R26-011 RESOLUTION NO. R26-011 1 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON 2 BEACH, FLORIDA, AUTHORIZING THE EXECUTION OF AN INTERLOCAL 3 AGREEMENT BETWEEN THE CITY OF BOYNTON BEACH AND PALM BEACH 4 COUNTY, PURSUANT TO SECTION 171.046, FLORIDA STATUTES, 5 PROVIDING FOR THE ANNEXATION OF A PORTION OF AN ENCLAVE 6 TOTALING APPROXIMATELY 4.61 ACRES GENERALLY LOCATED AT 7 BAMBOO LANE AND VICINITY; PROVIDING FOR TRANSMITTAL TO THE 8 PALM BEACH COUNTY BOARD OF COUNTY COMMISSIONERS FOR 9 SUBSEQUENT ACTION; PROVIDING FOR AN EFFECTIVE DATE; AND FOR 10 ALL OTHER PURPOSES. 11 12 WHEREAS, section 163.01, Florida Statutes, known as the "Florida Interlocal Cooperation 13 Act of 1969" authorizes local governments to make the most efficient use of their powers by 14 enabling them to cooperate with other localities on a basis of mutual advantage, and to thereby 15 provide services and facilities which will harmonize geographic, economic, population, and other 16 factors influencing the needs and development of local communities; and 17 WHEREAS, the Florida Interlocal Cooperation Act of 1969 permits public agencies to 18 enter into interlocal agreements with each other to jointly exercise any power, privilege, or 19 authority which such agencies share in common and which each might exercise separately; and 20 WHEREAS, section 171.046, Florida Statutes, provides for annexation of certain enclaves 21 into a municipality by entering into an Interlocal Agreement between the municipality and the 22 county having jurisdiction over such enclaves; and 23 WHEREAS, section 171.046, Florida Statutes, limits annexation by Interlocal Agreement 24 to enclaves of one hundred and ten (110) acres or less in size; and 25 WHEREAS, section 171.031(5)(a) and (b), Florida Statutes, defines enclaves as developed 26 or improved property enclosed within and bounded on all sides by a single municipality, or 27 enclosed within and bounded by a single municipality and a natural or manmade obstacle that 28 allows passage of vehicular traffic to that unincorporated area only through the municipality; 29 and 30 WHEREAS, it has been determined that the parcels to be annexed via this Interlocal 31 Agreement, commonly known as Bamboo Lane, meet the requirements set out in sections 32 171.031(5)(a) and (b) and 171.046, Florida Statutes, as such enclave is developed or is improved, RESOLUTION NO. R26-011 33 is one hundred and ten (110) acres or less in size, and is completely surrounded by the City or is 34 surrounded by the City and a natural or manmade obstacle that allows passage of vehicular 35 traffic to the enclave only through the City; and 36 WHEREAS, the enclave identified for annexation in this Interlocal Agreement is 37 consistent with Objective 8.4 and Policies 8.4.1 through 8.4.6 of the Intergovernmental 38 Coordination Element of the City's Comprehensive Plan, which encourage the annexation of 39 enclaves and coordination with Palm Beach County regarding the prevention of undesirable land 40 configurations adjacent to corporate limits; and 41 WHEREAS, the County and the City have determined that it is appropriate for the 42 efficient provision of governmental services for the City to annex the enclave; and 43 WHEREAS, the City Commission of the City of Boynton Beach finds that the proposed 44 annexation of the subject enclave is in the best interest of the citizens of the City of Boynton 45 Beach and is in accordance with state and local law. 46 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON 47 BEACH, FLORIDA, THAT: 48 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as 49 being true and correct and are hereby made a specific part of this Resolution upon adoption 50 hereof. 51 SECTION 2. The City Commission of the City of Boynton Beach hereby approves the 52 Interlocal Agreement with Palm Beach County for the annexation of an enclave commonly 53 known as Bamboo Lane totaling approximately 4.61 acres, and authorizes the Mayor to execute 54 the Interlocal Agreement attached hereto as Exhibit A and incorporated herein by reference, on 55 behalf of the City of Boynton Beach and to do all things necessary to effectuate the terms of the 56 Agreement. The City Manager and City Attorney are hereby authorized to make any non- 57 substantive changes to the Interlocal Agreement necessary to effectuate the terms authorized 58 herein. 59 SECTION 3. Upon execution of the Interlocal Agreement, the City Clerk is hereby 60 directed and authorized to take all actions necessary to transmit the Agreement to Palm Beach 61 County for the County's consideration and execution. The City Clerk shall prepare and transmit RESOLUTION NO. R26-011 62 two (2) original executed copies of the Interlocal Agreement to the Palm Beach County Board of 63 County Commissioners, together with a formal transmittal letter to the Clerk of the Palm Beach 64 County Board of County Commissioners identifying the nature of the Agreement and requesting 65 placement on the Board's agenda for consideration and execution. Upon receipt of the fully 66 executed Agreement from Palm Beach County, the City Clerk shall ensure that one (1) original 67 executed copy is returned to the City and properly filed in the City's official records and shall 68 coordinate with the City Attorney's Office to ensure the fully executed Agreement is recorded in 69 the Public Records of Palm Beach County, Florida. The City Clerk is further authorized to take all 70 other actions reasonably necessary to effectuate the transmittal, execution, recording, and filing 71 of the Interlocal Agreement. 72 SECTION 4. Lamb 102 City Attorney INTERLOCAL AGREEMENT BETWEEN PALM BEACH COUNTY AND THE CITY OF BOYNTON BEACH FOR ANNEXATION OF BAMBOO LANE PURSUANT TO SECTION 171.046,FLORIDA STATUTES THIS INTERLOCAL AGREEMENT is made on this a day of 3CueNuutv-It , 2026, between the CITY OF BOYNTON BEACH, a municipal corporation located in PMm Beach County, Florida, hereinafter referred to as "City," and PALM BEACH COUNTY, a political subdivision of the State of Florida, hereinafter referred to as "County," each entity constituting a"public agency"as defined in Part 1,Chapter 163,Florida Statutes. WHEREAS, Section 163.01, Florida Statutes, known as the "Florida Interlocal Cooperation Act of 1969," as amended, authorizes local governments to make the most efficient use of their powers by enabling them to cooperate with other localities on a basis of mutual advantage, and to thereby provide services and facilities which will harmonize geographic,economic,population and other factors influencing the needs and development of local communities; and WHEREAS,the Florida Interlocal Cooperation Act of 1969 permits public agencies as defined herein to enter into interlocal agreements with each other to jointly exercise any power, privilege, or authority which such agencies share in common and which each might exercise separately; and WHEREAS, Section 171.046, Florida Statutes, provides for annexation of certain enclaves by entering into an interlocal agreement between the municipality and the county having jurisdiction over such enclave; and WHEREAS, Section 171.046, Florida Statutes, limits annexation by interlocal agreement to enclaves of 110 acres or less in size; and WHEREAS, Section 171.031(5)(a) and (b), Florida Statutes, defines enclaves as developed or improved property bounded on all sides by a single municipality, or enclosed within and bounded by a single municipality and by a natural or manmade obstacle that allows passage of vehicular traffic to that unincorporated area only through the municipality;and WHEREAS, it has been determined that the parcels to be annexed via this Interlocal Agreement meet the requirements set out in Sections 171.031(5)(a) and (b) and 171.046, Florida Statutes, as such enclave is developed or is improved, is 110 acres or less in size, and is completely surrounded by the City or is surrounded by the City and a natural or manmade obstacle that allows passage of vehicular traffic to the enclave only through the City; and WHEREAS, the County and the City have determined that it is appropriate and will promote efficient provision of governmental services for the City to annex the enclave;and WHEREAS, the enclave identified for annexation in this Interlocal Agreement is consistent with Objective 8.4 and Policies 8.4.1 through 8.4.6 of the Intergovernmental Coordination Element of the City's Comprehensive Plan, which encourage the annexation of enclaves and coordination with Palm Beach County regarding the prevention of undesirable land configurations adjacent to corporate limits;and ILA Boynton Beach/Palm Beach County Bamboo Lane Annexation 11.20.25(SRW) 1 WHEREAS, the County and the City agree that the parcels to be annexed via this Interlocal Agreement are subject to the Land Use Atlas of the Palm Beach County Comprehensive Plan and County zoning and subdivision regulations until the City adopts Future Land Use Map Amendment and Rezoning Ordinances for the annexed parcels;and WHEREAS,the City and County find that entering into this Agreement serves a valid public purpose. NOW, THEREFORE, in consideration of the mutual representations, terms, and covenants hereinafter set forth, the sufficiency of which is acknowledged by both parties, the parties hereby agree as follows: Section 1. Purpose The purpose of the Agreement is to allow annexation by the City of that certain unincorporated enclave,commonly known as Bamboo Lane,which parcels are further identified in Exhibit A attached hereto and incorporated herein by reference. Section 2. Recitals The above whereas clauses and recitals are incorporated into this Agreement as true and correct statements of fact. Section 3. Definitions The following definitions shall apply to this Agreement: 1. The term "enclave" shall be defined as set forth in Section 171.031(5)(a) and (b), Florida Statutes. 2. "Act"means Part 1 of Chapter 163, Florida Statutes. 3. "Agreement" means this Interlocal Agreement, including any amendments or supplements hereto, executed and delivered in accordance with the terms hereof. Section 4. Annexation The unincorporated enclave identified in Exhibit A is hereby annexed into and is included in the corporate boundaries of the City of Boynton Beach. Section 5. Effective Date This Agreement shall take effect upon execution by both parties. Section 6. Filing Upon execution by both parties,a certified copy of this agreement shall be filed by Palm Beach County with the Clerk of Circuit Court in and for Palm Beach County. Notification The City hereby acknowledges that it has provided written notice to all owners of real property located in the enclave identified in Exhibit A, whose names and addresses are known by reference to the latest published ad valorem tax records of the Palm Beach County Property Appraiser.The written notice described the purpose of the Interlocal Agreement and stated the date, time, and place of the meeting of the City Commission of the City of Boynton Beach, where this Interlocal Agreement is to be considered for adoption. The written notice also indicated the name and telephone number of the Palm Beach County staff person to contact regarding the date, time, and place the Board of County Commissioners is to consider the adoption of this Interlocal Agreement. Section 8. Captions The captions and section designations herein set forth are for convenience only and shall have no substantive meaning. Section 9. Severability In the event any section,paragraph, sentence, clause, or provision hereof is held by a court of competent jurisdiction to be invalid, such shall not affect the remaining portions of this Agreement,and the same shall remain in full force and effect. Section 10. Entire Agreement & Counterparts This Agreement represents the entire understanding between the parties concerning the subject and supersedes all other negotiations, representations, or agreements, either written or oral, relating to this Agreement.This Agreement may be executed in two or more counterparts,each of which shall be deemed an original, but all of which together shall constitute one and the same instrument.
