON 4 BEACH, FLORIDA, APPROVING CHANGE ORDER TO TASK 225 AND PO 5 # 251608 WITH ATLANTIC SOUTHERN PAVING AND SEALCOATING, 6 LLC D/B/A ROSE PAVING LLC FOR THE CHAPEL HILL RESURFACING 7 PROJECT, FOR AN UPDATED PROJECT TOTAL OF $558,723 PLUS A 10% 8 CONTINGENCY OF $55,872, FOR A TOTAL NOT TO EXCEED $614,595, 9 INCREASING THE TOTAL PROJECT AMOUNT BY $161,564; AND FOR 10 ALL OTHER PURPOSES. 11 12 WHEREAS, at the March 18, 2025 City Commission Meeting, the Commission reviewed 13 and approved the FY2025 Paving Plan. Among the approved tasks was the resurfacing of Chapel 14 Hill; and 15 WHEREAS, resurfacing is required due to the deterioration of the existing micro-surfacing 16 pavement treatment to restore the roadway to safe and serviceable standards; and 17 WHEREAS, on June 3, 2025, the City Commission adopted Resolution No. R25-146, 18 authorizing the issuance of Purchase Order # 251608 to Atlantic Southern and Sealcoating LLC 19 ("Contractors") Paving in the amount of $411,846.40 for Task 225 for resurfacing project ("Chapel 20 Hill Resurfacing Project"), plus a %10 contingency of$41,184.64, for a total amount not to exceed 21 of $453,031.04; and 22 WHEREAS, shortly after work commenced, the Contractors identified significant 23 unforeseen subsurface conditions that were not apparent during the initial site evaluations and 24 design phase, revealing extensive base failures and widespread roadway degradation, which 25 significantly undermined the structural integrity of the pavement, requiring additional excavation, 26 enhanced stabilization measures, and materials well beyond the originally approved scope of 27 work; and 28 WHEREAS, the City Commission, upon the recommendation of staff, has deemed it in the 29 best interests of the City's citizens and residents to ratify Change Order # CO-25-005712-001 to 30 Purchase Order No. 251608 to the Contractors., for the Chapel Hill Resurfacing Project, for an 31 updated project total of $558,723 plus a 10% contingency of $55,872, increasing the total project 32 amount by $161,564 for a total amount not to exceed $614,595, due to unforeseen building 33 conditions. 34 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON 35 BEACH, FLORIDA, THAT: 36 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as 37 being true and correct and are hereby made a specific part of this Resolution upon adoption. 38 SECTION 2. The City Commission of the City of Boynton Beach, Florida, does hereby 39 ratify Change Order#CO-25-005712-001 to Purchase Order No. 251608 to Atlantic Southern and 40 Sealcoating LLC, for the Chapel Hill Resurfacing Project, for a new not-to-exceed amount of 41 $614,595, due to unforeseen building conditions, as further detailed to that attached as Exhibit 42 A. 43 SECTION 3.
