GESPW-2E-03-25 5 WITH WEST ARCHITECTURE + DESIGN, LLC FOR THE PENCE PARK 6 RECONSTRUCTION PROJECT RP2509, IN THE AMOUNT OF $375,845 7 PLUS A 10% ALLOWANCE OF $37,585 FOR UNFORESEEN 8 CONDITIONS, FOR A TOTAL OF $413,430; AND FOR ALL OTHER 9 PURPOSES. 10 11 WHEREAS, the City and West Architecture + Design, LLC ("Consultant") entered into a 12 General Engineering Consulting Services Agreement dated November 19, 2024, approved by 13 Resolution No. R24-291; and 14 WHEREAS, the City desires the Consultant to renovate the existing Pence Park; and 15 WHEREAS, the City Commission, upon the recommendation of staff, has deemed it in the 16 best interests of the City's citizens and residents to approve Task Order No. GESPW-2E-03-25 with 17 West Architecture + Design, LLC for the Pence Park Reconstruction project RP2509, in the amount 18 of $375,845, plus a 10% allowance of $37,585 for unforeseen conditions, for a total of$413,430. 19 20 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON 21 BEACH, FLORIDA, THAT: 22 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as 23 being true and correct and are hereby made a specific part of this Resolution upon adoption. 24 SECTION 2. The City Commission of the City of Boynton Beach, Florida, does hereby 25 approve Task Order No. GESPW-2E-03-25 with West Architecture + Design, LLC for the Pence 26 Park Reconstruction project RP2509, in the amount of $375,845, plus a 10% allowance of$37,585 27 for unforeseen conditions,for a total of$413,430 (the "Task Order"), in form and substance similar 28 to that attached as Exhibit A. 29 SECTION 3. The City Commission of the City of Boynton Beach, Florida, hereby 30 authorizes the Mayor to execute the Task Order. The Mayor is further authorized to execute any 31 ancillary documents as may be necessary to accomplish the purpose of this Resolution. 32 SECTION 4. The City Clerk shall retain the fully executed Task Order as a public record 33 of the City. A copy of the fully executed Task Order shall be provided to Maria Rozwadowski to 34 forward to the Consultant. 35 SECTION 5. Task/Project. Pence Park - Reconstruction 2. Detailed Scope of Professional Services. A detailed scope of services under this Task Order, in accordance with the phases of service detailed in the Agreement, is attached as Exhibit A. 3. Deliverables and Schedule. For study/design related services: Consultant shall deliver to the City the deliverables specified at the time indicated on the attached Exhibit B. For project administration services: Consultant shall provide project/construction administration services in accordance with the Agreement and project schedule. 4. Compensation. The total estimated construction costs of the Project or the cost of the study or report for this Task Order may not exceed the amounts set forth in Section 287.055, Florida Statutes. The total Fee to be paid to the Consultant under this Task Order shall not exceed $375,845, based on the hourly rates currently in effect under the Agreement. A detailed fee schedule is attached as Exhibit A. The payment schedule (based on deliverables) is attached as Exhibit A. 5. Agreement Reference. This Task Order shall be performed under the terms and conditions described within the General Engineering Consulting Services Agreement, dated November 19, 2024 by and between the City of Boynton Beach and West Architecture +Design, LLC ("Consultant"), Contract No. 6. Insurance. Consultant shall maintain insurance coverages in accordance with the Agreement and hereby confirms that Certificate(s) of Insurance evidencing current policies meeting the requirements of the Agreement are on file with the City as of the date of this Task Order. 7. The Surveyor shall update a boundary survey which will meet the requirements for site plan processing. The boundary survey shall show aboveground improvements and platted easements in accordance with the minimum technical standards of the State of Florida. B. The survey shall also include the existing physical features and improvements on the site and the surrounding right-of-ways. This will include any trees 2" and larger, existing parking lots, curbs, wheel stops, light poles, above ground utilities, buildings and other features that may be required in designing the projects development. Grades shall be located at any trees to be preserved, slope changes, edge of pavements, etc. The Surveyor shall also coordinate with a location service in order to locate underground phone, electric, gas or other services which may conflict with proposed piping of the new construction. 3. CONCEPTUAL DESIGN SERVICES A. Coordinate with the Client to finalize site design elements. B. Gather the existing utilities and drainage information along with information on SE 3rd Street. C. Develop (up to 2) conceptual Site Plans, include the Site Data information on plans D. Provide a (up to 2) colored conceptual Site Plan for presentation purposes. Task 1.2 — Schematic Design / Design Development/ 30% Construction Documents: Based on the outcome of the Task 1, the following steps will be provided. 1. PROGRAMMING SERVICES A. Coordinate with the Client to finalize the site program requirements. 1) Further develop the program for the site. B. Research Zoning, Land Development Codes, Building and Fire Codes for site and building requirements. 2. SCHEMATIC DESIGN SERVICES A. Develop a schematic Site Plan locating the buildings, driveways, parking, sidewalks and landscape areas, include the Site Data information on plans, based on the approved programming of the site. B. Develop a Conceptual Cost Estimate based on the previous approved Site Plan, Floor Plans and Exterior Elevations of the Programming, Conceptual and Schematic Design phases of the project. D. Provide a final Conceptual Cost Estimate for presentation purposes. CIVIL ENGINEERING Preliminary Engineering / Site Plan Support A. The Preliminary Plans are for regulatory agency and support to others during site plan approval process through the City of Boynton Beach. B. The Engineer will research existing available records for the project and prepare preliminary civil engineering plans for the infrastructure improvements to support the processing of the site plan layout for the Project. C. The preliminary civil engineering plans will be prepared in accordance with the CLIENT and regulatory agency requirements and will include Paving, Grading and Drainage, Water and Sewer System adjustments and services D. The preliminary engineering plan will include available existing utility information collected from various sources (Government Agencies, Utility providers etc.). Final design will require additional survey and Subsurface Utility investigation to verify the preliminary information supplied to or obtained by the engineer. E. Preliminary drainage calculations will be performed to address the impacts of the proposed development relating to the requirements of the site plan submission. One preliminary engineering plan will be prepared based on the supplied site plan design. The plans will contain the location of the proposed site lighting. Deliverables: 1. Preliminary Design Plans (30% Construction Documents) 2. Preliminary Drainage Calculations, as required. Construction Documents (CD) — Final Engineering F. The Engineer will prepare on-site paving, grading, and drainage construction plans, to support the proposed development, which meet the requirements of the jurisdictional regulatory agencies. Calculations will be performed to address the impacts of the proposed development relating to the requirements for permit agency submittal. G. The storm water management system will address water quality treatment and water quantity storage to meet the requirements of the jurisdictional agencies. It is anticipated that the proposed drainage system will consist of a series of catch basins, pipes, swales, and/or dry retention areas. H. Typical sections and standard paving and drainage details and notes for the construction of the paving, grading, and drainage system are included. Soils percolation tests to satisfy regulatory agency requirements will be performed by others as required. I. Pavement Marking and Signing Plans: The engineer will prepare a signing and pavement marking plan for the project that meets the requirements of the regulatory agencies. This plan will include standard details and notes. J. Erosion Control Plans: The engineer will prepare an Erosion Control Plan for the project that meets the requirements of the regulatory agencies and for the Contractor's use in preparing and processing the required Stormwater Pollution Prevention Plan (SWPPP), in compliance with the "Generic Permit for Stormwater Discharge from Large and Small Construction Activities (CGP)" through FDEP. The Erosion Control Plan(s) will include standard details and notes to meet the requirements of the regulatory agencies. K. Demolition Plan: The engineer will prepare a Demolition Plans incorporating removal of the existing improvements in conflict with the proposed facilities. This plan will include standard details and notes. Should permitting be required for this work, it will need to be provided by a licensed demolition contractor. a. Note: The use of explosive demolition materials and the assessment for or removal of hazardous materials or toxic waste are not included in these services and will not be incorporated in the Demolition Plan. The engineer will prepare and submit the permit applications for the construction of the following improvements and process them through the following regulatory agencies: a. The engineer will supply erosion control plans and ERP / Surface Water management permits, to the owner and building contractor for contractor's use in preparing the NPDES Storm Water Pollution Prevention Plan (SWPPP) and securing the required NPDES Construction Activity Permit. The contractor (as permittee) is responsible to monitor the construction activity for compliance with the NPDES permit and report to FDEP in accordance with the Permit. Deliverables: 1. MECHANICAL / ELECTRICAL / PLUMBING ENGINEERING Prepare Construction Drawings A. Heating, Ventilation, and Air Conditioning (HVAC) Systems a. Prepare construction drawings and specifications for the air conditioning, heating and ventilation systems. The plans shall include a plan view of the equipment, ductwork, air devices, Florida Energy Code, load calculations, etc. suitable for construction, pricing and permitting. B. Sanitary, Domestic Water, and Gas Systems a. The construction documents shall include both plan and riser views suitable for construction, pricing and permitted. All systems shall be terminated at utility systems at a point five-feet from the building to connections provided by civil engineering design. b. Deliverables: i. Coordination with Civil Eng. for sanitary. C. Electrical Systems a. The plans shall include a plan view of the electrical distribution system, risers, panel schedules, details and specifications suitable for construction, pricing and permitting. b. Design includes providing lighting; empty conduit for voice, data, fiber, cable, satellite, and card access or security systems at locations identified and coordinated by the Architect or owner's consultant(s) during Design Development phase of the Project; (Design and Cabling by others). c. Prepare engineering design documents for the fire alarm system to indicate device types and locations, system riser, conductor requirements, notification requirements, as per NFPA and the Florida Building Code. The Fire Alarm Contractor based on the criteria provided will produce permit documents. b. Produce schematic fire protection engineering documents and specifications including prescriptive and performance criteria specifications, water supply analysis and material specifications, sprinkler head type and location, as per NFPA and the Florida Building Code. The fire protection system contractor based on the prescriptive design requirements will prepare the fire protection system layout documents. E. Low Voltage a. Consultant to show locations of all low voltage (security/data, etc). Locations to be coordinated with the Owner. Contractor shall install the conduit and boxes, only. City will be responsible for the installation or the wiring and equipment. b. Consultant to coordinate AN requirements with the Owner. Review Meetings A. LANDSCAPE ARCHITECTURE Site Analysis A. Visit the site, photograph, and review existing site conditions. B. Use the tree location survey prepared by a Florida Licensed Surveyor, and a tree survey prepared by a Florida Certified Arborist to identify, measure DBH, and determine the tree/palm/hedge species and existing condition so that the Consultant can determine which existing trees and palms need to be protected, relocated, or mitigated on-site. This information will likely affect the site plan design. C Recommend site plan design D. Recommend site plan changes that will comply with athletic field and playground safety standards, ADA accessibility, vehicular and pedestrian circulation, and playground safety standards. Schematic Design/Design Development 130% Construction Documents / Prepare Planting and Mitigation Plan A. Prepare a Planting Plan to show the City Code's required landscape buffers, interior open space, parking landscape, sign landscaping, building foundation plantings, tree and palm mitigation, and street tree plantings. B. Prepare planting details, plant schedules, and planting outline specifications. C. Prepare and include the plan City required landscape statistics. D. Landscape Architect will Indicate on the planting plan any existing trees to be removed, relocated, or replaced as required by the City for approval 60% - Site Approval Submittal A. Assist with the application process. B. Provide signed and sealed PDF files of the plans that we prepare for the client to submit to the City and other approving agencies for permits. C Revise our plans, if required, and respond to City review comments. D. Attendance at public meetings will be billed hourly plus direct expenses. Prepare an Irrigation Plan indicating the location of the check valve, controller, main lines, lateral lines, and heads. B. Landscape Architect will use a reclaimed water source that is available at this site. C. Landscape Architect will specify a smart controller that will reduce the required watering amounts by at least 50 percent. D. Prepare irrigation details, irrigation head schedules, and outline specifications adequate to obtain required approvals and for the Client's use in obtaining quotations from Irrigation Contractors. Construction Observation Services and Preparation of As-Built Landscape Plans A. Advise the Client during construction. B. Review contractor written requests for any plant or irrigation substitutions. C. Prepare an As-Built Landscape Plan, if required, for the final Certificate of Occupancy. D. Landscape Architect can review the quality of plants delivered to the site for compliance with the referenced "Grades and Standards". E. The Consultant can review the placement of plants, construction progress, and quality of construction to determine if the work is proceeding according to the design intent as indicated on county-approved plans, outline specifications, and installation details. F. As built, irrigation plans shall be provided by the irrigation contractor. G. Any changes proposed by the irrigation contractor in the field must be approved in writing by the Landscape Architect before any changes are made in the field. H. The Landscape Architect shall not have any duty or authority to direct, control, or supervise any contractor's work, nor shall the Landscape Architect have any authority over or responsibility for the means, methods, sequences, or safety procedures employed by any contractor or for any contractor's failure to comply with applicable laws and requirements. 4. STRUCTURAL ENGINEERING Conceptual Design Phase A. Review site program and project goals in collaboration with the client. B. Evaluate initial concepts for structural feasibility. C. Identify potential structural systems for park features, including: a. Shade structures and pavilions b. Foundations for site furnishings, lighting, and monuments Deliverables: a. Provide rough structural system recommendations, preliminary material selections, and structural design considerations based on soil conditions (if available). Schematic Desian Phase A. Provide schematic-level structural design layouts for primary park structures. B. Coordinate with Landscape Architect and Civil Engineer to ensure integration of grading, drainage, and structural systems. C. Identify key structural design criteria including: We 4 i. Refine structural systems based on approved schematic design and updated site/civil plans. B. Develop preliminary structural framing plans, foundation concepts, and major details. C. Coordinate foundation systems with geotechnical report recommendations (to be provided by client or geotechnical consultant). D. Identify any special structural requirements, including: a. Vandal resistance b. Floodplain or coastal conditions c. Long-span or cantilevered elements E Submit design development drawings and assist in estimating quantities or materials for budgeting. Construction Documents (CD) — 60%, 100%, and Final A. Prepare complete structural construction drawings and technical specifications including: a. Foundations, framing, connections, and structural details b. Retaining walls, stairs, ramps, and elevated structures (as required) c. Structural calculations d. Notes and schedules necessary for permitting and construction B. Coordinate with all disciplines (civil, landscape, architectural, electrical) to avoid conflicts. Deliverables: a. Provide signed and sealed drawings for permitting and construction. 5.SURVEYING Boundary and Partial Topographic Survey. A. The surveyor will prepare a Boundary and Partial Topographic Survey of the site. Survey will show the boundary lines together with surface improvements within the scope limits shown in the exhibit below, including buildings, roadways, pavement, sidewalks, traffic striping, walls, fences, surface utilities, etc. Trees will be noted by common name and trunk diameter. Storm and Sanitary structures will be noted with the pipe invert elevation, diameter, material, and direction. Survey will be referenced to the Florida State Plane Coordinate System (NAD83/11) and the North American Vertical Datum of 1988 (NAVD88). Elevations will be shown at an interval of approximately 50 feet, including intermediate changes in grade. Deliverables: 1. A base file and survey sheet in AutoCAD and a signed/sealed survey map sheet in pdf format. 6. GEOTECHNICAL Standard Penetration Test (SPT) A. The engineer will perform three Standard Penetration Test (SPT) boring in general accordance with ASTM D-1586 specification to a depth of 15 feet in the area of the proposed construction. At the completion of the on-site work, the soil samples will be returned to our laboratory. We will provide an updated engineering report including a description of our findings, general site preparation, foundation design recommendations for support of the proposed construction, graphic logs of the test borings, and a test boring location plan. In order to provide information concerning the engineering properties of the soils encountered, it is anticipated that tests may be performed to determine natural water content, organic content, and sieve analysis on representative soil samples collected from the site. 7. TRAFFIC Traffic Statement A. Using information provided by Palm Beach County and the Institute of Transportation Engineer's (ITE), we will perform a trip generation analysis for both the existing and proposed park development. The trip generation estimates will be provided in a tabular form. It is expected that the increase in trips associated with the new park will be small enough to be considered de minimis. B. If deemed necessary, a graphic figure will be prepared showing how the trip generation information will be distributed on the adjacent roadway network. Using this trip distribution information, an evaluation, in accordance with Palm Beach County's Article 12 —Traffic Performance Standards procedures, will be completed to demonstrate that the proposed project will not have a significant effect on any capacity constrained roadway links in the study area. Deliverables: b. A letter report summarizing the study methodology and findings will be prepared for submittal to Palm Beach County's Traffic Engineering Division for their review and approval. The letter report will also include a copy of the project site plan and will be signed and sealed by a Professional Engineer registered in the State of Florida. Parking Analysis A. It is possible that a parking analysis will need to be completed in support of the project. If so, a parking analysis will be conducted using techniques and parking demand characteristics data obtained from ITE's Parking Generation manual, 6 th Edition. The parking analysis will compare the existing parking demand to that expected due to the park's redevelopment and will contrast the parking demand per code with that predicted by the ITE's parking generation characteristics. Deliverables: b. A letter report summarizing the study methodology and findings will be prepared for submittal to the City of Boynton Beach for their review and approval. The letter report will include a copy of the project site plan and will be signed and sealed by a Professional Engineer registered in the State of Florida.
