A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON
BEACH, FLORIDA, APPROVING THE CORRECTION OF THE LEGAL
3 DESCRIPTION AND MEASUREMENT OF A CITY-OWNED PARCEL
4 LOCATED AT THE SOUTHEAST CORNER OF NE 1ST AVENUE AND NE 4TH
STREET FOR THE CONVEYANCE OF PROPERTY FROM THE CITY TO BB
0 QOZ, LLC; AND FOR ALL OTHER PURPOSES.

C) WHEREAS, the City Commission found and determined that the City-owned parcel,
10 measuring 5' x 45', located at the southeast corner of NE 1st Avenue and NE 4th Street, was not
1 1 needed for City purposes and declared such property to be a surplus and available for disposition,
12 and approved the conveyance of the City-owned parcel, from the City to BB QOZ LLC, approved
13 by Resolution No. R25-232; and
14 WHEREAS, a survey of the parcel was conducted, and the surveyor provided an updated
15 legal description of the parcel; and
16 WHEREAS, the City Commission, upon the recommendation of staff, has deemed it in the
17 best interests of the City's citizens and residents to approve the correction of the legal description
18 and measurement of a City-Owned Parcel located at the Southeast Corner of NE 1st Avenue and
19 NE 4th Street for the conveyance of property from the City to BB QOZ, LLC.

21 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON
22 BEACH, FLORIDA, THAT:
23 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as
24 being true and correct and are hereby made a specific part of this Resolution upon adoption.
25 SECTION 2. The correct parcel information and legal description are as follows:
26 5' x 95' piece of real property generally located at the southeast corner of NE 1st Avenue and NE
27 4th Street, Boynton Beach, FL.
28 THE NORTH 5 FEET OF LOTS 6 AND 7, BLOCK 6 (ORIGINAL, TOWN OF BOYNTON, A SUBDIVISION
29 OF THE CITY OF BOYNTON BEACH, FLORIDA, ACCORDING TO THE PLAT THEREOF ON FILE IN
30 THE OFFICE OF THE CLERK OF THE CIRCUIT COURT, RECORDED IN PLAT BOOK 1, PAGE 23 LESS
31 THE WEST 5'.

31 SECTION 3. The City Commission hereby approves the correction of the legal
33 description and measurement of a City-Owned Parcel located at the Southeast Corner of NE 1st
34 Avenue and NE 4th Street for the conveyance of property from the City to BB QOZ, LLC.
35 SECTION 4. This Resolution shall take effect in accordance with the law.
