A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF BOYNTON BEACH, FLORIDA, URGING T~IE FLORIDA
LEAGUE OF CITIES TO DRAFT AND SUPPORT CORRECTIVE
LEGISLATION WHICH WILL ELIMINATE THE REQUIREMENT
THAT YARD TRASH COLLECTED BY AND IN THE SEVERAL
M~ICIPALITIES IN THE STATE BE DISPOSED OF IN
THE SAME MANNER AS HOUSEHOLD GARBAGE AND OTHER
SOLID WASTE.
WHEREAS, the Department of Pollution Control has adopted
rules as set forth in Chapter 17-7 of the Florida Administrative
Code, and
WHEREAS, these rules, as interpreted by the Department of
Pollution Control personnel, require yard trash such as, but not
limited to, tree branches, lawn clippings, coconuts and ornamental
vegetation of all kinds to be considered as though it were house-
hold garbage, and
WHEREAS, the rules of the Department of Pollution Control
do not differentiate between household garbage and yard trash,
and
WHEREAS, the Department of Pollution Control rules, as
interpreted by their field personnel, will require identical
disposal treatment for vegetative matter collected by the var-
ious municipalities in the State to be disposed of as though it
were dangerous to the environment, and
WHEREAS, the rules, as interpreted by the Department of
Pollution Control personnel, will drastically increase the costs
of yard trash disposal to approximately triple that now being
experienced by the City, and
WHEREAS, no substantial evidence has been presented that
decaying organic matter emanating from trees, shrubs, lawn
clippings, palm fronds and the like are harmful to the environ-
ment:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA:
SeCtion 1. That the Florida League of Cities is
hereby requested to evaluate the magnitude of this problem to
the municipalities in the State, and thereafter urge and sup-
port corrective legislation that will allow the municipalities
in the State to continue to dispose of vegetative matter col-
lect~ed by the municipalities in a manner other than that
required for common household and commercial garbage.
Section 2. The City Clerk is here bf directed to
forthwith furnish certified copies of this Resolution to the
Florida League of Cities and such other agencies or persons
as may be appropriate.
