1 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON
2 BEACH, FLORIDA, APPROVING THE DISPOSITION OF LAND BY THE
3 BOYNTON BEACH COMMUNITY REDEVELOPMENT AGENCY TO
4 LENNAR HOMES, LLC OF PROPERTY LOCATED AT 135 NE 3RD
5 AVENUE, 407 NE 1ST STREET, 524 NE 3RD STREET, 507 NW 12TH
6 AVENUE, LOT 348 NW 11TH AVENUE, AND 419 N. SEACREST
7 BOULEVARD, FOR DEVELOPMENT OF AFFORDABLE/WORKFORCE
8 HOUSING, FOR A PURCHASE PRICE LESS THAN FAIR MARKET VALUE;
9 AND FOR ALL OTHER PURPOSES.

11 WHEREAS, pursuant to section 163.380, Florida Statutes, in the event the value of such
12 real property being disposed of is for less than the fair value, such disposition shall require the
13 approval of the governing body,which approval may only be given following a duly noticed public
14 hearing; and
15 WHEREAS, the Boynton Beach Community Redevelopment Agency ("CRA") Board
16 approved the terms for the Purchase and Development Agreement for the sale and development
17 of the CRA property located at 135 NE 3rd Avenue, 407 NE 1st Street, 524 NE 3rd Street, 507 NW
1s 12th Avenue, Lot 348 NW 11th Avenue, and 419 N. Seacrest Boulevard; and
19 WHEREAS, since the sale amount is below fair market value, the City Commission, as the
20 governing body, is required to approve the disposition; and
21 WHEREAS, the City Commission, upon the recommendation of staff, has deemed it in the
22 best interests of the City's citizens and residents to approve the disposition of land by the Boynton
23 Beach Community Redevelopment Agency to Lennar Homes, LLC of property located at 135 NE
24 3rd Avenue, 407 NE 1st Street, 524 NE 3rd Street, 507 NW 12th Avenue, Lot 348 NW 11th Avenue,
25 and 419 N. Seacrest Boulevard, for development of affordable/workforce housing, for a purchase
26 price less than fair market value.

28 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON
29 BEACH, FLORIDA, THAT:
30 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as
31 being true and correct and are hereby made a specific part of this Resolution upon adoption.
32 SECTION 2. The City Commission of the City of Boynton Beach, Florida, does hereby

33 approve the disposition of land by the Boynton Beach Community Redevelopment Agency to
34 Lennar Homes, LLC of property located at 135 NE 3rd Avenue, 407 NE 1st Street, 524 NE 3rd Street,
35 507 NW 12th Avenue, Lot 348 NW 11th Avenue, and 419 N. Seacrest Boulevard, for development
36 of affordable/workforce housing, for a purchase price less than fair market value.
37 SECTION 3. The City Commission of the City of Boynton Beach, Florida, hereby
38 authorizes the Mayor to execute any ancillary documents as may be necessary to accomplish the
39 purpose of this Resolution.
40 SECTION 4. This Resolution shall take effect in accordance with the law.
