R26-077 1 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON 2 BEACH, FLORIDA, AMENDING THE ADOPTED COMPREHENSIVE FEE 3 SCHEDULE FOR FISCAL YEAR 2025-2026, AS APPROVED BY 4 RESOLUTION NO. R04-176, TO REVISE CEMETERY-RELATED FEES FOR 5 BOYNTON BEACH MEMORIAL PARK AND SARA SIMS MEMORIAL 6 GARDENS;AND PROVIDING AN EFFECTIVE DATE. 7 8 WHEREAS, the City of Boynton Beach owns and operates Boynton Beach Memorial Park 9 and Sara Sims Memorial Gardens as municipal cemeteries; and 10 WHEREAS, pursuant to Section 6-11 of the Code of Ordinances, the City Commission is 11 authorized to establish the price and terms for the sale of cemetery lots and related services; and 12 WHEREAS, the current cemetery fee structure has remained largely unchanged for more 13 than twenty (20) years and no longer reflects the actual cost of providing services, including 14 staffing, equipment, maintenance, and operational expenses; and 15 WHEREAS, the City has reviewed comparable cemetery operations in neighboring 16 municipalities and determined that current fees are below regional market standards; and 17 WHEREAS, the City Commission finds that updating the cemetery fee schedule is 18 necessary to align rates with current costs, support the ongoing maintenance and improvement 19 of cemetery facilities, and promote the long-term financial sustainability of the Cemetery Fund. 20 21 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON 22 BEACH, FLORIDA, THAT: 23 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as 24 being true and correct and are hereby made a specific part of this Resolution upon adoption. 25 SECTION 2. The comprehensive fee schedule for Fiscal Year 2025-2026, as previously 26 adopted and amended by Resolution No. R04-176 is hereby amended to revise cemetery-related 27 fees for Boynton Beach Memorial Park and Sara Sims Memorial Gardens as set forth in Exhibit A, 28 attached hereto and incorporated herein by reference. 29 SECTION 3. All other fees and provisions of the comprehensive fee schedule not 30 amended herein shall remain in full force and effect. 31 SECTION 4. The City Clerk shall retain the comprehensive fee schedule as a public RESOLUTION NO. R26-077 32 record of the City. 33 SECTION 5. GRAVE LOT PRICING Description Fee Adult Grave Lot $2,500.00 Child Grave Lot $500.00 B. OPENING AND CLOSING FEES Description Fee Weekday(Monday- Friday) $600.00 Weekend/ Holiday $800.00 C. EQUIPMENT AND SERVICE FEES Description Fee Tent and Chairs Setup $250.00 Infant Grave Setup $150.00 Disinterment (Adult) $900.00 Disinterment (Child) $500.00 D. GENERAL PROVISIONS 1. All fees are subject to change by resolution of the City Commission. 2. Payment of all applicable fees is required prior to the provision of services. 3. Disinterment services shall be subject to all applicable legal requirements and approvals. 4. Additional charges may apply for services not listed herein, as approved by the City Manager or designee. 5. All cemetery services shall be performed in accordance with Chapter 6 of the City Code and the Cemetery Rules and Regulations.
