Pursuant to Chapter 162, Florida Statutes, all orders are appealable only to the Circuit Court in Palm Beach County and not to the City Commission. Also, a fine will be imposed if the violation(s) are not corrected by the deadline. II. Mr. Bein-Aime stated that there have been many violations for the vehicles, and he would not feel okay with granting an extension. Joseph Morancie, the respondent, was present. Magistrate Zalman reviewed the violations and requested status. Mr. Morancie asked if he could get an extension to remove the vehicle. He said that he had car accident in December but that the insurance company recently informed him that they need at least 60 days to come out and assess the vehicle. Magistrate Zalman explained to Mr. Morancie that the car needs to be removed and placed elsewhere. She commented that if the vehicle is not removed, the City will tow it, and he will incur additional fees. Decision Magistrate Zalman ordered a compliance date of April 6, 2026, or a fine of $75.00 per day, plus administrative fees in the amount of $384.12. She will enter an abatement order for the car if it is not removed by April 6, 2026. 7 Case Hearing Case No. 25-3298 RAMNARACE BALIRAM TRUST, ROBERT C STONE, P.A. Property Address: 213 SW 9TH AVE Type of Property: SINGLE FAMILY / HOMESTEAD Property Violation(s): 14-3 Truck Parking Code Enforcement Officer Alex Lawson presented this case, which was a routine inspection. The initial inspection date was October 30, 2025. The initial notice was issued October 30, 2025, via written notice with 10 days to comply. This is not a repeat violator. Baliram Ramnarace, the respondent, was present with attorney, Robert Stone. Mr. Stone inquired if Ms. Zalman received his motion to dismiss. Magistrate Zalman stated that she had not received the motion. She reviewed the violations and explained to Mr. Stone and Mr. Ramnarace the City’s recommendation. Mr. Stone requested to have the case reset for April 26, 2026. He stated that he would like to find an amicable way to close the proceeding and that his client was not notified properly of the code violations. Magistrate Zalman questioned Mr. Lawson about the notification process. Mr. Lawson provided a copy of the notice that was sent to Mr. Ramnarace that explained the violation and what needed to be done in order to comply. Magistrate Zalman stated that she believed this to be a timing issue. She inquired if the City would have any objection to an extension. Mr. Lawson objected to the extension. He stated that the respondent has had multiple months to clear the violations and that he is not working towards compliance. Magistrate Zalman stated that she does not see the problem with the City’s recommendation. Mr. Stone stated that he does not agree with Ms. Zalman decision. He said that he did not get a chance to provide evidence or to cross-examine the code officer. He commented that his client has lived in the city for over 40 years and has had the truck the entire time. He said that it had never been an issue before. Mr. Ramnarace stated that the vehicle is not a commercial vehicle. 8 Mr. Stone commented that the vehicle does not meet the criteria for commercial vehicles according to the city’s ordinance. George Lagos, Assistant City Attorney, was present. He referred to the ordinance in question and read the specifications. He commented that although the ordinance does not mention a commercial type of vehicle, based on the photos of the vehicle in question, it does not meet the criteria of a sedan. Magistrate Zalman clarified that per the City, the vehicle is not allowed in the area. Mr. Lagos commented that that was correct. Magistrate Zalman explained to Mr. Ramnarace that per the city’s code the vehicle is not allowed. Mr. Mercardo explained that there have been multiple complaints regarding gathering at the property in the morning to receive work equipment and to prepare for the workday. He said that this is outside of the Business Tax Receipt. Magistrate Zalman asked to clarify what specifically was prohibited. Mr. Mercardo stated that there can be no work equipment, work trucks or gathering of employees at your property to prepare for the day. He explained that when he performed his inspection, he noticed employees come to the property to gather and pick up work equipment. He stated that you cannot have anything on your property that has to do with your business. Candice Stone, Code Enforcement Director, explained that on the home-based business license, there is an affidavit that the owners’ sign and that explains the type of vehicles that they can have on the property and the type of activities that are allowed and prohibited. She mentioned that you cannot disturb the peace of the neighborhood and that the gathering taking place is a violation. Magistrate Zalman explained to Mr. Thompson that if continued, he will be charged $150 per occurrence effective April 1, 2026. Magistrate Zalman reviewed the violations and explained the City’s recommendation. She asked Mr. Mercardo if a permit is still needed if the business does not continue live entertainment. Mr. Mercardo responded that a permit is not needed if the business does not intend to continue live entertainment. Ms. Riobueno stated that the tenants at the property are currently in a stipulation for non- payment and that the landlord is seeking eviction. Magistrate Zalman inquired if the tenants were aware of the hearing. Ms. Riobueno commented yes and said that the tenant was present. Magistrate Zalman requested clarification on the one-time fee of $500. Mr. Mercardo stated that the fee is for the nightclub activity. Magistrate explained to Ms. Riobueno that after 3/18/2026 there will be a fee of $500 due for each additional violation pertaining to any nightclub activity. Ms. Riobueno commented that she understood. Magistrate Zalman asked the tenant to come to the podium to be sure that she understands what the City is requesting. Lynda Mondesir, the tenant, was present and stated that she did not want to testify. Officer Redondo explained to the Magistrate that there have been several incidents over the years with the property. He said it has become a nuisance for law enforcement. Decision Magistrate Zalman ordered board order #1 a cease-and-desist order effective March 18, 2026, and a fine of $500.00 for the first occurrence and each occurrence thereafter, plus administrative fees in the amount of $384.12. He mentioned that they would like to work with the City and that he has plans to meet with Planning & Zoning to add some trees to the area. Magistrate Zalman stated that she would hold off on deciding for 1 week. She said that each party can submit their position on the matter and that she would decide from there.
