76-SRESOLUTION NO. A RESOLUTION OF THE CITY OF BOYNTON BEACH, FLORIDA, DETERMINING NECESSITY OF PAVING S.E. 3rd STREET FROM S.E. 21st AVENUE TO S. E. 23rd AVENUE; INDICATING TOTAL ESTIMATED COST OF PROPOSED IMPROVEMENT AND PORTION THEREOF PAYABLE BY SPECIAL ASSESSMENT; SETTING TIME AND PLACE FOR PUBLIC HEARING OF OBJECTIONS TO PROPOSED IMPROVEMENT; A ND ESTABLISHING METHOD BY WHICH SPECIAL ASSESSMENT SHALL BE IMPOSED AND PAID. WHEREAS, the City Council of the City of Boynton Beach, Florida, pursuant to the Charter of said City, deems it necessary for the public inter- est that the public streets of said City, more particu{ar[y described herein- after, be improved by being constructed, repaired, resui~faced and/or rebuilt and WHEREAS, the City Council of said City heretofore, by Resolution No. 76-P, has, according to [aw, required the City Engineer to prepare an estimated cost of such improvements and to prepare plans and specifications covering the construction of same, as well as a preliminary assessment setting forth those lots to be assessed and the amount of the approximate assessment against each such lot; and WHEREAS, the said City Engineer has completed such requirements, and said plans and specifications and preliminary assessment roll are now on file in his office; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, as follows: 1. That the public streets hereinafter described shah be constructed and/or rebuilt over the publicly dedicated right-of-way thereof, in accordance with plans and specifications as required by laws of the City of Boynton Beach Florida, now on file in the office of the City Engineer, said streets being mo particularly described as follows: That portion of S. E. 21st Avenue to S. E. 3rd Street lying between S.E. 23rd Avenue, containing approx- imate[y l, 306.09 front feet. Each abutting property owner along the.above proposed improve- ments shall be assessed on a front footage basis, charging said owner his proportionate share as divided by the lotal improvement cost. Any such assessment may be paid within ninety (90) days from the date of confirma- fhereof, without interest. Thereafter, all assessments shall be payable in three (3) equal consecutive annual installments, together with interest at the rate of eight (8%) per cent per annum, from the expiration of the said ninety (90) days, in each of the succeeding years at the time or times in each year at which genera[ municipal taxes are payable, provided that any assessment may be paid at any time before due, together with interest a.ecrued thereon to the date of payment.
