26-020 ORDINANCE NO. 26-020 1 2 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF 3 BOYNTON BEACH, FLORIDA, AMENDING PART III "LAND 4 DEVELOPMENT REGULATIONS," CHAPTER 4 "SITE DEVELOPMENT 5 STANDARDS," ARTICLE VII "EXTERIOR LIGHTING STANDARDS"; TO 6 AMEND THE RELIEF PROCESS TO REMOVE LANGUAGE REGARDING 7 COMMUNITY DESIGN RELIEF BUT KEEP WAIVER RELIEF, AND 8 GENERAL CLEANUP OF OVERALL ARTICLE; PROVIDING FOR 9 CODIFICATION; PROVIDING FOR SEVERABILITY; PROVIDING FOR 10 CONFLICTS;AND PROVIDING FOR AN EFFECTIVE DATE. 11 12 WHEREAS, Part III "Land Development Regulations," Chapter 4 "Site Development 13 Standards," Article VII "Exterior Lighting Standards" of the City's Code of Ordinances currently 14 regulates exterior lighting standards for all new construction and major modifications to existing 15 sites within the City; and 16 WHEREAS, Article VII currently provides two relief processes from exterior lighting 17 standards: a Community Design Appeal application for community design standards within this 18 Article and a Waiver application for all other standards within this Article; and 19 WHEREAS, the Planning and Zoning Department would like to amend the Land 20 Development Regulations to remove language regarding Community Design Appeal relief and 21 to make general fixes to language throughout the Article; and 22 WHEREAS, this amendment will provide for a more streamlined process for the applicant 23 to obtain the sought relief; and 24 WHEREAS, the City Commission has determined that this amendment serves the public 25 health, safety, and welfare of the citizens of the City of Boynton Beach. ORDINANCE NO. 26-020 26 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF 27 BOYNTON BEACH, FLORIDA: 28 Section 1: The foregoing "WHEREAS" clauses are hereby ratified as being true and 29 correct and are hereby made a specific part of this Ordinance upon adoption hereof. 30 Section 2: Part III "Land Development Regulations," Chapter 4 "Site Development 31 Standards," Article VII "Exterior Lighting Standards" is hereby amended to read as follows: 32 PART III LAND DEVELOPMENT REGULATIONS 33 ... 34 CHAPTER 4. SITE DEVELOPMENT STANDARDS 35 ... 36 ARTICLE VII. EXTERIOR LIGHTING STANDARDS 37 ... 38 Section 1. General. 39 ... 40 G. Relief from Standards. In addition to the regulations of this article, all lands shall be improved 41 in conformance with the minimum standards as set forth in the current Engineering Design 42 Handbook and Construction Standards or latest supplement thereof. Any deviation from the 43 lighting standards contained herein or within the Engineering Design Handbook and Construction 44 Standards requires the approval of a wWaiver application, which is subject to review and approval 45 by the City Engineer. A request for a wWaiver shall be reviewed in accordance with Chapter 2, 46 Article III, Section 5. 47 ... 48 Section 3. Standards. 49 ... 50 B. Public Rights-of-wWay. Street lighting shall be placed on all public and private rights-of-way 51 in compliance with the most recent addition of the Engineering Design Handbook and 52 Construction Standards for Landscaping, Irrigation, and Lighting (or Volume II). ORDINANCE NO. 26-020 53 Where street lighting is installed, it shall be installed on all local and collector streets, at each 54 intersection, at the end of cul-de-sacs, and wherever, in the opinion of the City Engineer, a 55 dangerous traffic/pedestrian condition exists. Between intersections, street lights street lights 56 may be engineered for security purposes only as recommended by the Chief of Police. Streetlights 57 Street liahts shall be wired for underground service except where aerial service is permitted by 58 Chapter 4, Article VIII, Section 3.B. 59 C. Off-Street Parking Lots.A minimum average light level of one (1)foot-candle shall be provided, 60 with no more than ten percent (10%) of the spot readings below one (1) foot-candle and none 61 below one-half (1/2) foot-candle. Lighting fixtures shall be energy efficient and automatically 62 controlled by a photoelectric switch or other device acceptable to the City Engineer and are to 63 remain on from dusk to one (1) hour after closing or 2:00 a.m., whichever is later. However, the 64 exterior lighting of off-street parking areas and other vehicular use areas within parks and other 65 types of recreation facilities may be shut off at an earlier time as determined by the Director of 66 Recreation and Parks or designee based upon the characteristics (e.g. type, location, hours of 67 operation, etc.) of such park or facility. 68 A photometric plan shall contain lighting levels in accordance with the standards of this section 69 and Section 4 below. Light fixtures must be baffled, shielded, screened, or recessed to prevent 70 visibility of the lit portion of the fixture from off the premises. In addition, light fixtures shall be 71 strategically located to avoid future conflicts with mature tree canopies (see Chapter 4, Article II, 72 Scction 3.A.12.) (see Chapter 4. Article II. Section 4.A.12.aa. 73 ... 74 F. Crime Prevention Through Environmental Design (CPTED). The purpose of this section is to promote harmony with nature and a 84 pleasant and comprehensible cohesiveness among development within the city. Through 85 enforcement of the community design, the local elected officials shall determine the basic 86 aesthetic character to be achieved in the development of the community. The following regulations shall apply to all new development and 93 redevelopment: 94 1. Generally. 95 a. Lighting fixture height, style, design and illumination level shall be compatible with the building 96 design and height and shall consider safety, function and aesthetic value; 97 b. Lighting of the exterior, parking areas, and watercraft docking facilities shall be of the lowest 98 intensity and energy use adequate for its purpose, and shall not create conditions of glare that 99 extend onto abutting properties; 100 c. Feature lighting emphasizing plants, trees, barriers, entrances, and exits is encouraged; 101 d. Lighting may be used to illuminate a building and its grounds for safety purposes and to 102 enhance its beauty. However, the visual effect shall be subtle; 103 e. Lighting shall not be used as a form of advertising in a manner that draws more attention to 104 the building or grounds at night than in the day; and 105 f. Lighting attached to the form of the building exterior,of the building or attached to part of the 106 building exterior,or visible from the building exterior of the building shall not be permitted if it is 107 contrary to the architectural style of the building. 108 C. Maximum Foot-€Candle and Illumination Levels. 109 Permanent off-street lighting levels for all multiple-family residential and non-residential uses 110 shall not exceed five and nine-tenths (5.9) foot-candles for any spot location reading, excluding 111 those areas where higher lighting levels are required for automated teller machines (ATM) or as 112 identified in €rime pPrevention tThrough eEnvironmental dDesign (CPTED). 113 D. Pole (Total Overall) Heights in Relation to Building Height. 114 It is the intent of this subsection to regulate the maximum allowable height of outdoor free- 115 standing lighting poles in order to encourage compatibility between said poles and heights of 116 principal buildings on-site and on adjacent properties. 117 The maximum height for all outdoor free-standing lighting poles of a project or development 118 shall not exceed the average roofline of a one (1)-story structure. ORDINANCE NO. 26-020 119 free-standing lighting pole exceed twenty-five (25) feet in height unless the height limitation is 120 found to be incompatible with guidelines and/or recommendations of an adopted redevelopment 121 plan or other public works project. 122 ... 123 Section 5. Prohibited Lighting. 124 The following types of outdoor lighting are prohibited: 125 A. Spillage. Any light that illuminates any vertical or horizontal surface on adjacent property or 126 rights-of-way at a level greater than 94 three-tenths (0.3) foot-candles. 127 B. Unauthorized Traffic Lighting. Any light that resembles an authorized traffic sign, signal, or 128 device, or that interferes with, misleads, or confuses vehicular traffic as determined by the City 129 Engineer. 130 C. Beacon or Searchlights. No beacon or searchlights shall be permitted. 131 D. Drop Lens Fixtures. Any drop lens fixtures. 132 E. Neon Tubing, Bare Bulbs, and Miniature Lighting. Neon tubing, bare bulbs, miniature lights, 133 and similar technologies shall not be used to illuminate or outline building facades, storefronts, 134 door openings, windows, or within window displays. See Chapter 4, Article IV, Section 3.tK.6. for 135 the prohibition of such material when used in signage and designed in an unshielded manner. 136 F. Awnings. No awnings, valances, or support structures shall be internally-illuminated or backlit 137 pursuant to Chapter 4, Article III, Section 3.E. 138 ... 139 Section 3: Codification. It is the intention of the City Commission of the City of 140 Boynton Beach, and it is hereby ordained that the provisions of this Ordinance shall become and 141 be made a part of the Code and Ordinances of the City of Boynton Beach, Florida, and that 142 Sections of this Ordinance may be renumbered, re-lettered and the word "Ordinance" may be 143 changed to"Section," "Article,"or such other word or phrase in order to accomplish such intention. 144 Section 4: Severability. ORDINANCE NO. 26-020 146 or invalid part shall be considered as eliminated and in no way affecting the validity of the other 147 provisions of this Ordinance. 148 Section 5: Conflicts. That all Ordinances or parts of Ordinances, Resolutions, or 149 parts of Resolutions in conflict herewith, be and the same are repealed to the extent of such 150 conflict. 151 Section 6: Effective Date.
