1 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON
2 BEACH, FLORIDA, RATIFYING THE APPROVAL OF THE RENEWAL OF
3 THE CITY'S INSURANCE POLICIES FOR POLLUTION COVERAGE
4 WITH CRUM & FORSTER SPECIALTY INSURANCE COMPANY
5 THROUGH INSURANCE BROKER, BROWN&BROWN, FOR THE POLICY
6 TERM BEGINNING APRIL 30, 2026,AND ENDING APRIL 30, 2029;AND
7 FOR ALL OTHER PURPOSES.

9 WHEREAS, Crum & Forster Specialty Insurance Company is the current insurance provider
10 for Pollution Coverage. Approval of this item will allow the City to continue coverage for another
11 3-year term in an amount not to exceed $67,424.00; and
12 WHEREAS, the City Commission, upon the recommendation of staff, has deemed it in the
13 best interests of the City's citizens and residents to ratify the approval of the renewal of the City's
14 insurance policies for Pollution Coverage with Crum & Forster Specialty Insurance Company
15 through Insurance Broker, Brown & Brown, for the policy term beginning April 30, 2026, and
16 ending April 30, 2029.

18 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON
19 BEACH, FLORIDA, THAT:
20 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as
21 being true and correct and are hereby made a specific part of this Resolution upon adoption.
22 SECTION 2. The City Commission of the City of Boynton Beach, Florida, does hereby
23 ratify the approval of the renewal of the City's insurance policies for Pollution Coverage with Crum
24 & Forster Specialty Insurance Company through Insurance Broker, Brown & Brown, for the policy
25 term beginning April 30, 2026, and ending April 30, 2029, as further detailed in the Insurance
26 Proposal attached hereto as Exhibit A.
27 SECTION 3. The City Commission of the City of Boynton Beach, Florida, hereby ratifies
28 the execution of the Proposal by the City Manager. The City Manager is further authorized to
29 execute any ancillary documents as may be necessary to accomplish the purpose of this
30 Resolution.
31 SECTION 4. This Resolution shall take effect in accordance with the law.

2. This insurance is issued pursuant to the Florida Surplus Lines Laws. Entities insured by surplus lines
carriers do not have the protection of the Florida Insurance Guaranty Act to the extent of any right of
recovery for the obligation of an insolvent, unlicensed insurer.
3. Premiums are subject to change if all lines of coverage quoted are not bound. Premiums are subject
to 25% minimum premium upon binding.

5. The total premium is due within 30 days of inception. Premium financing can be arranged if

Retail Compensation Disclosure
Compensation: As a licensed insurance producer/broker/agent, Brown & Brown entities ("we") are generally
authorized by our license to confer with insurance purchasers about the benefits, terms and conditions of insurance
contracts; to offer advice concerning the substantive benefits of particular insurance contracts; to sell insurance; and
to obtain insurance for purchasers. Our role as an insurance producer in any ordinary transaction typically involves
one or more of these activities.
We will receive compensation in the form of commission or fees for assistance with the placement, servicing, claims
handling, or renewal of your insurance coverages. Commission compensation will be based on the insurance contract
you purchase and may vary depending on a number of factors including the insurance contract(s) and the insurer(s)
the purchaser selects. In addition to the commissions or fees received by us for assistance with the placement,
servicing, claims handling, or renewal of your insurance coverages, other parties, such as excess and surplus lines
brokers, wholesale brokers, reinsurance intermediaries, underwriting managers and similar parties, some of which
may be owned in whole or in part by Brown & Brown, Inc., may also receive compensation for their role in providing
insurance products or services to you pursuant to their separate contracts with insurance or reinsurance carriers.
That compensation is derived from your premium payments. Additionally, it is possible that we, or our corporate
parents or affiliates, may receive contingent payments or allowances from insurers based on factors which are not
customer-specific, such as the performance and/or size of an overall book of business produced with an insurer. We
generally do not know if such a contingent payment will be made by a particular insurer, or the amount of any such
contingent payments, until the underwriting year is closed. That compensation is partially derived from your premium
dollars, after being combined (or "pooled") with the premium dollars of other insureds that have purchased similar
types of coverage. We may also receive invitations to programs sponsored and paid for by insurance carriers to
inform brokers regarding their products and services, including possible participation in company-sponsored events
such as trips, seminars, and advisory council meetings, based upon the total volume of business placed with the
carrier you select. We may, on occasion, receive loans or credit from insurance companies. Additionally, in the
ordinary course of our business, we may receive and retain interest on premiums you pay from the date we receive
them until the date of premiums are remitted to the insurance company or intermediary. In the event that we assist
with placement and other details of arranging for the financing of your insurance premium, we may also receive a fee
from the premium finance company.
If an intermediary is utilized in the placement of coverage, the intermediary may or may not be owned in whole or
part by Brown & Brown, Inc. or its subsidiaries. Brown & Brown entities operate independently and are not required
to utilize other companies owned by Brown & Brown, Inc., but routinely do so. In addition to providing access to the
insurance company, the Wholesale Insurance Broker/Managing General Agent may provide additional services
including, but not limited to: underwriting; loss control; risk placement; coverage review; claims coordination with
insurance company; and policy issuance. Compensation paid for those services is derived from your premium
payment, which may on average be 15% of the premium you pay for coverage, and may include additional fees
charged by the intermediary.

insurance to you, and (if applicable) compensation expected to be received based in whole or part on any alternative
quotes presented to you by us, by requesting such information from us.

Surplus Lines Disclosure Form Instructions
This form is designed to provide guidance based on the statutory requirements for such form and it has not been approved
by the Florida Department of Financial Services. This is a suggested form; however the law requires that the following
language be included in the form and that the insured sign the form:
"I have agreed to the placement of coverage in the surplus lines market. I understand that superior coverage may be
available in the admitted market and at a lesser cost and that persons insured by surplus lines carriers are not protected
under the Florida Insurance Guaranty Act with respect to any right of recovery for the obligation of an insolvent unlicensed
insurer."
The statute does not require the retail/producing agent to sign the form. However, the retail/producing agent should keep
the original signed form in the insured's file in the event of a future E&O claim. The statute clearly states that if the form is
signed by the insured that the insured is presumed to have been informed and to know that other coverage may be available
and that the retail/producing agent has no liability for placing the policy in the surplus lines market.
Some surplus lines brokers may ask for copies of these forms, but they are not required by statute to obtain or maintain
these forms. Retail/producing agents may choose to comply with their requests for copies of the forms, but agents and
brokers should note that the Florida Surplus Lines Service Office will not be looking for copies of these forms during
compliance reviews of the files of surplus lines brokers. Only when a surplus lines broker acts in both a retail/producing
agent capacity and a surplus lines broker capacity on a given risk/policy should the broker maintain a copy of this form.
