76-AA RESOLUTION NO_. 76-AA A RESOLUTION OF THE CITY OF BOYNTON BEACH, FLORIDA, TO ALL MEMBERS OF THE FLORIDA STATE 'LEGISLATURE OPPOSING CERTAIN PUBLISHED AMENDMENTS TO PART VI OF CHAPTER 553 (FLORIDA STATUTES 1975) AND ALTERNATIVELY RECOMMENDING ENACTMENT OF CERTAIN OTHER AMENDMENTS THERETO. WHEREAS, the City Council of the City of Boynton Beach, Florida, has been advised that the Florida State Board of Building Codes and Standards has published certain proposed amendments to Part VI of Chapter 553 (Florida Statutes 1975); and WHEREAS, it is believed that the enactment of the aforesaid proposed amend- ments by the Florida Legislature will effectively remove local agency control of building codes and transfer this control to the State; unnecessarily increase con- struction costs within the State of Florida; and drastically prolong the time periods required to pursue injunctive and appellate relief from the building codes; and WHEREAS. it is the opinion of the City Council of the City of Boynton Beach that the health, safety and welfare of the residents of the State of Florida would am' be served by the adequate enforcement of the existing provisions of Part VI of 553 (Florida Statutes 1975) requiring adoption of a current edition of one of the lng codes: a model building code, the EPCOT Code, the One and Two Family Code or the South Florida Building Code. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1: That the City of Boynton Beach, Florida, respectfully urges mem- bers of the Florida State Legislature to oppose the enactment of those certain amend- ments to Part VI of Chapter 553 (Florida Statutes 1975) which have been published b the State Board of Building Codes and Standards. Section 2: That the City of Boynton Beach earnestly solicits the support of all members of the Florida State Legislature to enact legislation ensuring the ade( enforcement of the existing provisions of Part VI of Chapter 553 (Florida Statutes 1975) which require adoption of a current edition of one of the following codes: a model building code, the EPCOT Code~ the One and Two Family Dwelling Code or South Florida Building Code. Section 3: That the City Manager of the City of Boynton Beach is hereby authorized to deliver copies of this Resolution to the President of the Florida Senate, the Speaker of the Florida House of Representatives and the members of the Palm Beach County Legislative Delegation.
