V~U~EREAS, it is deemed necessary and advisable and to the best interests of the Town of Boynton and the inhabitants thereof by the To~n Commission of the Town of Boynton, Palm Beach County, Florida, that all persons, firms and corporations Operating trains, locomotives or cars on or along any railroads within said Town, to pro- vide all safety devices which may be reasonable for the protection of persons crossing over such railroad tracks along certain oublic streets within said Town; and to keep such railroad tracks clear within a reasonable distance from such crossings so that persons crossing such tracks along such public streets may have a reason- able opportunity to observe the approach of trains being operated upon such railroads; and that such railroad cr~ossings shall not be obstructed by trains, cars or locomotives for an unreasonable lengtla of time. NO~Y THE~FORE, Be it ordained by the To~.m Commission of the Totem of Boynton, Palm Beach County, Florida, as follows: SECTION That all persons, firms and corporations who shall,, after this ordinance becomes effective, operate trains, cars or locomotives upon any railroad or rail- road track ~thin. the corporate limits of said Town over and across Ocean ~venue and Lake f~venue,' which are public streets within said To',,~rn, shall provide, erect and maintain automatic gates, beems or other safety devices on each and both sides of such railroad, rail- track, or tracks, where the same cross over the said streets~ and shall so construct, erect and maintain .such s~e~y devices as ~o cause the same to obstruct such streets upon each and both sides of such railroad or ra.ilroad tracks for a reasonable time before any train, locomotive or car upon such railroad, or railroad tracks, reaches or passes over such streets, and while such locomotives, trains or cars a~e passing along such railroad, or railroad trs. cks, over and across such streets; and that, in addition thereto such persons, firms or corporations operating locomotives, trains or cars upon a railroad track as aforesaid ~lthin said To~na, shall proved automatic signal bells, ~hich bells shall ring lou~ and continuously for a reasonable length of time before any locomotive, train or car crosses over the said st.~,eet; and such person, fir~ or corporation shall, at all time, af'ter this ordi- nance becomes effective, keep such safety devices herein specified in good repair and maintain them so that they will be in operation at any and all times. SECTION 2. That it shall be the duty of. all persons, firms or corporations and the agents, servants or employees of all persons, firms or corporations, who shall operate of cause to be operated after this ordinance becomes effective, as hereinafter provided, any trains, locomotives or cars upo~ or along any railroad or r~i lroad track within the corporate limits of said Town of Boynton, Palm Beach County, Florida, before approaching or crossing .over, or attempting to c~oss over~ Ocean Avenue and Lake Avenue, public streets within said Town, where such r&ilroad, or railroad track crosses the same, to cause such loco~uotive, train or car to come to a complete stop before cross- ing or attempting to cross each and both of said streets, provided that the safety devices and all of them which it is the duty of such persmas, firms or corporations to construct s~nd maintain as provided in Section 1 of this ordinance, are not in good condition and in active ooeration and are not so constructed sand main- tained as to obstruct such streets on each and bot~ sides of such railroad as provided as aforesaid. SECTi0~ 3. That it shall be the duty of all persons, firms and corporations, after this ordinance becomes effective, as hereinafter provided~ who shall operate locomotives, trains or cars over or along any railroad or railroad track which crosses~:over Ocean Avenne and Lake Avenue, which are public streets in said Town, to, at all times, ~eep such railroad and railroad tracks free and clear of any objects, in- c!uding locomotives, trains, box cars, flat cars and all other objects, for a distance of 30 feet on each and both sides of each and both of the said streets, so that anyone traveling along such streets may have an unobstructed view of such railroad or fsi lroad track for a distance of O0 feet on each side thereof at any and all times; provided, hoverer, that it shall not be a violation of this ordinance for any such ob- struction to be placed and remain thereon for a period of 8 minutes at any one time. SECTION 4. That no person, firm or corporation or the servant, agent or employee of any person, firm or corporation operating locomotives, trains or cars over or along any railroad, or railroad trac~ which crosses over Ocean Avenue and Lake Avenue, which are public streets within said Town, shall cause or allow such streets, where they cross over such railroad or railroad track ~ithin said Town, to become obstructed or blocked by a locomotive, train or cars or any other obstruction, for a period of more than $ minutes at any one ~ime. SECTION ;~. That if any person, firm or corpora- tion, or the agent,, servant or employee of any person, fibrin or corporation, violates either Section l, ~ ~ or 4, of this ordinance, he shall be punished by a fine of not less than ~lO.O0 and not more than ~j~lO0.O0 and may be imprisoned for a period of 80 days, one or both, at the discretion of the ~ourt. SECTION 6. That this ordinance shall become effective 30 days after its passage by the Town Commission of the Town of Boynton, Palm Beach County, Florida. SECTION V. That if either Section l, ~, 3 or 4 of this ordinance shall be declared to be Luvalid, such fact shall--not render Other provisions hereof from re- maining in full force and effect. SECTION 8. ORDinAnCE NO. ~ AN 0RDit~A~CE Amending Section 6, of Ordinance No. 61 of the Tov~ of Boynton, Florida. BE IT ORDAINED by the Town Commissioners of the T~n of Boynton, Palm Beach County, Florida, That Section S of Ordinance No. 61 be and the same is Amended to read as follows: SECTION 6. The annual license fee for Real Estate Brokers and Real Estate Salesmen within the T~¢n of Boynton, Florida, shall be as follows:- For each Real Estate Broker ~t0.00 For each Real Estate Salesman 8.00 ALL 0RDI>~CES or parts of Ordinances in con- flict herewith are hereby repealed. Winchester (Signed) Town Clerk ORDINA2~C'E No. 78 TAX COLLECTOR Be it Ordained by the Town Commission of the Town of Boynton, Florida: - SECTIOI~ !. That the T-~vn Commission shall de- signate some person as Tax Collector who shall collect all ~tu~icipa! Taxes and Assessments due on real and personal property and all other Taxes imposed as occu- pational, professional, business or other licenses and shall deliver the same as oft.eh as shall be prescribed by Ordinance to the Treasurer of the Town of Boynton, Florida, taking his or her receipt therefor. SECTION ~. Before entering upon his or her duties as Tax Collector, he or she shall give bond with two or more sufficient sureties or with an approved Surety Company as surety equal to the amount of money tb~t may come into his or her hands at any t im~, such bond to be approved by the T~fn Commission and to be re- newed and approved annually. SECTIOI{ 3. Duties of Tax Collector shall be as defined in the Charter of the Town of Boynton, Florida, and in the Town of Boynton, Flo-rida, Ordinance #11, entitled ~G.~.neral Revenue" and other Ordinances or Re- solutions of the Town of Boynton, F!omida. SECTION 4. Ail Ordinances or parts of Ordinances in conflict herewith are hereby repealed.
