25-010 Li ORDINANCE NO. 25-010 2 3 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, 4 AMENDING CODE OF ORDINANCES PART III, LAND DEVELOPMENT 5 REGULATIONS, CHAPTER 2, LAND DEVELOPMENT PROCESS, ARTICLE 6 VI, IMPACT AND SELECTED FEES, AND PROVIDING AN EFFECTIVE 7 DATE. 8 9 WHEREAS, the City Commission desires to amend the mobility fee process pertaining 10 to impact and selected fees under the land development process, specifically to clarify which 11 development projects are subject to the mobility fee by updating triggering language in the 12 applicable section of the Code of Ordinances; and 13 WHEREAS, the City Commission finds that changing the triggering language in 14 Section 10.C of Part III, Land Development Regulations,Chapter 2, Land Development Process, 15 Article VI, Impact and Selected Fees from "applications submitted on" to "permits issued on" 16 will ensure that the appropriate mobility fee applies only to development permits issued on 17 or after May 20, 2025, rather than to any application submitted before that date; and 18 WHEREAS, the proposed change will provide consistency and fairness by aligning the 19 application of the mobility fee with the point at which a project is formally approved to 20 proceed, which will thus generate new travel demand; and Page 1 of 3 CODING Words in stfike4hfetigh type are deletions from existing law; Words in underlined type are additions. L21 WHEREAS, staff has determined that the proposed change will align the mobility fee 22 process with the City's treatment of all other impact fees, which are assessed and collected at 23 the time of permit issuance; and 24 WHEREAS, this will improve administrative efficiency and provide a clear, predictable 25 process for applicants and staff. 26 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF 27 BOYNTON BEACH, FLORIDA THAT: 28 Section 1. The foregoing "Whereas"clauses are true and correct and incorporated 29 herein by this reference. 30 Section 2. Chapter 2 "Land Development Process,"Article VI "Impact and Selected 31 Fees," Section 10. C "Mobility Fees" is hereby amended to read as follows 32 Sec. 10. Mobility Fees 33 C. Mobility Fee Imposition. The mobility fee imposed by this section shall 34 apply to new applications for development permits &witted issued on or 35 after May 20, 2025, for future development that results in an increase in person 36 travel demand above and beyond the current use of property. 37 38 Section 3. It is the intention of the City Commission of the City of Boynton Beach, 39 and it is hereby ordained that the provisions of this Ordinance shall become and be made a 40 part of the Code and Ordinances of the City of Boynton Beach, Florida.
