R25-238 RESOLUTION NO. R25-238 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, APPROVING THE INCREASE OF THE ANNUAL 3 EXPENDITURE FROM $2,400,000 TO $3,680,000 FOR ITB NO. PWE22- 4 008 FOR ASPHALT AND SIDEWALK REHABILITATION ON AN AS- 5 NEEDED BASIS, PROVIDED BY ATLANTIC SOUTHERN PAVING AND 6 SEALCOATING LLC, AND M&M ASPHALT MAINTENANCE INC., D/B/A 7 ALL COUNTY PAVING; AND FOR ALL OTHER PURPOSES. 8 9 10 WHEREAS, on April 5, 2022, the City Commission approved Resolution No. R22-057 11 awarding Bid No. PWE22-008 for asphalt and sidewalk rehabilitation on an as-needed basis to 12 Atlantic Southern Paving and Sealcoating LLC, and M&M Asphalt Maintenance Inc., d/b/a All 13 County Paving, and approving an Agreement with each awarded Vendor, for a budgeted amount 14 of $2,000,000 yearly for the services; and 15 WHEREAS, on December 17, 2024, the City Commission approved the renewal of the 16 Agreements through April 4, 2026, and increased the annual expenditure to $2,400,000; and 17 WHEREAS, in March 2025, the Commission further directed staff to accelerate resurfacing 18 projects in neighborhoods throughout the City to improve road conditions and enhance the 19 quality of life for visitors and residents. As of July 2025, the expenditure has approached this 20 revised budgeted annual expenditure; and 21 WHEREAS, to ensure the City can continue meeting resurfacing needs through the end of 22 the fiscal year without service disruption, staff is requesting Commission approval to increase the 23 annual expenditure to $3,200,000 for the remainder of the contract term. This adjustment will 24 provide the necessary capacity to process upcoming work orders and ensure timely payment to 25 the Vendor; and 26 WHEREAS, the City Commission, upon the recommendation of staff, has deemed it in the 27 best interests of the City's citizens and residents to approve the increase of the annual expenditure 28 from $2,400,000 to $3,680,000 for ITB No. PWE22-008 for asphalt and sidewalk rehabilitation on 29 an as-needed basis, provided by Atlantic Southern Paving and Sealcoating LLC, and M&M Asphalt 30 Maintenance Inc., d/b/a All County Paving. 31 32 RESOLUTION NO. R25-238 33 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON 34 BEACH, FLORIDA, THAT: 35 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as 36 being true and correct and are hereby made a specific part of this Resolution upon adoption. 37 SECTION 2. The City Commission of the City of Boynton Beach, Florida, does hereby 3$ approve the increase of the annual expenditure from $2,400,000 to $3,680,000 for ITB No. PWE22- 39 008 for asphalt and sidewalk rehabilitation on an as-needed basis, provided by Atlantic Southern 40 Paving and Sealcoating LLC, and M&M Asphalt Maintenance Inc., d/b/a All County Paving. 41 SECTION 3.
