3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON
4 BEACH, FLORIDA, ESTABLISHING GUIDELINES AND APPOINTING
5 MEMBERS TO SERVE ON THE CHARTER REVIEW COMMITTEE;
6 PROVIDING FOR AN EFFECTIVE DATE.; AND FOR ALL OTHER
7 PURPOSES.

9 WHEREAS, the Charter of the City of Boynton Beach, Florida, is the constitutional
10 document for the City, establishing the underlying structure of City government; and
11 WHEREAS, the City Commission has in the past created Charter Review Committees to
12 review the Charter and make recommendations as to items that should potentially be amended;
13 and
14 WHEREAS, the last Charter Review Committee was in 2011; and
15 WHEREAS, the Charter has not been subject to a Charter Review for over ten (10) years,
16 and the Commission believes it is time to create another Charter Review Committee to conduct
17 such a review.

19 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON
20 BEACH, FLORIDA, THAT:
21 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as
22 being true and correct and are hereby made a specific part of this Resolution upon adoption.
23 SECTION 2. The City Commission hereby creates a Charter Review Committee to be
24 composed of five (5) members.The Charter Review Committee is hereby authorized to review and
25 propose changes to the Charter of the City of Boynton Beach. The Committee shall function in an
26 advisory capacity to the City Commission.
27 SECTION 3. The Mayor, Vice Mayor, and Commissioners will each appoint one member
28 who must be a City resident. Any vacancy occurring on the Committee shall be filled by the
29 appointing Mayor, Vice Mayor, or Commissioner who made the appointment. Membership shall
30 be sought from persons of knowledge, experience, mature judgment, and background, having
31 the ability and desire to act in the public interest and representing, insofar as possible, the various
32 special professional training, experience, and interests to make informed suggestions for
33 amendments to the City's Charter. At least three (3) of the nominations made by the City
34 Commission shall be sought from the following professions: 1) Attorneys, 2) Previous/current
35 elected officials, 3) Individuals with extensive professional experience in City or County
36 Government, 3) Professors/academics well versed in local government 4) Historians, or 5) Public
37 finance professionals. The Commission shall ratify its appointees to the Committee at the August
38 5, 2025, regular City Commission meeting or as soon as possible thereafter.
39 SECTION 4. The Commission will then hold a joint sunshine meeting with the
40 Committee to provide the Committee with guidance on the questions it shall consider.
41 SECTION 5. The Committee members shall elect a chair, a vice chair, and other officers
42 as may be deemed necessary at their first meeting after their appointment, who shall serve at the
43 pleasure of the Committee. The chair shall preside over meetings of the Committee, shall be the
44 spokesperson for the Committee, and cause to be carried out such other business as the
45 Committee deems necessary.In the absence or unavailability of the chair, the vice chair shall serve
46 as presiding officer. The vice chair shall have and exercise all duties of the chair for meetings over
47 which they are called to preside.
48 SECTION 6. A City staff liaison and an attorney from the City Attorney's office will attend
49 meetings as support personnel. The City staff liaison will prepare agendas, post meetings, attend
50 meetings, and prepare minutes of the meetings.
Si SECTION 7. A majority vote of the Charter Review Committee shall be required to
52 submit amendments to the City Commission. The chair shall present the final Charter Review
53 Committee recommendations at the October 21, 2025, regular Commission meeting.
54 SECTION 8. The Charter Review Committee's recommendations shall be nonbinding,
55 and the City Commission shall have the sole discretion to determine which amendments it places
56 on the ballot, if any, the final wording of any amendments, and the timing of any election on
57 Charter amendments.
58 SECTION 9. Upon final approval by the City Commission, a referendum will be held
59 where an amendment is presented to the electorate for final adoption.
60 SECTION 10. The Charter Review Committee shall be considered a temporary advisory
61 board that will be dissolved by the Commission by majority vote. The members of the Committee
62 shall serve without monetary compensation. Members of other City boards may be members of
63 the Charter Review Committee as well.
64 SECTION 11. This Resolution shall take effect in accordance with the law.
