12 WHEREAS, the City and Miller, Legg, and Associates, Inc. ("Consultant") entered into a
13 General Engineering Consulting Services Agreement dated November 19, 2024, approved by
14 Resolution No. R24-291; and
15 WHEREAS, the City desires the Consultant to provide survey, SUE, site planning, landscape
16 architecture, and civil engineering services for the proposed improvements to Jaycee Park; and
17 WHEREAS, the City Commission, upon the recommendation of staff, has deemed it in the
18 best interests of the City's citizens and residents to approve Task Order No. GESPW-1 K-01-25 with
19 Miller, Legg, and Associates, Inc. for design and consultant services for the Jaycee Park
20 Master/New Play Structure Design Project RP2511, in the amount of $186,345.00, plus a 10%
21 allowance of $18,634.50 for unforeseen conditions, for a total not to exceed $204,979.50.

23 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON
24 BEACH, FLORIDA, THAT:
25 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as
26 being true and correct and are hereby made a specific part of this Resolution upon adoption.
27 SECTION 2. The City Commission of the City of Boynton Beach, Florida, does hereby
28 approve Task Order No. GESPW-1K-01-25 with Miller, Legg, and Associates, Inc. for design and
29 consultant services for the Jaycee Park Master/New Play Structure Design Project RP2511, in the
30 amount of $186,345.00 plus a 10% allowance of $18,634.50 for unforeseen conditions, for a total
31 not to exceed $204,979.50 (the "Task Order"), in form and substance similar to that attached as
32 Exhibit A.
33 SECTION 3. The City Commission of the City of Boynton Beach, Florida, hereby
34 authorizes the Mayor to execute the Task Order. The Mayor is further authorized to execute any
35 ancillary documents as may be necessary to accomplish the purpose of this Resolution.
36 SECTION 4. The City Clerk shall retain the fully executed Task Order as a public record
37 of the City. A copy of the fully executed Task Order shall be provided to Adrianna Greco-Arencibia
38 to forward to the Consultant.
39 SECTION 5. This Resolution shall take effect in accordance with the law.

Consultant: Miller Legg
1. Task/Project. Jaycee Park Improvements
2. Detailed Scope of Professional Services.
A detailed scope of services under this Task Order, in accordance with the phases of service detailed
in the Agreement, is attached as Exhibit A.
3. Deliverables and Schedule.
For study/design related services: Consultant shall deliver to the City the deliverables specified at
the time indicated on the attached Exhibit B.
For project administration services: Consultant shall provide project/construction administration
services in accordance with the Agreement and project schedule.
4. Compensation.
The total estimated construction costs of the Project or the cost of the study or report for this Task
Order may not exceed the amounts set forth in Section 287.055, Florida Statutes.
The total Fee to be paid to the Consultant under this Task Order shall not exceed $186,345, based
on the hourly rates currently in effect under the Agreement.
A detailed fee schedule is attached as Exhibit A.
The payment schedule (based on deliverables) is attached as Exhibit A.
5. Agreement Reference.
This Task Order shall be performed under the terms and conditions described within the General
Engineering Consulting Services Agreement, dated November 21, 2024 by and between the City of
Boynton Beach and Miller Legg ("Consultant"), Contract No.
6. Insurance.
Consultant shall maintain insurance coverages in accordance with the Agreement and hereby
confirms that Certificate(s) of Insurance evidencing current policies meeting the requirements of
the Agreement are on file with the City as of the date of this Task Order.
7. Exhibits.
All attached Exhibits are incorporated fully into this Task Order and the Agreement.

EXHIBIT A—SCOPE OF SERVICES
Jaycee Park Improvements (the "Project")
1.0 PROJECT DESCRIPTION
1.1 The Project is generally described as follows: Consultant shall provide survey,
SUE, site planning, landscape architecture, and civil engineering services for
the proposed improvements to Jaycee Park, located at 2600 Federal Hwy,
Boynton Beach, FL. Refer to Exhibit B for Project Boundary.
2.0 BASIS OF SCOPE
This scope was prepared based on the Consultant's understanding of the Project information
provided by Anderson Slocombe, City of Boynton Beach, both via email on February 12,
2025, and during a site visit conducted on March 5, 2025. Consultant reserves the right to
amend this scope should the proposed layout change.
2.1 General:
• The Client and Owner for this proposal is the City of Boynton Beach, and the
Consultant is Miller Legg.
• The purpose of this scope is to renovate the existing park to include the following
improvements:
• Parking Lot Expansion
• Additional parking spaces (14 spaces or maximum possible).
• Reconfiguration of drainage swale/ drainage mitigation.
• Removal of existing landscaping, picnic tables/ stools, slabs, etc. as
necessary to accommodate new work
• Playground/equipment & Paved plaza area:
• Demolition/ removal of existing playground and equipment.
• Demolition/ removal of existing paved plaza area, existing picnic tables,
stools, etc. as necessary to accommodate new work.
• Re-design/ reconfiguration of area to accommodate new open green
lawn area with a small playground/ equipment area adjacent — located
Northeast of the existing playground.
• Maintain public access to restrooms.
• It is the City's intent to save the large existing tree in that area
• Install new decorative aluminum fencing along west border of the site.
Exact location/ routing to be determined in the field.
• Demolition / Removal of existing gate system and install new manual
swing arm vehicular gates at the park/ parking lot entrance.
• Improve walkway transition at boardwalk entry. No improvements to
boardwalk.
• Permitting and construction for the project scope will be completed in one (1)
phase. Phasing plans are not included in the scope. If requested, phasing plans
shall be provided as an additional service.

• The Client will assist with the coordination of the submission of the Site Plan
approvals. Consultant shall provide support in the form of landscape architecture,
and engineering drawings, exhibits, and calculations during this process.
Consultant shall attend one (1) pre-application meeting with the planning and
zoning board. of the Site Plan approval process under this scope.
• This scope includes all applicable codes including current Florida Building Code
provisions and the adopted 8th edition, 2023 FBC.
• Engineering approvals will be required from Authorities Having Jurisdiction
(AHJs) including the City of Boynton Beach, South Florida Water Management
District (SFWMD), and Florida Department of Transportation (FDOT).
▪ If an Agency Having Jurisdiction (AHJ) issues or implements design or
development code changes that differ from those in place at the time of execution
of this scope/agreement, and which trigger changes or revisions to the scope at
any stage of the Project, an additional service will be issued by Consultant. This
includes but is not limited to design criteria of utilities, storm water management
systems, or flood elevation changes.
• Consultant will attempt to supply all required deliverables in an expeditious
manner. However, Consultant has no control of City procured deliverables or
Authority Having Jurisdiction (AHJ) review timelines, which may ultimately affect

the Client's projected schedule. Failure to complete the Project for reasons
beyond the control of Consultant will not void this agreement. Work performed
will be invoiced as a percentage of the fee for said task.
• Application fees for governmental agency permitting are not included in this
scope. Consultant shall prepare and update site related permitting dates and
estimated permit fees during the design process.
• Consultant does not guarantee the scope will result in issuance of permit(s) or
approvals by the regulatory agencies. Issuance of permits is a discretionary
decision which ultimately may not be based solely on the scope of the
Consultant's work.
• The site is not subject to any requirements stemming from a Phase 1 or Phase 2
environmental site assessments (ESA). All previous environmental reports and
regulatory enforcement documents shall be required prior to the start of an
Agreement.
• Services such as environmental and protected species studies/monitoring
services are not included in this scope but can be provided as an additional
service at Client request.
• Project specifications are included and limited to the following:
• Review and editing of City's Special Conditions
• All site work, civil engineering, landscape and irrigation notes,
specifications and details will be provided on the plans.
• Construction services are included within this scope of services. Construction
administration limited to progress meeting attendance, pay application review and
recommendations, response to request for information (RFI) and resolution. On-
site field reviews shall be limited to RFI resolution and milestone reviews. Plan
revisions for unforeseen features or additional scope of work are not included in
this scope but can be provided as an additional service at Client request.
• Such visits and observations are not intended to be an exhaustive check
or a detailed inspection of the Contractor's work, but rather to allow
Consultant, as an experienced professional, to become generally familiar
with the work in progress and to determine whether the work is proceeding
in accordance with the contract documents.
• Based on this general observation, Consultant shall keep Client informed
about the progress of the work and shall endeavor to guard Client against
deficiencies in the work. If Client desires more extensive project
observation or full-time project representation, an additional service
proposal for these services can be provided upon request.
• Consultant shall not supervise, direct, or have control over the
Contractor's work, nor will it have any responsibility for the construction
means, methods, techniques, sequences, or procedures selected by the
Contractor, or for the contractor's safety precautions or programs in
connection with the work. These rights and responsibilities are solely
those of the contractor in accordance with the contract documents.

• Consultant shall not be responsible for any acts or omissions of the
Contractor, subcontractor, or any entity performing any portions of the
work, or any agents or employees of any of them. Consultant does not
guarantee the performance of the Contractor and shall not be responsible
for the Contractor's failure to perform its work in accordance with the
contract documents or any applicable laws, codes, rules, or regulations.
• Project Construction is anticipated to take up to five (5) months, if
construction is extended for reasons beyond the Consultants control
additional construction services can be provided as an additional service
at the Client's request.
• Additional construction observation/coordination efforts or site visits resulting
from contractor not being prepared for a scheduled/required inspection or testing,
failed tests or inspections. Contractor shall notify Consultant a minimum of 24
hours prior to any tests or site inspections to which the Consultant attendance
may be required. Failure to do so may result in Consultant not being able to grant
such request.
2.1 Survey:
• ALTA/NSPS Land Tittle Survey/Title Exception Review are not required.
• The survey will be based on legal description provided by Client.
• Special certification will be provided by Client.
• Horizontal Datum will be referenced to the State Plane Coordinate System.
Florida East Zone, North American Datum of 1983, Adjustment of 2011, (NAD
83/2011), will be identified on the Survey.
• Vertical Datum will be referenced to the North American Vertical Datum of 1988,
(N.A.V.D. '88), will be identified on the Survey.
• A topo of half right-of-way and on the east side up to the west tree line of the
heavy vegetation. No bathymetric survey shall be performed in the water.
• Parking spaces will be shown and identified.
• If boundary inconsistencies (i.e. overlaps, hiatuses)with adjoiners exist, a survey
report per minimum technical standards may be required and an additional fee
may be negotiated.
• Location of underground utilities are based on company or Consultant's
designations. Consultant cannot guarantee that all utilities will be located.
• If Title of Opinion is not performed or provided, Client assumes liability for missing
recorded information.
2.2 Subsurface Utility Engineering (SUE) Services:
• Utility designation is being provided in an attempt to prevent the likelihood of damage
during excavation and/or provide design information. See Exhibit B for SUE Limits.

• Results are dependent upon field conditions at the time of locating services.
• American Public Works Association (APWA) standards are used for marking.
• Consultant shall provide marking services; CAD drawing will provided.
• Consultant is not responsible for moved, altered, obliterated or maintaining marks.
Consultant will impose an additional fee to relocate/re-mark facilities.
• Consultant is not responsible for errors and omissions of recorded utility information.
• Information provided by Consultant is for informational purposes and is intended to
be used prior to excavation. Prior to Project construction, the excavating contractor
is responsible for securing locations of public utilities through Sunshine State One
Call of Florida (800-432-4770).
• The performance of Consultant's services is limited to full and unobstructed access
including, but not limited to: mechanical rooms, manholes, hand holes, vaults, meter
rooms, telecom rooms, fixtures (plumbing, electrical, communication), dispensers,
fenced compounds,tanks and structures. Full cooperation from the on-site personnel
is necessary to perform a complete survey.
• All fees within this proposal are based on performing each task one (1) time only.
Additions or modifications to the scope, re-staking as well as resulting CAD and
Project management time, will be invoiced per the attached hourly Rate Schedule,
unless said additions and modifications are requested as an additional service.
• Failure to complete the Project for reasons beyond the control of Consultant will not
void this agreement. Work performed will be invoiced as a percentage of the fee for
said task.
2.3 Site Planning / Landscape Architecture:
• Landscape and Site plans shall meet City of Boynton Beach minimum standards
for Site Plan Approval.
• Site amenities are included in this scope and are outlined under 2.1 General
section.
• Irrigation for the site is included in the scope of work. There is an existing system.
Point of connection will be to the existing system and its municipal source.
• Site Plan documents submittal and permitting assistance are included within this
scope. Vacating existing rights-of-ways, easements, or platting services, public
outreach, rezoning, special permit, or land use plan amendment (LUPA)
processes are not included in this scope of services. If required, these can be
provided as additional services.
• There are existing trees on site; tree removal may be required; the permitting
agency is City of Boynton Beach.
2.4 Civil Engineering:

• Legal positive outfall exists to serve the site and will be used as a means of
conveying stormwater runoff to the Intracoastal Waterway adjacent to the site.
• Should civil engineering design or permitting requirements vary or extend beyond
this Basis of Scope, additional design and permitting services may be required
(e.g. improvements outside of project area, etc.) Refer to Exhibit B for Project
and scope limits.
• This scope does not include design or permitting of domestic water, sanitary
sewer, or fire service utility improvements.
• This scope does not include electrical services, service lines, duct bank or
transformer design. This service shall be provided by Client's MEP Consultant.
• Traffic, parking or signalization studies (or updates to previously issued studies)
are not included in this scope. If AHJs determine these are required, they could
be provided as additional services.
• Off-site roadway or traffic improvement such as roadway widening, turn lanes,
intersection improvements, or traffic signalization are not included in this scope.
Should these services be required as a result of AHJ reviews, Consultant shall
assist with these tasks as an additional service.
• All required Maintenance of Traffic (MOT) designs/operations shall be provided
by Contractor and approved by Owner. MOT plans are not included in the scope.
• Any required National Pollutant Discharge Elimination System (NPDES) permit
from Florida Department of Environmental Protection (FDEP) will be obtained by
the Contractor.
• Periodic inspection and reporting of the approved SWPP plan per NPDES
requirements is not included in the scope. If required, Consultant could assist with
these tasks as an additional service.
• Consultant shall provide locations for geotechnical services to City as required
for paving and earthwork. Drainage design calculations will be provided by others.
Soil borings, percolation tests, and pavement section design recommendations
shall be included as part of geotechnical investigation provided to the Consultant.
• Scope does not include design, permitting or coordination services for non-civil
utilities (chilled water, gas, electrical, IT/communications). These will be provided
by Client, Owner, utility provider or Contractor.
• Consultant shall prepare stormwater management calculations. These may
include preparation of drainage analysis and associated pipe/structure sizing as
required for the proposed on-site improvements. confined to within the project
area (see Exhibit B). Should calculations or improvements extend beyond the
Project area due to Regulatory Agency review requirements, they will be provided
as additional services.
• Based on the location of the Project, the use of a drainage well may be necessary
as a means of stormwater discharge. Design of a gravity drainage well is included
in this scope. Design of a pumped drainage well (should it be required) shall be
performed as an additional service.

• FEMA floodplain analysis, study or map amendment is not included in this scope.
If required, Consultant can assist with these tasks as an additional service.
2.5 Information to be provided by Client:
• Electronic CADD files of prior survey and existing site plan.
• Authorization from property owner shall be provided as necessary to enter the
Property and conduct this investigation.
• As coordinated by Consultant identified locations, City shall provide geotechnical
services including soil borings, standard percolation (determination of the 'k'
value), paving/asphalt, and structural reporting and recommendations.
• Permit fees, assessments, impact fees or other application fees associated with
implementation of project scope.
• Previous reports and assessments, including Phase 1 or 2 environmental site
assessments (ESA).
• Copies of all relevant data, including correspondence, reports, plans or
information in its possession which may be beneficial to the work effort performed
by the others required for Consultant's services.
3.0 SCOPE OF BASIC SERVICES AND FEE
The scope of services to be provided by consultant shall be as follows:
SURVEY TASKS
Task 1 Boundary & Topographic Survey - Consultant shall prepare a boundary and
topographic survey of the Project establishing the perimeter of the property in
accordance with the legal description provided by the Client. The survey shall show
aboveground boundary encroachments, interior improvements, rights-of-way and
easements of record as shown on applicable recorded plats adjoining or across the
property. If easements or rights-of-way of record, other than those shown on
recorded plats, are required, this information must be furnished to Consultant. The
survey shall show topographic elevations on a 50-foot grid for hardscape areas and
100'for non-hardscape. Trees located will be native 3-inch DBH and larger and shall
be depicted as tree or palm and as DBH from approximate center of the tree or palm.
Species shall be identified. Invasive /exotic trees will NOT be located and will NOT
be depicted on the survey. Tree species specific arborist identification and
assessment is included in Arborist Tree Inventory & Evaluation Task.
SUBSURFACE UTILITY ENGINEERING (SUE)TASKS
Task 2 Underground Utility Designation and Mapping — Consultant shall provide utility
designation and mapping services at the above referenced Project; see Exhibit B for
SUE Limits.APWA standards are used for marking. A subsurface ground penetrating
radar (GPR) unit will be used in addition to electromagnetic induction (EM) to
perform/verify horizontal locations of any detectable utility. A GPR unit can assist in

identifying nonmetallic utilities and other structures that are unidentifiable using
traditional electromagnetic techniques. Factors such as soil moisture clay content,
and variations in the dielectric constants of materials control the effectiveness of the
GPR method. Additionally, passive VLF signals can be detected on other metallic
utilities that are typically long in length are well grounded electrically.
Designating underground utilities is not an exact science. Therefore, Consultant
expresses no guarantees that using one or any of the available technologies for
identifying utilities/structures will identify all utilities/structures and/or meet the
objective of each individual Project. Client understands that limitations within the
available technology, the complexity of site conditions and circumstances beyond the
control of Consultant may limit the performance/results of Consultant's services.
The services provided by Consultant shall be performed in accordance with generally
accepted professional practices as related to the nature of services performed.
Consultant cannot guarantee that all utilities within any given survey area will be
identified due to inherent limitations within technology and existing site conditions.
Utility location is being provided in an attempt to prevent or reduce the likelihood of
damage during excavation and/or provide design information.
Task 3 Arborist Tree Inventory & Evaluation - Consultant shall prepare a tree inventory
and evaluation by an International Society of Arboriculture (ISA) Certified Arborist
showing locations of trees pursuant to City of Boynton Beach code. Inventory shall
show hardwood and palm trees only: Invasive exotics shall not be located. Trees
located will be 3-inch DBH and larger, within the subject property boundary. The tree
inventory and evaluation shall reflect the following data to meet the requests of the
City of Boynton Beach tree species; common and scientific names; dbh (diameter at
breast height) for dicot trees; clear trunk, grey wood, or overall heights for palms;
canopy spread, and general health/condition/ hazard determination as evaluated by
an ISA Certified Arborist. The location of trees will be recorded using a differential
global positioning satellite (dGPS)and displayed on map with aerial background. This
task does not include tree disposition or permitting.
Task 4 Schematic Design (30%)—Based upon the Client-provided programming approach,
a preliminary site layout shall be produced, including a color rendering site plan.
Submittal documents to be submitted in presentation exhibits.
A. Site Plan Schematic Design - Consultant shall prepare a preliminary site plan
including color rendering.
B. Landscape Architecture Schematic Design — Consultant shall provide
preliminary data required for tree disposition, conceptual planting, and site
amenities including preliminary playground design. Irrigation shall be schematic
identifying water source and area.
C. Site Civil Schematic Design — Consultant shall prepare a 30% Civil Schematic
Design (SD) Plan showing the general alignment and layout of parking areas
including vehicular and pedestrian access/circulation, storm drainage lines and
preliminary grading. Consultant shall research, and compare available utility
maps, as-builts and existing site conditions for potential limitations and conflicts
of the proposed systems and other constraints that may impact design and
permitting.

D. Schematic Opinion of Probable Cost - Consultant shall prepare a 30%
Schematic OPC for the Project. The opinion shall address Schematic buildings ,
tree impacts / tree mitigation, site amenities, earthwork, paving, drainage,
improvements.
Task 5 Design Development (60%) — Based upon the Client-approved 30% submission,
Design Development documents shall be produced, including an updated color
rendered site plan. Consultant shall prepare 60% Design Development Documents
to a level of completeness required for Site Plan Submittal, provided within the Site
Plan Assistance task which includes Site Plan modification review and approval.
A. Design Development Site Plan- Consultant shall update design development
site plan including updated color rendering.
B. Landscape Architecture Design Development — Consultant shall provide
updated data required for tree removal, planting species and site amenities.
Irrigation shall identify water source and components. Manufacturer cut sheets to
be assembled for Client review.
Consultant shall review a tree survey and prepare data on the existing site
conditions to prepare tree removal documents for the Project. The documents
will designate existing trees to be preserved or removed as well as new trees
necessary for replacement credits, if required. The documents shall include
plans, details, tree credit and replacement charts, and notes for the proposed tree
preservation, removal, and relocation activities meeting the minimum
requirements of the City of Boynton Beach. The documents will be submitted to
the City of Boynton Beach for review.
Consultant shall prepare landscape design documents meeting the program and
minimum requirements for the City of Boynton Beach. The documents shall
include plans, details, quantities, notes and size specifications for the installation
of the proposed landscape.
Consultant shall prepare site amenities design documents showing the layout of
site furnishings and playground equipment including material and color selection.
C. Site Civil Design Development Documents — Based upon the Client-
approved Schematic Design, Consultant shall prepare 60% Design
Development Documents (DDs) for site civil improvements including site
demolition/clearing, vehicular and pedestrian access/circulation, paving,
grading, and drainage. The DDs will be prepared to a level required for Site
Plan modification review and approval.
Consultant may also reference on the civil drawings background the alignment of
non-civil utilities such as chilled water, gas, IT/communication, and electrical
utilities on the Design Development Documents. The design, alignment and
associated sizes/depths of these non-civil utilities shall be provided to Consultant
by Client's MEP Consultant in CAD format.
Under this task Consultant shall also prepare preliminary stormwater
management calculations. This includes preliminary drainage analysis limited to
the Project area (reference exhibit B).

D. Design Development Opinion of Probable Cost - Consultant shall prepare a
60% Design Development OPC for the Project. The opinion shall address design
development improvements including tree impacts / tree mitigation, site
amenities, earthwork, paving, drainage improvements.
Task 6 Site Plan Assistance — Based upon the 60% submission, Consultant shall prepare
plans for Site Plan review.
A. Site Plan Documents Consultant shall submit final Design Development
Documents to Client for Site Plan review. After the initial review, Consultant will
assist Client with responses to submission and address compiled comments in
an expeditious manner. However, Consultant is not responsible for regulatory
agency internal review timelines.
B. Meeting Attendance Consultant shall attend up to two (2) in-person meetings or
conference calls with Client.
Task 7 Construction Documents (100%) - Based upon the Client-approved 60%
submission, Consultant shall prepare construction documents, address final Site
Plan comments, prepare, and submit permit documents and 100% OPC. Consultant
shall prepare Construction Documents to a level of completeness required for
permitting agency submittals.
A. Landscape Architecture Construction Documents —Consultant shall prepare
100% construction plans for Tree Disposition, Landscape, Site Amenities,
Irrigation and associated details.
Proposed shade structure structural footers shall be coordinated with structural
subconsultant.
Consultant shall prepare planting construction documents for tree mitigation,
meeting the minimum requirements for the City of Boynton Beach. The
documents shall include plans, details, quantities, notes and size specifications
for the installation of the proposed landscaping.
The construction documents will include location, quantity and size of proposed
irrigation materials for installation.
B. Site Civil Construction Documents — Based on the Client and Site Plan
happroved 60% Design Development documents, Consultant shall prepare
Construction Documents (CDs)to a level of completeness required for
Contractor bidding and permitting agency submittals.
Consultant shall prepare the final engineering plans, supporting documents and
calculations for site civil improvements including site demolition/clearing,
vehicular and pedestrian access/circulation, paving, drainage, and final grading.
Consultant may also reference on the civil drawings background the alignment
of non-civil utilities such as chilled water, gas, IT/communication, and electrical
utilities on the Construction Documents. The design, alignment and associated
sizes/depths of these non-civil utilities shall be provided to Consultant by
Client's MEP Consultant in CAD format.

100% CDs shall be used for initial permit submittals to AHJs. Final CDs will be
produced and issued based on revisions made as a result of the permitting
process through AHJs..
Under this task Consultant shall also prepare final stormwater management
calculations. This includes preliminary drainage analysis limited to the Project
area (reference exhibit B).
C. Construction Documents Opinion of Probable Cost-Consultant shall prepare
a construction OPC for the Project. The opinion shall address proposed
buildings, tree impacts / tree mitigation, site amenities, earthwork, paving,
drainage improvements.
Task 8 Permitting Assistance
A. Tree Removal Permitting — Consultant shall prepare a vegetation/tree removal
permit application and support documentation that includes plans, location maps,
mitigation tables and other information as required for permitting existing trees
proposed for removal or relocation. This includes mitigation of trees on the
landscape plan. Consultant shall then submit the tree removal permit application
package to the City of Boynton Beach for removal/relocation activities associated
with the existing trees on site. This Task does not include the application fee
required for tree removal/relocation.
B. Civil Government Agency Permitting — Consultant shall assist Client in
preparing and submitting site engineering permit applications, plans, and support
data to AHJs including:
• City of Boynton Beach
• South Florida Water Management District (SFWMD)
• Florida Department of Transportation (FDOT)
After the initial permit application submittal, Consultant will respond to, and
address compiled regulatory agency review comments in an expeditious manner.
However, Consultant is not responsible for regulatory agency internal review
timelines.
Additional permitting and coordination services as a result of Client revisions or
agency review comments which may extend/expand the scope of the Project
beyond the stipulations outlined under Section 2.0 Basis of Scope, shall be
performed as an additional service.
C. Building Permit Approval Process Assistance—Client shall be responsible for
preparation, submittal, and processing of the Building Permit approvals through
the City of Boynton Beach. Consultant shall submit Construction Documents to
Client for submittal. After the initial Building Department submittal, Consultant will
respond to and address compiled comments in an expeditious manner. However,
Consultant is not responsible for regulatory agency internal review timelines.
Task 9 Final Plans - Based on the Client, and AHJ approved 100% Construction
Documents, Consultant shall prepare Final Plans to a level of completeness required
for Contractor bidding. Final Plans shall be accompanied by a Final OPC.

A. Landscape Architecture Final Plans — Subconsultant shall prepare Final
Construction Documents, plan specifications, and details.
B. Civil Engineering Final Plans—Subconsultant shall prepare Final Construction
Documents, plan specifications, and details.
C. Final Plans Opinion of Probable Cost—Consultant shall prepare a construction
OPC for the Project. The opinion shall address proposed buildings, tree impacts
/ tree mitigation, site amenities, earthwork, paving, drainage improvements. The
OPC is not a construction estimate.
Task 10 Construction Services — Consultant shall provide general construction services as
outlined below:
A. Bidding Assistance — Consultant shall assist Client with preparing bid
documents, coordinate with Client and attend up to one (1) pre-bid meeting
to assist City with bid documents; and respond to up to twenty (20) Bidding
Contractor's Requests for Information (RFIs). Consultant shall attend
additional meetings at the direction of Client upon additional service approval.
B. Pre-construction Conference - Consultant shall coordinate with Client and
attend one (1) pre-construction conferences. Consultant shall attend
additional meetings at the direction of Client upon additional service approval.
C. Construction Administration - Consultant shall coordinate with Client and
Contractor on construction interpretations and clarifications of approved
drawings and review of requested substitutions. Under this task, Consultant
shall also provide services limited to the following:
• Limited field observation documentation.
• Review shop drawing documentation for project features.
• RFIs related to project issues/materials.
• Response to comments made by the Authorities Having Jurisdiction
over the project and its inspectors during the construction phase and
will make the necessary revisions to their drawings.
• Limited pay application review and coordination to assist City project
manager approvals.
• Sitework Change Order Requests.
D. Construction Observation - Consultant shall assist Client with limited
construction observation services. Consultant will perform site visits for
verification of site work compliance and for certification of the Project through
the AHJs by providing limited site visits for milestone or RFI resolution to
observe site work, including installation of underground piping and general
site civil improvements. Consultant will observe system testing confirming that
the site work is completed in substantial compliance with the approved plans
and specifications.
E. Construction OAC/Progress Meetings—Consultant shall attend up to five
(5) monthly construction progress (OAC) meetings or virtual/conference calls
on an as-needed basis. Client shall prepare minutes of such meetings for

distribution to meeting attendees. Attendance at additional construction
progress meetings will be provided as an additional service.
F. Landscape Inspections and Statement of Work—Consultant shall provide
one (1) preliminary walkthrough and provide a deficiencies list and one (1)
final walkthrough and statement of work.
G. Civil Engineering Project Close-Out and Final Certifications—Consultant
shall review final as-built drawings submitted by Contractor and prepared by
a registered surveyor. Up to two (2) review rounds are included in this scope.
Additional as-built reviews after the initial two (2) rounds shall be performed
at the direction of Client and billed on an hourly NTE basis. Upon acceptance
of final as-built drawings, Consultant shall prepare a Statement of Work
Completion and final certification letters to the applicable AHJs.
H. Civil Record Drawings - Based on reviewed and accepted Contractor as-
builts and "red line" documented drawings "Field Record Set" provided by the
County from the Contractor, Consultant will compile and issue Record
Drawings for Civil related trades only.
Task 11 Reimbursable Expenses—Consultant shall be paid a reimbursable fee NTE (not to
exceed) $3,000 for reimbursable expenses. This fee is for customary costs, travel,
and excludes subconsultants. This fee may be increased in the event Client
authorizes additional services.
