R25-163 1 RESOLUTION NO. R25-163 2 3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON 4 BEACH, FLORIDA, APPROVING AND AUTHORIZING THE ASSESSMENT 5 AND RECORDING OF NUISANCE ABATEMENT LIENS AGAINST 6 PROPERTIES IN THE PUBLIC RECORDS OF PALM BEACH COUNTY, 7 FLORIDA, WITHIN 60 DAYS AFTER THE ADOPTION OF THIS 8 RESOLUTION; AND FOR ALL OTHER PURPOSES. 9 10 WHEREAS, in accordance with the Municipal Lien Procedure on file in the City of Boynton 11 Beach, the attached list contains the addresses of properties cited by Community Standards for 12 nuisances abated by a City-contracted vendor; and 13 WHEREAS, the owners of the parcel(s) of property hereinafter described were invoiced by 14 the Finance Department in an effort to recoup these costs with no response within the required 15 30-day period; and 16 WHEREAS, said nuisance was not abated as required; and 17 WHEREAS, all the property owners listed in the attached Exhibit "A" were sent letters 18 offering them an opportunity to remit payment within 30 days to avoid incurring a lien on their 19 property; and 20 WHEREAS, Community Standards has made a report of costs incurred by the City and 21 abatement of said nuisance as to the property(s) involved, which are described in Exhibit "A" 22 attached to this Resolution; and 23 WHEREAS, upon passage of this Resolution, the property owners will be furnished with a 24 copy of this Resolution and given one more opportunity to remit all costs associated with the 25 abatement in full within 30 days after the passage of this Resolution before transmittal to the 26 County for recordation of Liens. 27 28 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON 29 BEACH, FLORIDA, THAT: 30 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as 31 being true and correct and are hereby made a specific part of this Resolution upon adoption. 32 SECTION 2. The amount of costs incurred by the City and the abatement of the above- 33 described nuisance as to the parcels of land owned and indicated, to wit: 34 SEE ATTACHED EXHIBIT "A" 35 The subject amount is hereby assessed as liens against said parcels of land as indicated, plus an 36 additional administrative charge of $30.00 for each Lien. Liens shall be of equal dignity with the 37 taxes therefrom for 2025 and shall be enforced and collected in like manner pursuant to applicable 38 law provisions. In the event collection proceedings are necessary, the property owner shall pay 39 all costs of the proceedings, including reasonable attorney's fees. 40 SECTION 3. The City Clerk is authorized to record this Resolution in the public records 41 of Palm Beach County, Florida. 42 SECTION 4.
