I. CALL TO ORDER
Hilary Zalman, Code Enforcement Special Magistrate, called the Hearings to order at
9:05 a.m., and explained the Magistrate's role and the procedures. Pursuant to Chapter
162, Florida Statutes, all orders are appealable only to the Circuit Court in Palm Beach
County and not to the City Commission. Also, a fine will be imposed if the violation(s) are
not corrected by the deadline.

Ms. Janvier commented that she reached out to someone but will need extra time. She
questioned if a permit is needed if removed.
Mr. Chevalier-Bien Aime stated that a permit is not needed to remove the front fence.

Mr. Chevalier-Bien Aime commented that the pavers are unsecure and that in order to be
sure they were installed correctly, a permit is required. He mentioned that the pavers are
not considered a hard surface per the City's code.
Mr. Orta asked for clarification of a hard surface per the City's code.
Mr. Chevalier-Bien Aime stated that for his property, the driveway would be considered a
hard surface. He mentioned that the boat can be moved behind the front roof line if not
on a hard surface.
Mr. Orta inquired about driveway violation. He stated that the driveway was cleaned on
January 27, 2026.
Mr. Chevalier-Bien Aime pointed out that during the last inspection on April 10, 2026, the
driveway had not met compliance.

to switch from short-term rental to long-term rental. She said that she was told a long-
term rental does not have the same requirements as short-term.
Magistrate Zalman asked if a Business Tax Receipt (BTR) and Certificate (COU) were
still needed for a long-term rental.
Ms. Ortiz said that a BTR and COU are still needed.
Ms. Brown stated that she spoke to Saleica Brown, Development Director, and that she
was told that if it is over 4 months, it is not considered short-term and that a business
license is not needed. She commented that she is now confused about what is needed.
Lionel Mesadieu, Business Compliance Officer, stated that it is required to have a BTR
regardless of whether it is a 4-month or 6-month rental.
Ms. Brown asked if she rents a room out for 1 year, does she need a BTR.
Mr. Mesadieu stated that that is correct.
Ms. Ortiz commented that a BTR and COU are still needed. She mentioned that even if
the property is not being rented at the moment, a retroactive BTR and COU are needed
from the time she did.
