I. CALL TO ORDER
Hilary Zalman, Code Enforcement Special Magistrate, called the Hearings to order at
9:05 a.m., and explained the Magistrate's role and the procedures. Pursuant to Chapter
162, Florida Statutes, all orders are appealable only to the Circuit Court in Palm Beach
County and not to the City Commission. Also, a fine will be imposed if the violation(s) are
not corrected by the deadline.

was applied for January 28, 2026. He said that the owner informed him that he pressured
cleaned the driveway but that he has to go back out to verify.
Mr. Sims stated that he is waiting for approval from the City. He said that he removed the
outside storage and cleaned the driveway.

Patrick Hart, Code Enforcement Supervisor, advised Mr. Sims that his permit has failed
review for electrical and structural and that the permit is not in the process of getting
approved.

violations is regarding miscellaneous items that were left out in front of the property. He
stated that the boat can be parked on the property, but it has to be placed on a hard
surface or placed behind the roof line on a soft surface.
Mrs. Ziebarth questioned if rocks could be used as a hard surface.
Mr. Lawson recommended that Mrs. Ziebarth speak with someone in Planning & Zoning.

he was contacted by Solid Waste in December of 2025 and was notified that only 1 of the
dumpsters were serviced by the City since delivery. Mr. Patrick, along with the Solid
Waste supervisor, completed filed visits between December 11 , 2025, and December 16,
2025, and observed changes in the dumpster content levels. On January 27, 2026, Mr.
Patrick spoke with the general superintendent of the construction site, and he stated that
he thought recyclable material could be serviced by vendors other than the City. City
dumpsters were removed from the site on January 26, 2026. Property was last inspected
on January 30, 2026. This is not a health and safety hazard. The City recommends a one-
time payment in the amount of$5,000, plus administrative fees in the amount of$384.12.

Mr. Green stated that according to the City's website, 100% recyclable material is allowed
to be serviced by outside vendors. He said that everything on the construction site is

Jonathan Cane, Solid Waste Supervisor, was present. He stated that some of the
materials they observed in the dumpster were not recyclable. He commented that there
were drywall and dirt inside the dumpster.
Mr. Green commented that on the construction site, they use Coastal Waste. He stated
that Coastal Waste sorts everything themselves at their facility and that the recyclable
material is taken out.
Mr. Patrick provided Magistrate Zalman with photo evidence of the dumpster contents
and stated that Coastal Waste does not have the jurisdiction to service the City's
dumpsters.
Mr. Green provided Magistrate Zalman with a copy of the code.

Mr. Patrick explained that within the City limits it is required that the roll-out dumpsters be
rented from the City and adhere to the City's removal process.

the violations and brought everything into compliance. He commented that he invested

over $50k to restore the property. He stated that he would like to request a full reduction
on the lien.
Magistrate Zalman explained that for an investment property it is usually a 20%
reduction. She inquired about the $50K used to repair the property.
Mr. Minguez said that when he took control of the property, he had to remove an
unauthorized tenant through eviction. He stated that the interior of the home was in
terrible condition and that he had also replaced the roof. He said that the property is
currently listed for $390K and that he would like a reduction in the amount of $5,000.
Magistrate Zalman requested Mr. Minguez to make another offer.
Mr. Minguez countered with a $10K reduction.
Mr. Hart commented that he would agree to whatever Ms. Zalman recommends but that
the minimum he would like to see is at least $15k.
Magistrate Zalman stated that she was considering a 2.5% reduction to the amount of
$14,043.75.
Mr. Minguez made a counteroffer of$12,500.00.
Magistrate Zalman agreed to Mr. Minguez's counteroffer.
