A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON
2 BEACH, FLORIDA, APPROVING THE WAIVER OF RIGHT OF FIRST
3 REFUSAL FOR THE PROPERTY LOCATED AT 12 CROSSING CIRCLE, # G,
4 BOYNTON BEACH, FL 33435, OWNED BY JUCKEL DELVA AND YANICK
5 COLASTIN; AND FOR ALL OTHER PURPOSES.

7 WHEREAS, the house is located at 12 Crossing Circle, Unit G, Boynton Beach, FL 33435,
8 owned by Juckel Delva and Yanick Colastin, and was purchased with the assistance of the State
9 Housing Initiatives Partnership (SHIP) Program. $68,518.00 of the SHIP Program was secured by a
10 thirty (30) year interest-free deferred loan (second mortgage and promissory note), and an
11 Agreement for Right of First Refusal. This deferred payment loan was issued on August 31, 2006.
12 The Property was originally purchased for$170,000.00.The property is being sold for$155,000.00.
13 There will be no shared equity; and
14 WHEREAS,the City has no interest in purchasing the property;therefore,the City has been
15 requested to waive the Right of First Refusal so the property can be sold; and
16 WHEREAS, the City Commission, upon the recommendation of staff, has deemed it in the
17 best interests of the City's citizens and residents to approve the Waiver of Right of First Refusal
18 for the property located at 12 Crossing Circle, # G, Boynton Beach, FL 33435, owned by Juckel
19 Delva and Yanick Colastin.

21 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON
22 BEACH, FLORIDA, THAT:
23 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as
24 being true and correct and are hereby made a specific part of this Resolution upon adoption.
25 SECTION 2. The City Commission of the City of Boynton Beach, Florida, does hereby
26 approve a Waiver of Right of First Refusal for the property located at 12 Crossing Circle, # G,
27 Boynton Beach, FL 33435, owned by Juckel Delva and Yanick Colastin (the "Waiver"), in form and
28 substance similar to that attached as Exhibit A.
29 SECTION 3. The City Commission of the City of Boynton Beach, Florida, hereby
30 authorizes the Mayor to execute the Waiver. The Mayor is further authorized to execute any
31 ancillary documents necessary to accomplish the purposes of this Resolution.

32 SECTION 4. Upon execution of the Waiver by the City, the City Clerk shall provide the
33 Waiver to RJ Ramirez to forward to the Title Company.
34 SECTION 5. This Resolution shall take effect in accordance with the law.

WAIVER OF RIGHT OF FIRST REFUSAL
The CITY OF BOYNTON BEACH, FLORIDA (the "CITY"), a Florida municipal corporation, being the
owner, holder, and beneficiary of a right of first refusal recorded in Official Records Book 20838, Page
1919, of the Public Records of Palm Beach County, Florida, on any sale or resale or transfer of the real
property located at 12 Crossing Circle, Unit G, Boynton Beach, FL 33435, hereby acknowledges that it has
been offered the following described land pursuant to its right of first refusal, and the CITY hereby waives
its right to exercise such right of first refusal to purchase the property for the following described
transaction:
Owner: Juckel Delva and Yanick Colastin
Recipient: The property is being sold to Cristian Alexander Martinez (buyer),for
the sum of$155,000.00.
PROPERTY DESCRIPTION: Condominium Unit 12-G of the Crossings of Boynton Beach, a
Condominium, according to the Declaration of Condominium
thereof, as recorded in Official Record Book 4071, Page 1175,
of the Public Records of Palm Beach County, Florida (together
with any and all amendments thereto).
If the above referenced transaction does not close, then the City's right of first refusal shall be reinstated
and shall be fully applicable to any successive transactions.
