25-006 ORDINANCE NO.25-006 1 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF 2 BOYNTON BEACH, FLORIDA, AMENDING PART II, CHAPTER 27, 3 ARTICLE I, SECTION 27-2 "BOARD OR COMMITTEE MEMBER 4 SELECTION; ORGANIZATION; QUALIFICATIONS; TERM," 5 ESTABLISHING LIMITED AUTHORITY TO WAIVE CERTAIN 6 APPOINTMENT REQUIREMENTS;PROVIDING FOR CODIFICATION; 7 PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; 8 AND PROVIDING FOR AN EFFECTIVE DATE. 9 10 WHEREAS, Part II "Code of Ordinances," Chapter 27 "Advisory Boards and Committees," 11 Article I "In General," Section 27-2 "Board or Committee Member Selection; Organization; 12 Qualifications; Term" of the City's Code of Ordinances currently establishes specific requirements for 13 board and committee member selection,organization,qualifications,and terms;and 14 WHEREAS,the City Commission recognizes that strict adherence to these requirements may, in 15 certain circumstances,limit the City's ability to appoint the most qualified and suitable individuals to serve 16 on its boards and committees;and 17 WHEREAS, the City Commission has determined that limited authority to waive certain 18 requirements,including residency requirements,term limits,and certain qualification requirements,would 19 serve the best interest of the City; and 20 WHEREAS, such waiver authority would allow the City Commission to consider exceptional 21 candidates who may bring valuable expertise,experience,and perspective to City boards and committees 22 despite not meeting all standard requirements;and 23 WHEREAS,the City Commission has determined that this amendment serves the public health, 24 safety,and welfare of the citizens of the City of Boynton Beach. 25 NOW,THEREFORE,BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY 26 OF BOYNTON BEACH,FLORIDA: 27 Section 1: The foregoing"WHEREAS"clauses are hereby ratified as being true and correct 28 and are hereby made a specific part of this Ordinance upon adoption hereof. ORDINANCE NO.25-006 29 Section 2: Part II, Chapter 27, Article I, Section 27-2 "Board or Committee Member 30 Selection; Organization; Qualifications; Term" is hereby amended to read as follows: 31 Sec. 27-2. Board or committee member selection; organization; qualifications; term. 32 ••• 33 (f) Qualifications. Members and alternate members serving on advisory boards and committees shall 34 possess sufficient knowledge, experience, judgment or background necessary to competently serve the 35 board or committee to which they are appointed. Members and alternate members must also meet any 36 specific qualification requirements for their advisory board.However, if finding such persons after diligent 37 effort is difficult or impossible, as determined by the city commission, persons having comparable or 38 equivalent qualifications may be appointed.This provision shall not be applicable to qualifications imposed 39 by state statute or other similar regulations. 40 (1) In order to qualify for appointment to and to serve as a member of any board or committee of the 41 city, an individual must be an elector of Palm Beach County, Florida. 42 (2) In selecting individuals to serve on boards and committees of the city,preference shall be given to 43 individuals who are residents of the City of Boynton Beach; provided however, non-residents who own 44 property in the city,own a business within the city,or serve as an officer,director or manager of a business 45 located within the city may also qualify for appointment provided they possess qualifications or experience 46 required by the board or committee to which they are appointed; provided that residency within the City is 47 not required by ordinance or law. This provision shall not preclude the city commission from waiving the 48 residency requirement when a city-established board, committee, or commission requires unique 49 experience or qualifications. 50 (3) Individuals may not serve on more than one advisory board at a time. 51 (g) Term limits. ORDINANCE NO. 25-006 52 (1) No member or alternate member shall be appointed for more than two successive terms (original 53 term, plus one additional term). A member who has been appointed to fill an unexpired term shall remain 54 eligible to serve two full successive terms. This two-term limit may be waived upon a finding by the city 55 commission that a third or successive appointment is in the best public interest. 56 (2) Upon completion of the maximum allowable two full terms of membership,no member or alternate 57 shall be eligible for reappointment to the same advisory board or committee for a period of one year,unless 58 otherwise waived by the city commission. 59 (3) An individual who has served two successive terms as an alternate member may be eligible to serve 60 up to two additional successive terms as a regular member of the same advisory board or committee,upon 61 approval by the city commission. 62 ... 63 Section 3: Codification. It is the intention of the City Commission of the City of Boynton 64 Beach, and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of 65 the Code and Ordinances of the City of Boynton Beach, Florida, and that Sections of this Ordinance may 66 be renumbered,re-lettered and the word"Ordinance"may be changed to"Section,""Article,"or such other 67 word or phrase in order to accomplish such intention. 68 Section 4: Severability. If any clause, section,or other part of this Ordinance shall be held 69 by any court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional or invalid 70 part shall be considered as eliminated and in no way affect the validity of the other provisions of this 71 Ordinance. 72 Section 5: Conflicts. All Ordinances or parts of Ordinances, Resolutions, or parts of 73 Resolutions in conflict herewith, be and the same are repealed to the extent of such conflict.
