12 WHEREAS,the City Commission of the City of Boynton Beach, Florida,adopted Ordinance
13 No. 23-006 approving the abandonment of the 225-foot long segment of the 20-foot wide right-
14 of-way located within the northern section of the proposed The Pierce development
15 approximately 175 feet south of the East Boynton Beach Boulevard centerline (a.k.a. "North
16 Alley"), the 220-foot long segment of the 40-foot wide NE 1st Avenue right-of-way, and the
17 335.02-foot long segment of the 20-foot wide right-of-way located within the southern section
18 of the proposed The Pierce development,approximately 150 feet north of the East Ocean Avenue
19 centerline (a.k.a. "South Alley"); and
20 WHEREAS, the parties discovered scrivener errors in the ordinance title and legal
21 descriptions of the 1st Street, North Alley, and South Alley abandonment areas; and
22 WHEREAS, the City Commission desires to correct the errors in the title and legal
23 descriptions; and
24 WHEREAS, the City Commission has determined that this amendment serves the public
25 health, safety, and welfare of the citizens of the City of Boynton Beach.

26 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
27 BOYNTON BEACH, FLORIDA:
28 Section 1: The foregoing "WHEREAS" clauses are hereby ratified as being true and
29 correct and are hereby made a specific part of this Ordinance upon adoption hereof.
30 Section 2: Section 2. Of Ordinance No. 23-006 is hereby repealed in its entirety and
31 replaced with the following language:
32 Section 2. The City Commission of the City of Boynton Beach, Florida, does hereby
33 abandon the 225-foot long segment of the 20-foot wide right-of-way located within the northern
34 section of the proposed The Pierce development approximately 175 feet south of the East Boynton

106 Section 4: Severability. If any clause, section, or other part of this Ordinance shall be
107 held by any court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional
108 or invalid part shall be considered as eliminated and in no way affect the validity of the other
109 provisions of this Ordinance.
110 Section 5: Conflicts. That all Ordinances or parts of Ordinances, Resolutions, or
111 parts of Resolutions in conflict herewith, be and the same are repealed to the extent of such
112 conflict.
113 Section 6: Effective Date. This Ordinance shall take effect immediately upon
