The Recording Secretary administered the oath to all persons who would be testifying. Chairman DeLiso explained the plea system to the audience. V. NEW BUSINESS A. CASES TO BE HEARD Case #01-1760 Property Address: Violation: D'Etenga N'Gurumo 331 NE 16th Avenue SBC '97 Edition 104.1.1; See attached letter for canopy; get permit or remove Inspector MelillO stated that the case was originally cited on July 23, 2001 through routine inspection of the neighborhOod. Service was accomplished by certified mail. Mr. D'Etenga N'Gurumo, 331 NE 16th Avenue, Boynton Beach, pled not guilty. He stated that he has received all kinds of conflicting information from the City and that he was refused a building permit Chairman DeLiso pointed out that the City has determined that a canopy is a permanent structure and requires a permit. In order to obtain a permit, the canopy must meet the wind Icad of 140 mph and the setbacks. Chairman 2 Meeting Minutes " .... Code Compliance Board Boynton Beach, FL May 15, 2002 DeLiso informed the respondent that this Board has heard a multitude of canopy cases over the past couple of months and suggested that the-respondent take the canopy down. The respondent changed ,hiS plea to gui:lb/and noted that he had two canopies to remove, The respondent asked for 60 days. Motion Based on the testimony and evidence presented in Case No. 01-1760, Mr. Foot moved that this Board find, as a matter of fact and as a conclusion of law, that N'Detenga N'Gurumo is in violation of SBC '97 Edition 104.1.1. Mr. Foot moved to order that the Respondent correct the violation on or before June 14, 2002. If the Respondent does not comply with this Order, a fine in the amount of $25.00 per day, plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division to arrange for reinspection of the propertY to verify compliance with this Order. Case #02-289 Property Address: Violation: Crystal L. Simpson 3201 N. Seacrest Blvd. Chapter 15, Article IX-15-120 (D) 1, Inc.; Please sod/grass your yard and swale areas or water and de-weed; fertilize to comply with City Code. Inspector Laverdure stated that the case was originally cited on January 29, 2002 through routine inspection. Service was obtained by posting. Crystal L. Simpson, 3201 N. Seacrest Boulevard, Boynton Beach, pled no contest. Chairman DeLiso requested to see the photos of the property and Inspector Laverdure first presented them to the respondent and then to the Board. Ms. Simpson said she does not have the money to fix the property. Chairman DeLiso suggested that she contact Community Redevelopment. She said that she had previously contacted them, but they informed her that she made too much money. After speaking with her, the Board learned that her financial situation has changed and encouraged her to contact Community Redevelopment again, which she agreed to do. Inspector Laverdure agreed to assist her. Chairman DeLiso suggested tabling the case. Mr. Foot suggested granting the respondent 90 days to bring the property into compliance. Case #02-603 PrOperty Address: Violation: Bradley Stocker 148 SW 14th Avenue FBC '01 Edition 104.1~1; Please apply for and receive a building permit and electrical permit for the garage enclosed and altered to convert to a livable space. (Inspections required.) Inspector Lewis stated that the property was originally cited on March 13, 2002. Bradley Stocker, 312 SW 9th Avenue, Boynton Beach said he has been trying to upgrade his property, but has had difficulty obtaining a building permit. Chairman DeLiso requested to look at the photographs. Inspector Lewis presented the photos to the respondent to identify and then to the Board. The respondent pled no contest. MOtion Based on the testimony and evidence presented in Case No. 02-603, Mr. Foot moved that this Board find, as a matter of fact and as a conclusion of law, that Bradley Stocker is in violation of the FBC '01 Edition 104.1.1. Mr. Foot moved to order that the Respondent correct the violation on or before August 14, 2002. If the Respondent does not comply with this Order, a fine in the amOunt of $25.00 per day, plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division to arrange for reinspection of the property to verify compliance with this Order. Case #02-834 Property Address: Violation: Ovide and Mederline Paul 435 SW 5th Avenue Chapter 15, Article IX-15-120 (D) 1, Inc. and FBC '01 ED 104.1.1, Article XVIII, Section 3, and 1801.2.1.8 and Chapter 25, Article XVlII, Section 3, Inc.; Please install proper pool barrier on the property. Screens and screen doors all need to be repaired. Garage converted to livable space requires a building permit and inspections for plumbing, building and electrical. Inspector Lewis stated that the case was originally cited on March 29, 2002. He pointed out that a temporary barrier has been erected around the pool and is satisfactory to the City until a permit is obtained for a permanent fence. Inspector Lewis requested that the Board orders be separated into two motions, because it will take longer to obtain a building permit for the garage conversion. Ovide Paul, 435 SW 5th Avenue, Boynton Beach, pled no contest and asked for six months. Chairman DeLiso requested to view the photographs. Inspector Lewis presented the photos to the respondent and then to the Board. Mr. Foot asked the City how much time was needed. Inspector Lewis stated at least four months for the garage and one to two months for the fence. Chairman DeLiso suggested giving the respondent six months for the garage. The respondent stated that they have contracted with a fence company, but the job cannot start for four weeks. Motion Based on the testimony and evidence presented in Case No. 02-834, Mr. Foot moved that this Board find, as a matter of fact and as a conclusion of law, that Ovide and Mededine Paul are in violation of Code Sections Article XVIll, Section 3 and Section 1801.2.1.8' of the Swimming Pool Code and Chapter 25,-Article XVII, Section 3, Inc. of the City Code of Ordinances. Mr. Foot moved to order that the Respondents correct the violations on or before July 14, 2002. If the Respondents do not comply with this Order, a fine in the amount of $25.00 per day, plus administrative Costs shall be imposed, The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division to arrange for reinspection of the property to verify compliance with this Order. Motion seconded by Ms. Costantino and unanimously carried. Ms. Costantino had concerns about the pool being secure. Inspector Lewis stated that the temporary fence, which was put up around the screen enclosure, was secure and should be sufficient. The motion unanimously carried. Motion Based on the testimony and evidence presented in Case No. 02-834, Mr. Foot moved that this Board find, as a matter of fact and as a conclusion of law, that Ovide and Mederline Paul are in violation of Code Sections Chapter 15, Article Meeting Minutes Code Compliance Board Boynton Beach, FL May 15, 2002 IX-15-120 (D) 1, Inc. of the City Code of Ordinances and FBC '01 ED 104.1.1. Mr. Foot moved to order that the Respondents correct the violation on or before September 13, 2002. If the Respondents do not comply with this Order, a fine in the amount of $25.00 per day, plus administrative costs shall be imposed, The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division to arrange for reinspection of the property to verify compliance with this Order. Motion died for a lack of a second. Motion Based on the testimony and evidence presented in Case No. 02-834, Vice Chair Hammer moved that this Board find, as a matter of fact and as a conclusion of law, that Ovide and Mederline Paul are in violation of Code Sections Chapter 15, Article IX-15-120 (D) 1, Inc. of the City Code of Ordinances and FBC '01 ED 104.1.1. Vice Chair Hammer moved to order that the Respondents correct the violations on or before November 30, 2002. If the Respondents do not comply with this Order, a fine in the amount of $25.00 per day, plus administrative costs shall be imposed. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division to arrange for reinspection of the property to verify compliance with this Order. Motion seconded by Ms. Costantino. Motion carded 6-1 (Mr. Foot dissenting.) Case #02-1013 Property Address: Violation: Learie W. Wells 740 NW 1st Avenue Article XVIII, Section 3, Chapter 15, Article IX-15-120 (D) Inc. and 10-52 B.B.C. of Ord.; Pool needs proper barrier installed to maintain Safety. Property needs to be mowed and trimmed mainly in the backyard. Pool needs to be restored to sanitary condition. Remove all trash, debris and inoperable vehicle from the property. Inspector Lewis stated that the property was originally cited on April 17, 2002. Learie W. Wells, 6644 Emalyn Court, Lake Worth, said that the property was rental property and is currently vacant. He pled no contest and requested three weeks to bring the property into compliance. Mr. Foot inquired about the hazards with regard to the pool. Inspector Lewis said that the pool was a hazard and that a person could easily fall into the pool. Mr. Wells acknowledged that the door to the front gate was broken and he could fix this within 10 days. Inspector Lewis presented photos and said that there are holes in the chain link fence as well. 6 Meeting Minutes Code Compliance Board Boynton Beach, FL May 15, 2002 Motion Based on the testimony and evidence presented in Case No. 02-1013, Mr. Foot moved that this Board find, as a matter of fact and as a conclusion of law, that Learie W. Wells is in violation of Code Sections Article XVIll, Section 3, Chapter 15, Article IX-15-120 (D), Inc. and 10-52 of the B.B.C. of Ordinances. Mr. Foot moved to order that the Respondent correct the violations on or before June 5, 2002. If the Respondent does not comply with this Order, a fine in the amount of $50.00 per day, plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division to arrange for reinspection of the property to verify compliance with this Order. Motion died for lack of a second. Motion Based on the testimony and evidence presented in Case No. 02-1013, Vice Chair Hammer moved that this Board find, as a matter of fact and as a conclusion of law, that Learie W. Wells is in violation of Code Sections Article XVIII, Section 3, Chapter 15, Article IX-15-120 (D), Inc. and 10-52 of the B.B.C. of Ordinances. Vice Chair Hammer moved to order that the Respondent correct the violations on or before June 14, 2002. If the Respondent does not comply with this Order, a fine in the amount of $25.00 per day, plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division to arrange for reinspection of the property to vedfy compliance with this Order. Motion seconded by Mr. Walsh and carried 6-1 (Mr. Foot dissenting.) Case #02-480 Property Address: Violation: Lake Worth Mariner Village HOA 732 NE 12th Terrace SBC '97 Edition 105.6; Permit #00-3249- Required inspections - See copy of "red tag" dated December 19, 2001. Storage shed installed without an inspection and shed is not located on the proposed site and does not meet the required setbacks. Inspector Webb stated that the property was originally cited on February 28, 2002. Service was obtained by certified mail. Mr. Robert O'Neil, 718-4 NE 12th Terrace, Boynton Beach, pled not guilty. Attorney Tolces asked Mr. O'Neil what his relationship was with the respondent. Mr. O'Neil stated that he is Vice President of the new Board for the Association. Mr. O'Neil distributed a handout to the Board regarding the history of the installation of the shed. Meeting Minutes Code Compliance Board Boynton Beach, FL May 15, 2002 Inspector Webb stated that the shed was supposed to be erected on a different site, but was built on another spot. Also, the City was never contacted for an inspection. Mr. O'Neil stated that the address cited was incorrect. The shed is a freestanding building located elsewhere on the property. Attorney Tolces requested that the second respondent identify himself. Elliot Linskey, 624-1 NE 12th Terrace, Boynton Beach, stated he was Treasurer of the Board. Mr. O'Neil stated that he has been to the City on three occasions to resolve the issue. He presented a drawing showing the location of the shed on the complex. Originally they planned to erect a 12' x 32' shed, and the company that sold them the shed applied for a permit, but never put the shed up. Seven months later Mariner's Village hired another contractor that pulled the permit. This particular contractor was paid, never put the shed up, and took half the building with him. Mariner's Village is planning to construct a recreation building to create a play area for the children in the greenways area of the property. The prior Board put the shed in a different area than originally intended. The shed now is 23' to the property line and does not meet the setback requirements. Mr. O'Neil spoke to the Planning Division about obtaining a variance and he was referred to the Permitting Division. After speaking with the Permitting Division, he was under the impression that he could use the same permit, but that was not correct because the permit lapsed. Chairman DeLiso explained that in order to obtain a variance, a hardship has to exist and Attorney Tolces explained what this involved. Mr, Foot inquired how long this would take to resolve. Inspector Webb was not certain and suggested that the Building Division appear at the next meeting to address the issue. Chairman DeLiso pointed out that the respondent had two alternatives--either obtain a variance, or move the shed. If the shed had been erected where it was originally intended, it would have met the setbacks. Mr. Foot pointed out that the respondent pled not guilty and that in fact they did not comply with the building code and the Board should find them guilty or ask them to change their plea. Mr. Foot suggested giving them 90 days to resolve the issue. Motion Based on the testimony and evidence presented in Case No. 02-480, Mr. Foot moved that this Board find, as a matter of fact and as a conclusion of law, that Lake Worth Mariner Village HOA is in violation of the SBC '97 Edition 105.6. Mr. Foot moved to order that the Respondent correct the violation on or before 8 Meeting Minutes Code Compliance Board Boynton Beach, FL May 15, 2002 August 14, 2002. If the Respondent does not comply with this Order, a fine in the amount of $25.00 per day, plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division to arrange for reinspection of the property to verify compliance with this Order. Motion seconded by Ms. Costantino. Chairman DeLiso asked the respondent what they intended to do. Mr. O'Neil said they would be applying for a variance. Chairman DeLiso asked Mr. Blasie if 90 days would be enough time to apply for a variance. Mr. Blasie felt this was possible if the respondent moved on it: right away. He recommended giving the respondent 120 days. Mr. Foot amended his motion to change the compliance date to September 13, 2002. Mr. Walsh seconded the amended motion that carried 7-0. Case #02-551 Property Address: Violation: Jean C. Dorisca 111 NW 3rd Avenue Chapter 15, Article IX-15-120 (D), Inc.; Unregistered/inoperable vehicles not allowed in residential area; please remove. Inspector Pierre stated that the case was originally cited on March 7, 2002. The violation was discovered through routine inspection. Jean Dorisca, 111 NW 3rd Avenue, Boynton Beach, pled no contest. The respondent said that it was not his car and he has been having difficulty reaching the owner of the vehicle who is currently in New York. The respondent agreed to 30 days for compliance. Motion Based on the testimony and evidence presented in Case No. 02-551, Mr. Miriana moved: that this Board find, as a matter of fact and as a conclusion of law, that Jean C. Dorisca is in violation of Code Sections Chapter 15, Article IX-15-120 (D), Inc. of the City Code of Ordinances. Mr. Mariana moved to order that the Respondent correct the violation on or before June 14, 2002. If the Respondent does not comply with this Order, a fine in the amount of $25,00 per day, plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division to arrange for reinspection of the property to verify compliance with this Order. Case #02-710 Property Address: Violation: Joseph A. & Vito DeCosmo 209 SE 6th Avenue Section 13-16 B.B.C. of Ord., FBC '01 ED 104.1.1, Chapter 15, Article IX-15-120 (B) 2A 9 Meeting Minutes Code Compliance Board Boynton Beach, FL May 15, 2002 and PT3-LDR, Chapter 2.S.SA.5.B. (13); (1) Permits required for structure, including canopy, 6' wood fence and office built inside the bay. (2) Occupational License is required for rental property. (3) Exterior storage not allowed without screening. Please remove truck body. (4) Illegal bumpers are not allowed in swale area. Inspector Pierre stated that the case was originally cited on March 19, 2002. Inspector Pierre said that all of the violations have complied, except for the office within the bay. Joseph A. DeCosmo, 209 SE 6th Avenue, Boynton Beach, pled not guilty. Inspector Pierre said the violation was the result of a complaint by the next-door neighbor. Attorney Tolces requested that the record reflect that the photos were presented to the respondent first without objection and then to the Board. The respondent said he pled not guilty because the office has been in the bay for 33 years and there have been three legally licensed businesses that have occupied the office over the years. Chairman DeLiso inquired if the respondent owned the building, to which he replied he did. Chairman DeLiso informed him that he was responsible for what his tenants do. Mr. DeCosmo said that the building was CO'd with the office in it. Chairman DeLiso asked for proof of this and the respondent said he had none. Mr. DeCosmo stated that the City has no proof either. The respondent present documents that he intended to file with the Palm Beach County Circuit Court to ask the Court to decide whether or not he is guilty. Chairman DeLiso explained that it is the Board's responsibility to find the respondent either guilty or not guilty and it.is obvious to the Board that he is guilty because the office is not permitted. Chairman DeLiso noted that the respondent has the right to appeal the decision of this Board. Mr. Foot inquired what the use of the building was and was informed that it was a warehouse. An electrical contractor, real estate office and a construction company had previously occupied the office. Inspector Pierre said he checked with the Building Department and there is no permit for the office, which is a violation of FBC '01 ED 104.1.1. Chairman DeLiso asked if the City had proof that the building was CO'd without the office. Inspector Pierre said that there is. Inspector Pierre did not have these documents with him. Chairman DeLiso suggested tabling the case until the City can present the proper documents. Motion Vice Chair Hammer moved to continue the hearing on Case #02-710 until June 19, 2002. Motion seconded by Mr. Walsh and unanimously carried. Case #02-192 Property Address: Violation: Alene & Vincent Molle, Sr. 2915 SE 2nd Street Chapter 15, Article IX-15-120 (D), Inc.; De- weed/fertilize and water yard to create a uniform green appearance. Inspector Roy stated that the property was originally cited on January 17, 2002. The violation was discovered through routine inspection and service was accomplished by certified mail, Vincent Molle, 896 NE Sumner Avenue, Jensen Beach, Florida, said he owns the duplex at 2915 SE 2nd Street and pled no contest. The respondent said that he is going to re-sod the property. Chairman DeLiso inquired if the respondent intended to install a sprinkler system and he said he did not. Mr. Molle was worried that in the event water restrictions were mandated, the sod would die. Chairman DeLiso told him that if water restrictions were put in place, the property would not be cited. Motion Based on the testimony and evidence presented in Case No. 02-192, Mr. Foot moved that this Board find, as a matter of fact and as a conclusion of law, that Alene and Vincent Mole, Sr. are in violation of Code Sections Chapter 15, Article IX-15-120 (D), Inc. of the City Code of Ordinances. Mr. Foot moved to order that the Respondents correct the violation on or before August 14, 2002. If the Respondents do not comply with this Order, a fine in the amount of $25.00 per day, plus administrative costs shall be imposed. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division to arrange for reinspection of the property to verify compliance with this Order. Motion seconded by Mr. Walsh and unanimously carried. Case #02-1192 Property Address: Violation: Gary C. & Pamela J. Case 811 Ocean Inlet Dr. FBC '01 ED 104.1.1; Stop using unpermitted fuel tank. You must obtain a proper permit and inspections. 11 Meeting Minutes Code Compliance Board Boynton Beach, FL May 15, 2002 Inspector Melillo stated that the case was originally cited on May 8, 2002 through a "red tag" from the Building Division and the Fire Marshal. Service was accomplished by hand carry. Gary Case, 811 Ocean Inlet Dr., Boynton Beach, pled no contest and asked for 90 days. Chairman DeLiso asked what the size of the tank was and the respondent stated it was a 280-gallon, aboveground tank in which diesel fuel is stored. Mr. Foot asked if the City agreed to 90 days. Inspector Melillo responded that the respondent must get approval from DERM and then the City's Engineering Division. This process will take some time and the Respondent cannot use the tank. The City agreed to 90 days. Motion Based on the testimony and evidence presented in Case No. 02-1192, Mr. Foot moved that this Board find, as a matter of fact and as a conclusion of law, that Gary C. and Pamela J. Case are in violation of FBC '01 ED 104.1,1. Mr. Foot moved to order that the Respondents correct the violation on or before August 14, 2002. If the Respondents do not comply with this Order, a fine in the amount of $25.00 per day, plus administrative costs shall be imposed. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division to arrange for reinspection of the property to verify compliance with this Order. OLD BUSINESS LIEN PENALTY CERTIFICATIONS Case #01-3070 Annette Harrell 391 NE 28th Court Inspector Guillaume stated that the property was cited for violation of the Community Appearance Code. The respondent appeared at the Code Compliance Board Hearing on January 16, 2002. A compliance date of April 18, 2002 was set or be fined $25 per day. The property has not yet complied for 27 days of non-compliance. Inspector Guillaume said that most of the violations have been corrected except for the shed. Annette Harrell, 391 NE 28th Court, Boynton Beach asked if the fine would continue to run until the property complied. Chairman DeLiso would like to see a review board for this purpose because there are a lot of people being turned down that are in need of help. Attorney Tolces pointed out that Community Redevelopment must follow certain Federal guidelines. Mr. Blasie said that he did meet with Community Redevelopment last Friday and the requirements that apply for assistance are based on the median income in Palm Beach County, which is quite high and is to the benefit of the residents. Case #01-3280 Carlos & Leonor Perez 115 NE 4th Avenue Inspector Pierre stated the property was cited on November 29, 2001 for violation of the Community Appearance Code. No one appeared at the February 20, 2002 Code Compliance Board Hearing. A compliance date of March 22, 2002 was set or be fined $25.00 per day. The property has not yet complied. Carlos Perez, 115 NE 4th Avenue, Boynton Beach, was present. Chairman DeLiso informed the respondent that he has 54 days of non-compliance and that service was made by posting, because the City was unable to contact him. Mr. Foot inquired if the City had prior contact with the respondent to inform him of the violations. Inspector Roy said he spoke with Mr. Perez's brother when he posted the property and he read the violations to him. His brother told Inspector Roy that the respondent was in the hospital. Inspector Pierre said he went to the house several times and the respondent used fowl language on several occasions. Because the respondent refused to pick up his mail, the property had to be posted. Chairman DeLiso asked the respondent how much time he needed to bring the property into compliance and explained that the fine kept running. Mr. Perez said he would not put grass on his property because he couldn't afford to water the grass. Chairman DeLiso stated if the respondent refused to fix the property, a lien would be placed on the property. Mr. Foot suggested that the respondent xeriscape his property. Mr. Estella testified that prior to the original hearing date, the property was brought into compliance. However, soon after that his younger brother parked his car on the grass and killed it. There were two inoperable cars on the property and the City had them towed away, but the tow company took one of the wrong cars. Mr. Miller said he tried several towing companies, but they all refused to tow the remaining car off the property. He spoke with Inspector Pierre today who sent a tow company to the property and the car was removed today. Inspector Pierre pointed out that there were three cars. The City towed the two cars that were in the driveway, but could not tow the car parked in the carport. Mr. Miller said that car was his grandson's car and he intends to get it registered tomorrow. Mr. Miller agreed to 30 days for compliance.
