2 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON
3 BEACH, FLORIDA, APPROVING THE CONVEYANCE OF FOUR (4) CITY-
4 OWNED PARCELS OF REAL PROPERTY, IDENTIFIED BY PARCEL
5 CONTROL NUMBERS 08-43-45-21-18-000-1510, 08-43-45-21-18-
6 000-1540, 08-43-45-21-04-000-0050, AND 08-43-45-21-18-000-
7 1572, TO THE BOYNTON BEACH COMMUNITY REDEVELOPMENT
8 AGENCY BY QUIT CLAIM DEED; DECLARING THE PARCELS AS
9 SURPLUS PROPERTY; AUTHORIZING THE MAYOR TO SIGN A QUIT
10 CLAIM DEED; PROVIDING AN EFFECTIVE DATE; AND FOR ALL OTHER
11 PURPOSES.

13 WHEREAS, the City of Boynton Beach, Florida (the "City"), owns four (4) parcels of real
14 property in Arden Park Addition to Boynton and Robert Wells' Subdivision (Parcel Control
15 Numbers 08-43-45-21-18-000-1510, 08-43-45-21-18-000-1540, 08-43-45-21-04-000-0050, and
16 08-43-45-21-18-000-1572), as more particularly described in the Quit Claim Deed attached hereto
17 as Exhibit "A" (collectively, the "Property"); and
18 WHEREAS, the Boynton Beach Community Redevelopment Agency (the "CRA") is a public
19 body corporate and politic created by the City pursuant to Section 163.356, Florida Statutes, and
20 is charged with carrying out community redevelopment within the City's Community
21 Redevelopment Area, in which the Property is located; and
22 WHEREAS, the City now desires to convey the Property back to the CRA, for the sum of
23 Ten Dollars ($10.00) and other good and valuable consideration, so that the CRA may redevelop
24 it consistent with the CRA Redevelopment Plan, and the City Commission finds that the
25 conveyance serves a valid municipal and public purpose; and
26 WHEREAS, the Property is located within the City's Community Redevelopment Area, was
27 acquired by the City for the purposes of community redevelopment, is no longer needed for City
28 purposes, and its conveyance to the CRA will facilitate redevelopment consistent with the CRA
29 Redevelopment Plan, and therefore, pursuant to Section 2-56(d) of the City of Boynton Beach
30 Code of Ordinances, the provisions governing the disposition of City-owned real property set
31 forth in Section 2-56(c) do not apply to this conveyance; and
32 WHEREAS, the Commission, upon recommendation of staff, has deemed it to be in the
33 best interests of the citizens and residents of the City to approve the conveyance and authorize

34 the Mayor to sign a Quit Claim Deed between the City ("Grantor") and CRA ("Grantee") for Parcel
35 Control Numbers 08-43-45-21-18-000-1510, 08 43 45 21 18 000-1540, 08-43-45-21-04-000-
36 0050, and 08-43-45-21-18-000-1572.
37 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON
38 BEACH, FLORIDA, THAT:
39 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as
40 being true and correct and are hereby made a specific part of this Resolution upon adoption.
41 SECTION 2. The City Commission of the City of Boynton Beach, Florida, does hereby
42 declare the Property surplus, and approve the conveyance of the Property described in the
43 attached Exhibit "A" to the Boynton Beach Community Redevelopment Agency by Quit Claim
44 Deed.
45 SECTION 3. The City Commission hereby authorizes the Mayor to execute the Quit
46 Claim Deed, in form and substance similar to "Exhibit A," and any other documents necessary to
47 effectuate the transaction, subject to approval by the City Attorney's Office.
48 SECTION 4. Upon execution of the Quit Claim Deed by the City, the City Clerk shall
49 record the Deed in the Public Records of Palm Beach County.
50 SECTION 5. This Resolution shall take effect in accordance with the law.
