26-014 ORDINANCE NO. 26-014 1 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, 2 REPEALING CHAPTER 2, ARTICLE I, SECTION 2-15 AND ANY 3 AMENDMENTS THEREAFTER WHICH ESTABLISHED LIMITATIONS 4 ON BOARD MEMBER ADVOCACY AND LOBBYING IN THE CITY OF 5 BOYNTON BEACH; PROVIDING FOR CODIFICATION; PROVIDING 6 FOR SEVERABILITY; PROVIDING FOR CONFLICTS; AND PROVIDING 7 FOR AN EFFECTIVE DATE. 8 9 WHEREAS, Chapter 2, Article I, Section 2-15 of the Code of Ordinances of the City of 10 Boynton Beach currently establishes limitations on board member advocacy and lobbying;and 11 WHEREAS, Section 2-15 imposes broad restrictions on constitutionally protected 12 speech that are not narrowly tailored and are unlikely to withstand legal challenge; and 13 WHEREAS, the Palm Beach County Code of Ethics and Florida law already regulate the 14 conduct the ordinance seeks to address; and 15 WHEREAS, the City Commission finds the repeal of Chapter 2, Article I, Section 2-15, 16 and any amendments thereafter, is in the best interest of the citizens and residents of the City 17 of Boynton Beach. 18 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF 19 BOYNTON BEACH, FLORIDA, THAT: 20 Section 1. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as 21 being true and correct and are hereby made a specific part of this Ordinance upon adoption 22 hereof. 23 Section 2. The City Commission of the City of Boynton Beach hereby repeal Chapter 24 2, Article I, Section 2-15 and any amendments thereafter. 25 Section 3. Codification. It is the intention of the City Commission of the City of 26 Boynton Beach, and it is hereby ordained that the provisions of this Ordinance shall become 27 and be made a part of the Code and Ordinances of the City of Boynton Beach, Florida, and that 28 Sections of this Ordinance may be renumbered, re-lettered and the word "Ordinance" may be 29 changed to "Section," "Article," or such other word or phrase in order to accomplish such 30 intention. 31 Section 4. Severability. If any clause, section, or other part of this Ordinance shall 32 be held by any court of competent jurisdiction to be unconstitutional or invalid, such ORDINANCE NO. 26-014 33 unconstitutional or invalid part shall be considered as eliminated and in no way affect the 34 validity of the other provisions of this Ordinance. 35 Section 5. Conflicts. That all Ordinances or parts of Ordinances, Resolutions, or 36 parts of Resolutions in conflict herewith, be and the same are repealed to the extent of such 37 conflict. 38 Section 6. Effective Date.
