Herb Suss, a resident of Quail Run, requested that the Commission rescind its
approval of the project it approved on the corner of Woolbright Road and Congress
Avenue since the construction has yet to start. He is opposed to the placement and
height of the elevator, which is 17' over code. He did not feel that the building would
fit in with the .plans for the Congress Avenue Corridor and would like the building
reconfigured.
Mr. Suss complimented the City Services Institute in which he Es participating. Mr. Suss
would like to see the plans formulated in Visions 20/20 brought to fruition as soon as
possible.
Richard Stone, 111 SE Ist Street, Boynton Beach, spoke on behalf of the Blue and
White Collar Bargaining Units, regarding an article that appeared in the ,~a//~ Bea£/~
/~osz'on .lune :~9th. Mr. Stone read the last sentence of the article that referred to "City
employees also get an annual cost of living raise." Mr. Stone stated that this is not
correct and employees of the bargaining units and other non-contractual employees do
not get an annual cost of living raise.
Brian Edwards, 629 NE 9th Avenue, Boynton Beach, reported on the Planned
Approach to Community Health (PATCH). Hr. Edwards thanked the City for allowing
PATCH to use the Wilson Center and the Civic Center. PATCH, in conjunction with the
Palm Beach County Health Department, had an immunization van at the Civic Center
and 20 children were inoculated. Last Saturday 20 women received mammograms at
the Wilson Center with the assistance of the Boca Community Hospital. Mr. Edwards
thanked Mr. DeCarlo, the City's Neighborhood Specialist, and the Community Relations
Board for their assistance. Another mammogram session is scheduled for July 27th and
an H~V van will be at the Wilson Center on August 3:Lst.
III. OTHER:
A. Informational Items by Members of the City Commission
Commissioner Fisher contacted the County to determine if the u-turn on Woolbright and
SW. 26th Street could be eliminated. He received a reply from Charles Walker, the
County's Director of the Traffic Division that denied the City's request, since a traffic
study indicated that there would be no justification to eliminate the u-turn.
Commissioner Fisher furnished the letter to the Recording Secretary to place on file in
the City Clerk's Office with the original minutes of the meeting.
Commissioner Fisher noted that Adelphia Cable Company is raising rates and inquired if
there was any action that the City could take. Mr. Bressner responded that the Federal

Government is responsible for setting rates. City Attorney Cherof reported that his
office is in the process of reviewing Adelphia's franchise agreement for compliance
purposes and will report his findings to the Commission.
Commissioner Fisher announced that the Annual Adult/Child Golf Tournament took
place last weekend. Staff did an excellent job and everyone had a good time.

V. ANNOUNCEMENTS & PRESENTATIONS:
A. Announcements:
State Legislative Update by Anne M. Gannon, Florida House of
Representatives, 88th District
Rep. Gannon stated that her new district as of November 2002 would be District 86 that
will now cover several districts in Boynton Beach east of 1-95. The Senate and
Congressional Plans were approved yesterday by the Department of ]ustice and by the
courts today. However, the House plan has not been pre-cleared because there are
some problems with a particular county. Either the leadership of the house and senate
can redraw the districts and resubmit it for approval or they will have to go back into
special session. Hopefully, this issue will be resolved in the next week or two.
The State's budget is $52 billion, $24 billion of which are federal funds. For every 45¢
spent, the government contributes 55¢. Approximately $4 billion of the budget is non-
reoccurring general revenue and hopefully the sales tax revenue will increase to make
up for the loss of those funds.
Rep. Gannon also reported on the Election Reform Package recently adopted. The
State Statute now permits that after the second primary, a person can vote early. This
would allow a registered voter to vote for any candidate that is on the ballot in
November by going to the Supervisor of Election's Office to vote early. The Supervisor
of Elections is also required to keep the Office open on Saturdays for this purpose. All
registered voters will be receiving new voter registration cards and a large percentage
will be assigned new precinct numbers.
Rep. Gannon urged anyone that needed assistance with voting or transportation to the
polls to telephone her office. A brief question and answer period followed and Rep.
Gannon thanked the City for allowing her an opportunity to speak.

Mayor Broening read the Proclamation declaring July Recreation and Parks Month and
presented it to Wally Majors, Recreation Director for the City.
Mr. Majors thanked the Mayor and Commissioners for the Proclamation and urged all
citizens to participate in the City's recreation programs. Mr. Majors announced the
Fourth of ]uly celebration that will take place at the Boynton Beach High School.

Presentation of the Citizen Action SystemTM by Carisse Weise and
acknowledgement of receipt of the Tnnovations in Communications
and Technology Award in the over 50,000-population category
iVls. Weise gave a presentation of the City's new Citizen Action SystemTM (CAS), which is
a web-based Geographic [nformation System that will be used by City staff to track
citizen inquiries, concerns and other general feedback. Ms. Weise demonstrated the
various steps involved in utilizing the CAS system. Ms. Weise also reviewed the GTS
system and explained how it is linked to the CAS system and can be used when dealing
with property questions and complaints.
Commissioner Fisher inquired if there was a time requirement in addressing the
inquiries. Mr. Bressner stated that time requirements varied depending upon the type of
case. A monthly report will be generated setting out the number of cases logged and
the time it took to handle the case. Ms. Weise stated that there is a policy that a citizen
will receive a first response within 72 hours.
Mr. Bressner stated that Ms. Weise has done a wonderful job with the project, working
together with Regina Hagger and Peter Wallace. The City received a State award for
technology from the Florida City and County Managers Association for communities with
a population of over 50,000 people and Mr. Bressner presented the award to Ms. Weise.
Receive the South Congress Avenue rvl-! Planning Study and discuss study
recommendatio ns
Mayor Broening explained that the report being presented is a separate issue that the
Commission will receive, discuss and make recommendations on and is separate and
apart from the two public hearing items. A full and complete copy of the South
Congress Avenue (lVl-:L) Study is attached and made a part of the minutes of this
meeting.
Mr. Rumpf, Planning and Zoning Director, announced that the project team included
Principal Planner, Lusia Galav; Senior Planner, Dick Hudson; Hannah IVlatras, Economic
Planner; and Eric Johnson, Project Planner. The Congress Avenue Study resulted from
a request by the City Commission in January to address the concerns of area residents
regarding the industrial zoned lands and how the remaining parcels could be developed.
The study was completed during the "Notice of ]:ntent" (NOT) time frame that concluded
July Ist. When an NOT is made, it triggers special temporary regulations that control
the use of the land during this period. The NOT expired July Ist. The study included
the second largest industrial pocket in the City and deals with the concerns of area
residents.
IVlr. Rumpf introduced Eric Johnson, who gave a PowerPoint presentation of the study
and illustrated in detail the area of the study by utilizing maps and architectural

drawings. Mr. Johnson pointed out that there is a difference bet~veen the NOT study
area and the M-1 Study. The M-1 study area included Caloosa Park and the Board of
Public Construction property, comprising 61 properties totaling 285 acres. Caloosa Park
contains 58 acres and the Board of Public Construction property is over 40 acres.
Mr. Johnson explained that IVl-1 use is an industrial category that allows for different
uses. Some of these include research and development, wholesale and distribution,
businesses, repair facilities, warehousing and storage, transportation, communication
and utility facilities, and others. The M-1 zoning district dictates what is allowed and
what is not allowed. Tt also regulates the size of the building, landscaping and parking.
Mr. Johnson reviewed the various properties that were contained in the study area.
also contains two Lake Worth Drainage Canals and any work done near the canals
requires a permit from the LWDD. Other notable businesses are Tire Kingdom, Guardian
Storage, U-Haul, Berry Veal Corp. and the future site of United Forward. The South
Area Transportation Compound is currently storing approximately 170 to 200 buses on
their property.
The Biscayne Acquifer is the sole source of potable water in the County. There are
three water distribution mains and one reuse main that could service the three vacant
parcels if needed. There are also three sanitary sewer facilities in the area. Adelphia
Cable, FPL, MC], Bell South and Palm Beach County Operations provide service in this
area as well. As of 2001 the 61 developed parcels total assessed value was over $71
million.
There are 204 Occupational Licenses for the businesses in the study area and they are
broken down into nine categories. The major categories are construction,
manufacturing, wholesale trade, transportation, warehousing and personal and
professional service sectors, with most licenses being in the manufacturing sector.
Thirty percent of the Congress Avenue licenses are engaged primarily in wholesale
trade businesses.
The vacant parcels include lots containing 33 acres, 15 acres and 5 acres. A Land Use
Amendment Application has been submitted to the City for the 33-acre parcel, which is
the second largest parcel in the area. The Land Use Amendment is a request to change
the land use classification from industrial to high-density residential. All vacant parcels
front Congress Avenue.
Golfview Harbour Estates and a new elementary school opening in August 2002 bound
the study area to the north. The CSX Railroad and the ]:-95 right-of-way border the
area to the east. To the west of the studY area is Hunters Run, which is a Iow density
PUD. Within Hunters Run is another development called the Tsles at Hunters Run.
Hunters Run consists of 470 acres with a density of 5.4 dwelling units per acre. To the
north is Manor Care that provides nursing facilities and respite. To the south is the
South County Regional Waste Water Treatment Facility Plant, which is actually in Delray

Beach. The properties on Congress Avenue located in Delray Beach have a commerce
use designation. Mr..lohnson explained that in urban planning the object is to separate
incompatible land uses that the City's Land Development Regulations is trying to
accomplish.
Mr..lohnson introduced Dick Hudson, Senior Planner, to discuss the City's
Comprehensive Plan.
Mr. Hudson noted that there are two policies in the Comprehensive Plan that deal with
industrial land. One is to provide acreage to accommodate the projected working
population and to prohibit conversion of land designated industrial to other uses, unless
it could provide for future employment. The second major objective is to keep industrial
uses in industrial parks or concentrated areas to maximize the linkage between
complementary industries. The future land use element adopted in 1989 specifically
recommends that all site plans along Congress Avenue should include strong
consideration of esthetics.
Mr. Johnson explained the difference between M-1 and PID zoning. PID allows the City
to decide what uses could be allowed and goes through a use approval process. M-!
already has a list of permitted uses and as long as a developer submits a site plan that
complies with the LDR regulations, it is considered a permitted use and is allowed by
right. However, in a PID district, an applicant must go through a use approval process
that is heard by the Planning and Development Board and the City Commission. Also
there are different setback requirements in these two districts. A PID has greater
setback requirements, as well as a periphery buffer requirement of 25'.
As of 2002, there are nine new residential rental projects in the City that total 2,599
units. There are seven vacant properties not yet developed and if these properties
were built out to the maximum allowable, there would be an additional 1,758 dwelling
units, making a grand total of 4,357 dwelling units. Eliminating industrial areas would
eliminate employment opportunities. Tndustrial uses routinely generate eight to 24
employees per acre.
Hr. Rumpf presented staff'S recommendations:
(1) tmprove the appearance on major roadways;
(2) Transition some of the older projects to improve their buildings and
signage;
(3) Provide landscaping improvements;
(4) ~[ncorporate appearance and design requirements;
(5) Retain the industrial land and implement Policy 1.19.2 of the
Comprehensive Plan;
(6) Reduce commercial/industrial projects to 15 or more acres and require
approval as a PID;
(7) Decrease the minimum land area for a PTD to 15 acres; and

(8) Any rezoning of those properties would adhere to policy :L.15.3
Lynne Matson, 1 W. Chesterfield Drive, Boynton Beach said she was a Commissioner
when Quantum Park was turned into a Community Development District, which was a
special taxing district to help bring light industry, research and development to Boynton
Beach. However, this did not happen and today in Quantum Park there is a Pancake
House, gas stations, CarMax and everything except what was intended. She
commended staff on the study, but if the City cannot fill up Quantum Park, she did not
think that the City could attract a quality project to this property.
Ms. Matson pointed out that the residents of Hunters Run have contributed greatly to
the City and other agencies over the years, as well as providing a great amount of
volunteer hours on City Boards. She noted that both Boca Raton and Delray Beach have
viable downtowns, which Boynton Beach does not have. She stated that Congress
Avenue is the City's downtown and what is being proposed tonight is a travesty.
Alice Otis, 203 SW 13th Street, Boynton Beach, said she was present at the Planning
and Development Board meeting on Tuesday and it reminded her of the same type of
attack on City staff and residents made by a donut-factory lawyer. She did not feel it
was necessary to ridicule the City and its plans or malign the small businesses in the
C ty.
Ms. Otis did not think that the apartments being proposed represented high-end rental
units and consisted of third-floor walk-ups. Also, the proposed apartments would take
business away from the City adding to the poor economic conditions that currently exist
in the country. She pointed out that new residents need employment and require City
services. Ms. Otis requested that the City not sell out on zoning.
Bob Ensler, 26 Woods Lane, Boynton Beach, read three items from the City's
Comprehensive Plan that states (1) the purpose of the Ordinance is to preserve and
enhance the existing quality of life; (2) to address current problems that have occurred
before the use and development of the land; and (3) to deal effectively with future
problems that may occur as a result of the use and development of land.
Mr. Ensler noted that the first two miles of Congress Avenue coming from Delray Beach
include seven residential areas and others running off Congress Avenue, as well as
several assisted living facilities. These properties represent 65% of the frontage on
Congress Avenue. Only 10% of the properties along Congress Avenue fall under the
commercial designation. Mr. Ensler said there is no industrial land usage on Congress
Avenue and to institute this use at this time does not make sense.
Hr. Ensler supports the development of the major corridors in the City, but does not
want to use one at the expense of another. Tf the property in question were left as
industrial, this would create an isolated district. He also felt that the industrial use
would affect the property values of the residential properties. Mr. Ensler said that

putting an attractive development on this property would create a nice entrance to the
City on Congress Avenue.
Maurice Rosenstock requested to reserve his remarks to the Public Hearing item.
Mike Friedland, 330 NE 26th Avenue, Boynton Beach said that after reading the South
Congress Avenue Study, he feels that the decision that the Planning and Development
Board made on Tuesday was the correct decision. He pointed out that the land has
remained vacant for a long period of time and now someone is interested in developing
it. Mr. Friedland felt that the project would make a beautiful entrance into the City on
Congress Avenue. He did not think that the City had too many apartments and noted in
the winter the City's population doubles. Winter residents have to live somewhere and
contribute a great deal of money to the local economy. He urged the Commissioners to
approve the proposed project.
Mayor Broening closed the public audience.
Commissioner McCray thanked staff for doing a good job on preparing the study.
Commissioner McCray requested that staff furnish a complete copy of the study to all
members of the Planning and Development Board since it was not available at their
Tuesday meeting. He also requested that copies of the study be made available to the
public.
Commissioner Fisher also noted staff did a very professional job in providing the study.
He pointed out that the School District intends to convert South Technical High School
into a Full Service School for students who do not fit in with the general school
population. This is something that will need to be addressed.
Mayor Broening highly respects staff and said that the Planning and Zoning staff is
charged with the responsibility of ensuring that the City proceeds in accordance with
the Comprehensive Plan. He also commended staff on a job well done, but feels that it
needs more work. Mayor Broening pointed out that if the M-1 zoning remained, there
are undesirable businesses that would be permitted.
Mayor Broening noted that Bethesda Hospital has expressed an interest in the vacant
APAC building. Mayor Broening is a proponent of density, which is the key to the future
of South Florida and other parts of the Country. He noted that there is a dearth of
housing throughout the Country and that the new apartments going up in the City are
top quality and an asset to the City. Mayor Broening was not ready to adopt the plan
as presented.
Commissioner Fisher concurred and looked at the plan as recommendations that did not
have to be adopted.
Vice Mayor Weiland did not have a problem with adopting the plan.

Commissioner Fisher requested that Public Audience speakers be limited to two minutes
each that was agreeable to everyone.
City Attorney Cherof stated that this was a quasi-judicial proceeding and the applicant
has agreed to consolidate the two items into one hearing. Anyone who intends to testify
must be sworn in. City Attorney Cherof explained the procedures that must be followed
when assuming the podium and the rules of decorum. City Attorney Cherof
administered the oath to all persons testifying.
Mr. Hudson testified that since the property is over :[0 acres it is being reviewed as a
large-scale, future land use map amendment. Chapter 163 of the Florida Statutes limits
large-scale amendments to two adoptions each year. If the City Commission approves

the amendment, it will be submitted to the Florida Department of Community of Affairs
for their review and comments. :It is possible that an adoption hearing could be
scheduled for late in November 2002. The rezoning will not be reviewed until
November, together with the land use map amendment.
The Department of Community Affairs has informed the City that they are required to
send courtesy statements regarding the NOT to any citizen who furnishes their name
and address to the City during this hearing or at the adoption hearing. Persons
requesting to receive this information were advised to complete the sign-up sheets
contained on the table in the back of the Chambers.
Mr. Hudson pointed out that the parcel in question contains 32.159 acres and is
classified as industrial and zoned M-1. The applicant is requesting that the property be
reclassified from industrial to high-density residential and to rezone from H-1 to PUD to
allow the applicant to construct a rental apartment complex with a maximum of 347
units. Mr. Hudson reviewed the various uses and properties that surround the parcel in
question.
Staff must review eight criteria when reviewing amendments and rezonings, which can
be found in the City Codes in Article :II, Section 9 (''Administration and Enforcement'~ as
follows:
1. ]:s the proposed rezoning consistent with applicable Comprehensive Plan
Policies?
2. Does the project adhere, as stated in Policy 1.19.2, to the principle that the
City shall provide continued effort to allow for industrial acreage to
accommodate the approximate industrial employment that has been
projected in the future land use element? (The Policy also prohibits the
conversion of land designated industrial, unless such conversion would
generate a range of employment choices for current and future residents.)
3. Does the project comply with Policy 1.19.4 that the City Shall continue to
encourage and enforce the development of industrial land in order to
maximize linkage between complementary industries?
Mr. Hudson pointed out that the project would not generate employment for current
and future residents. Staff feels that there will be a shortage in the demand and supply
for industrial spaces. The area is well defined and the conversion would diminish the
current, strong definitions of the area.
Staff also feels that the rezoning would create an isolated district contrary to the
established use pattern on the east side of Congress Avenue. IVlr. Hudson pointed out
that Hunters Run, directly across the street, is very Iow density residential. ]~t has been
determined that there is a noticeable increase in rental-occupied housing units and the
construction of large rental apartments. Currently, there are over 1,000 units under

construction or just entering the lease market. Staff supports multi-family units, but
feels they belong on the Federal Highway Corridor and the Central Business District.
4. Would the project be compatible with utility systems, roadways and other
public facilities? Under the proposed use, demands for sewer and water
services would increase slightly, but unanticipated demands on the service
could occur. National studies have shown that residential uses can have a
greater impact on municipal services as compared to industrial uses,
especially fire rescue and police.
5. Would the proposed rezoning be compatible with current and future use of
adjacent and nearby properties or would the property values of adjacent
properties be impacted.
6. :Is the property physically and economically developable under the existing
zoning? Staff feels that it is.
7. Ts the rezoning reasonably related to the needs of the neighborhood and the
City? Staff does not feel that the amendment and rezoning meet either one
of these criterion. There are indications that the rental apartment market is
slowing.
8. Are there adequate places in the City for the proposed use and in districts
where such uses are already allowed?
In summary, Mr. Hudson stated that staff does not feel that the request is consistent
with the intent of the Comprehensive Plan or the Congress Avenue M-1 Study. Staff
does not feel that the project would be compatible with adjacent land uses or existing
development and might create an increase in expenses for public safety. Staff
recommends that the request be denied. :If the amendment is approved for transmittal
to DCA, staff does recommend that the required PUD Master Plan be approved prior to
the approval of the rezoning.
Commissioner Fisher asked when the Comprehensive Plan in this section of the City was
last changed? Hr. Rumpf noted that the IVl-! designation has been in place since 1972.
Mr. Rumpf requested that staff be allowed to give a final summary.
Bonnie Miskel stated that she is a land use and zoning attorney and was present on
behalf of the applicant. Ms. Miskel felt that the main issue tonight was whether the
request would be consistent with the City's Comprehensive Plan. Ms. Miskel
acknowledged that there were eight criteria that the applicant must comply with to gain
approval and addressed each criterion.
Whether the Land Use Amendment would be consistent with the
Comprehensive Policies and Objectives. Several policies have been identified,
such as minimizing inconsistencies and incompatibilities between land use
plan designations.

2. The project would permit a full range of housing opportunities at varying
locations within the community.
3. The applicant does not believe that the conversion would have any impact on
the City's industrial acreage and feels the City has a surplus of industrial land.
4. Amending the land use on the southern end of the City would not interfere
with the industrial land uses to the north of the subject property.
Ms. Miskel agreed that industrial property is not consistent with residential property.
When the land was designated industrial in 1972, Hunters Run was not part of the City
at that time. Today, Hunters Run is a large part of the City and should be given
consideration in determining whether the designation of the property should remain
industrial.
Ms. Miskel stated that they provided a traffic study by Simmons and White with their
application and the report addressed a.m. and p.m. peak-hour traffic and total daily
traffic. If the site were developed industrial, it would generate approximately 23,000
trips per day and would access the same intersection used by Hunters Run. Industrial
uses create a different type of traffic including semi-tractor trailers, construction
vehicles, and 18-wheelers. If the property were developed residential it would create
under 3,500 trips per day.
Ms. Miskel felt that if 48 acres out of the 285 acres were changed to PID, something
could be done with the remainder of the land. Additionally, the City could be faced with
dealing with legal challenges. She also disagreed that their application was not
compatible with what is going on in the City and the Comprehensive Plan.
Ms. Miskel compared the Congress Avenue Corridor to Military Trail in Boca Raton.
There are residential communities at the north and south ends of Military Trail and
there are retail and offices in the middle. This has become a very successful corridor for
Boca Raton and she would like to see the City's Congress Avenue corridor mimic Military
Trail in Boca Raton. She felt that staff's study did not look at the entire corridor and
looked at only one area. Currently, the property is assessed at $1.12 million and taxes
are $24,000, of which $10,000 goes to the City. When the property is developed, the
assessed value would go to $34 million and a minimum tax of $600,000 wOuld be paid
to the County and the City would receive one-third of the amount. She disagreed with
staff's report that asserted there was a shortage of industrial land in the City and felt
that there was actually a surplus according to the County's study.
Some of the deterrents to putting in industrial in the proposed area is the lack of access
to 1-95 and is not centrally located from a distribution standpoint. Ms. Miskel did not
think that the industrial use would be compatible with Hunters Run. She requested to
be afforded an opportunity to rebut.
Mayor Broening opened up the public audience and restated that public comment is
limited to two minutes.

Herb Suss requested that the corridor be kept residential and the residents of Hunters
Run deserve some consideration. He pointed out that there are already over 170 buses
going onto Congress Avenue everyday in that area. Mr. Suss noted that Bethesda
Hospital would be coming into the area and would create jobs.
Lloyd Powell, 1112 N. Federal Highway, Boynton Beach said that many businesses
along North Federal Highway are operating under a conditional use designation. ]:f any
of these businesses need to relocate, they would have to go someplace. ]:f industrial
property is rezoned high density residential, there will be less industrial in the City. Mr.
Powell said that the City should not lose sight of retaining a good mix of all types of
zoned property.
Mike Fitzpatrick, 101 SW 4th Avenue, Boynton Beach felt that the development would
result in transient renters. Mr. Fitzpatrick pointed out that as soon as these renters
accumulate enough money, they would move out since no one wants to smell the
sewer plant, hear the traffic on ]:-95 or be aroused by the railroad every hour, twenty-
four hours per day. This project would create 250 additional cars twice a day, more
crowding at the beach, more crowding at the Library, more emergency medical calls,
more fire calls, more police calls, while destroying a crucial link for greenways between
Caloosa Park and the Delray Beach Park system. The development will use six million
gallons of water per month and will take away from the downtown redevelopment.
IVlr. Fitzpatrick suggested that the best use for the land would be for water retention
wetlands for the adjacent sewer plant. He urged the Commission to support staff, the
CRA and keep options open for the greenways study.
Bob Ensler, 26 Woods Lane, Boynton Beach, handed in a stack of green cards signed
by residents of Hunters Run to the Recording Secretary to be included as part of the
record of the meeting. Mr. Ensler asked all the residents who supported the project to
please stand up. He requested that the Commission support the project.
Herman Gold, 29 Northwoods Lane, Boynton Beach, is the Vice President of Hunters
Run, a residential community of 3,200 people. Mr. Gold said that he was once a
member of the City's Zoning Board of Appeals. He has lived at Hunters Run since 1986
and does not recall any plans being presented for this particular property..1P]:, who is a
renowned developer, wants to build an attractive, residential community and Mr. Gold
felt this would be a benefit to everyone. He requested that the property be rezoned
from industrial to residential.
Alvin Newman, 49 Bristol Drive, Boynton Beach, is the President of the President's
Council of Hunters Run that has 23 communities. When .]P]: gave a presentation at the
President's Council meeting, the Presidents unanimously voted for the project. He also
noted that there has never been any interest in the subject property due to the quality
of the land. Mr. Newman requested that the project be approved.

Lucien Kaminski, 20 Bristol Lane, Boynton Beach, has lived in Boynton Beach for 21
years. He pointed out that Hunters Run is responsible for 30% of all residential tax
revenues in the City, and he does not want to see property values diluted. He supports
the change of use for the land from industrial to residential. He noted that a new
elementary school will be opening next to Hunters Run and that an industrial area was
not suitable for schools. He urged the Commissioners to vote for the change.
Sue Steiner, 20 Villa Lane, Boynton Beach, is President of the Northwoods
Condominium Association at Hunters Run. She felt an industrial area would be totally
inappropriate at this location, and she expressed concerns about the elderly, children,
retirees, noise and air pollution. Ms. Steiner would like the entire area kept residential.
Alvin Cohen, 19 Villa Lane, Boynton Beach, is Secretary of the Board of Directors and
Chairman of Security for Hunters Run. Mr. Cohen is concerned about the increased
traffic at the intersection of Congress and Summit and the increased likelihood of
accidents, He did not think that the land would be developed industrially in the near
future and requested that the Commission move forward and :approve the project.
Maurice Rosenstock, 1 Villa Lane, Boynton Beach, was a former Chairman of the
Planning and Development Board and is still a current member of that Board. Mr.
Rosenstock was in favor of the proposed change to the Comprehensive'Plan. He
pointed out that a great deal of the project land is muck and water and thought the
best use for the land would have been a park, which is not going to happen. Because
of the condition of the land, he did not think it would be suitable for industrial
development. He urged the Commission to approve the project, which would result in a
beautification of the Congress Avenue Corridor.
Lynne Matson, 1 West Chesterfield Drive, Boynton Beach, a former City Commissioner
Vice IVlayor, and former CRA member, expressed concerns about the traffic if the
subject property was used for industrial. She thought that the traffic would interfere
with the school traffic and could create a dangerous situation for the children coming
and going to school. She would not like to see a strip club or slaughterhouse locate
onto this property if it remained M-1.
Mayor Broening closed the public hearing.
Mr. Rumpf summarized staff's position and said there were two major categories that
he would like to address: land use planning and marketing, and economic impact. He
stated that the residential uses going into Quantum Park are different from the
proposed project. He pointed out that the development would be located next to the
wastewater treatment plant. He also pointed out that the property is not a consolidated
piece and the residential area would still abut IVl-1 areas that could be categorized spot
zoning. Hr. Rumpf stated that staff was confident that the P[D would have
performance standards and the worst case uses mentioned would not be permitted.
He said that the P[D uses would enhance the uses at that site.

IVlr. Rumpf pointed out that the 38-acre parcel does not encompass the entire study
area. The IVI-1 zoned area would still remain. Secondly, Congress Avenue is a six-lane
divided major roadway and is an intense corridor. There are over 33i000 average daily
trips on Congress Avenue now and he did not agree with the traffic analysis mentioned
tonight that an additional 23~000 trips would be generated daily. He also did not' think
that the lack of a direct connection to 1-95 would be a hindrance to industrial
development.
IVlr. Rumpf opined that Boynton Beach could attract industrial development and over the
past five years 1.7 million square feet of industrial space and warehouse space has
been approved. Staff does not feel that there would be an impact on property values.
However, if the project were approved, the property lines would be very jaggered and
would have a definite impact on the area.
Vice Mayor Weiland asked Mr. Rumpf to address the Eastward-Ho IVlovement and its
purpose. Mr. Rumpf responded that the Eastward-Ho IVlovement was created to deal
with urban sprawl and has a great significance in Florida because of the wetlands and
farmland issues. To prevent sprawl onto these lands, this IVlovement encourages
development of the downtown areas, the cities and waterfront areas. ]:t is also intended
to reduce traffic and encompasses the area of 1-95 eastward.
IVls. IVliskel did not think that living next to the wastewater treatment plant would be a
deterrent and that residents of Hunters Run go by this treatment plant regularly. She
did not think the project was spot zoning. Even though PID is an alternative, the owner
of the property does not wish to rezone his property to a P]:D. Iris. Miskel read from a
report published in £/7c-o/-e Z/~t~z'/~at/o/7,~/, an organization of real estate firms that
provides reports on sales. The article stated that "the sub-market that continues to
have the most trouble absorbing its new space is Boynton Beach...and partially a victim
of the economy and its negative results on the real estate market." The vacancy
increased in Boynton Beach from 3.6% to 11.6%, which is more than double the 5.8%
vacancy rate in West Palm Beach.
Ms. Miskel responded to the Eastward-Ho concept and stated this was designed to push
development back to where infrastructure is in place. She felt that the infrastructure
was in place and could meet the needs of the development. Ms. Miskel requested
approval of the project.
Vice Mayor Weiland was surprised by Mr. Suss' comments regarding approval of the
apartments because for the last year and one-half, Mr. Suss has been advocating "no
more apartments. The City needs a moratorium on apartments."
Vice Mayor Weiland was concerned that the density of the development would be twice
as much as Hunters Run, and he did not understand why that community would be
amenable to such a high density across the street. Vice Mayor Weiland also thought
that the apartments would have a negative affect on the prices of their homes. He

pointed out that the study was really not a complete study of South Congress Avenue,
but in fact was limited to the south end of South Congress Avenue. He would like to
see some of the changes anticipated for the Federal Highway Corridor be incorporated
into this area as well. Vice Mayor Weiland didn't think the City would suffer financially,
if the property was not developed right away. He was not in favor of the project.
Commissioner McCray noted that although Hunters Run is not in his District, he
represents all the citizens of Boynton Beach. He was present at the Planning and
Development Board meeting and heard what the residents wanted. Tf all these
residents of Hunters Run came out to support the project, he feels it would be a benefit
to the area.

Mr. Bressner reported that this is the continuation process for the Fire Assessment for
Boynton Beach. The City Commission authorized the imposition of a Fire Assessment
Program last year for a seven-year period. 2002-2003 is the second year of the
Program, which will be reviewed by the Commission each year. The Commission will
determine the rate of the assessment based on the type of the property served by Fire
Services.
There are two resol-utions for consideration. The first is a tiered-rate system for non-
residential properties and a per unit rate for residential property, which is the same as
last year. All proposed rates are lower except for single family, which would remain at
$70. The second rate system being proposed is a square footage charge for non-
residential properties and a per unit rate for residential properties. This year the
County, as opposed to the City, will perform the billing. The City Commission is being

requested to approve one of the rate systems. Once approved, it would become the
tentative rate and property owners will receive notice in late August from the County
showing them what their tentative rate would be.
A Public Hearing for the final rate will be conducted on September 12, 2002 and once
the rate is determined, the County would be notified so that the rate could be included
in the County tax bills that are sent out to property owners.
Mr. Herb Suss requested that the Commission support the Fire Assessment Program
and felt there was a need for four fire stations in the City to better serve all citizens.
Commissioner Fisher was not in favor of the square footage system because many
businesses would pay more. Mr. Bressner responded that staff is recommending that
the City remain with the tier system. Commissioner Fisher noted that since the rates do
not have to be set until September, he would like to see the rates reduced.
Commissioner McCray said he was in favor of the tier system and reminded the
Commission that litigation is still pending.
Commissioner Ferguson also would like to keep the tier system, but he has a significant
problem with the amount of the assessment and would like to see it cut in half. He
would like reconsideration given to relocating the fire station to the northeast quadrant
of the City.

In response to our conversation regarding the referenced intersection, the Traffic
Division conducted a field review and an accident study. Our study revealed that
there has been no accident pattern attributable to U-turn movements from
02/01/1999 through 01/31/2002. It was observed there was no apparent sight
distance Obstruction from the west approach that wouldjusti~ changing the current
intersection operation.
Therefore, prohibition of the west bound U-turn movement at this intersection is not
recommended by the Traffic Division. Please be advised that the Trmhqc Division ,mill
continue monitoring the subject intersection, and take action as necessary to enhance
traffic flow and safety.

1.0 INTRODUCTION
On January 2, 2002, the City Commission by Resolution R02-006 approved the "Notice
of Intent" (NOI) #2002-01, which initiated a planning study and placed additional
limitations on development activity within the study area during a 180-day study period.
The size of the "affected area" is approximately 186 acres in area. The boundaries of the
"affected area" as defined by the Notice of Intent #2002-01 are described as follows:
"The area bounded by the Lake Worth Drainage District (LWDD) L-28 Canal on the
north, the existing M-1 zoning district boundary on the east, the LWDD L-30 Canal to the
south, and the Congress Avenue right-of-way on the west (see Exhibit "A" - NOI
Affected Area) ".
Ordinance No. 00-53 required that the Chamber of Commerce be directly notified of any
Notice of Intent placed in effect within the City of Boynton Beach. The purpose of the
Notice of Intent was to declare, in anticipation of amendments to the Future Land Use
Map, Official Zoning Map and Land Development Regulations, a study period, which
identified existing uses and development characteristics of the property zoned for
industrial uses within the "affected area". The "affected area" is defined below within
Section 2.0 PROJECT DESCRIPTION. This study identifies the existing uses and
development characteristics of properties within and near the vicinity of the "affected
area". The report identifies three (3) remaining vacant parcels within the "affected area".
It also evaluates the existing zoning and site regulations applicable to the "affected area".
The South Congress Avenue (M-l) Study attempts to evaluate the best zoning and
regulations applicable to the developed and undeveloped properties within the '*affected
area".
2.0 PROJECT DESCRIPTION
For the purposes of this report, the South Congress Avenue (M-i) Study is hereby
referred to as the study. Caloosa Park and the South Technical Community High School
directly abut the "affected area". Since they are in such close proximity to the "affected
area" and have direct / indirect impacts on the "affected area", the study will include the
Palm Beach County and the Board of Public Instruction properties in its analysis.
Therefore, for the purposes of this study the "affected area" is referred to as the study
area (see Exhibit "A" - Map 1 Study Area).
The study area comprises 285.78 acres. Caloosa Park is over 58 acres and the Board of
Public Instruction property is over 40 acres. Caloosa Park is the largest property in the
study area. The smallest property in the study area is slightly less than 1,000 square feet.
The average property size is 4.68 acres.
3.0 EXISTING CONDITIONS
In the context of geographical boundaries, the perimeter of the study area is "well
defined" in that its overall shape closely resembles that of a rectangle. A majority of the
lots within the study area are square or rectangular in shape as well. There are few, if
any, curvilinear or irregularly-shaped parcels. Also, the entire subject area is physically
separated from the surrounding residential neighborhoods. As previously stated, the
LWDD L-28 Canal to the north and the LWDD L-30 Canal to the south bound the study
area. These two (2) canals separate the subject area from the abutting properties to the
north and south, respectively. Furthermore, the C.S.X. Railroad and Interstate 95 rights-
of-way further isolate the subject area from the residential properties to the east, and
Congress Avenue separates the study area from the :Hunter's Run residential development
to the west. All bordering rights-of-way are considered as barriers to the study area.
3.1 Current Regulations
It is important to recognize existing regulations that are applicable to the study area.
These regulations, which are already approved for the subject area greatly, influence the
type of use, site design, and intensity of existing and future development.
3.1.1 Industrial (I) Land Use Classification
According to the Comprehensive Plan, the Industrial (I) Land Use classification provides
the uses allowed in the M-1 zoning district and the PID zoning district. These allowed
uses are limited to, but do not necessarily include the following:
Industrial uses, research and development, wholesale and distribution, business and repair
facilities, warehousing and storage, transportation, communication, and utility facilities,
retail sale of home improvement goods, tools, machinery and the like; Adult
Entertainment Establishments, trade and industrial schools, major recreational facilities
such as racetracks, arenas, amusement parks, exposition halls, and the like; offices and
restaurants which are accessory to the above uses; temporary amusements, revival tents,
and the like, uses allowed in the Office Commercial, Local Retail Commercial, and
Public and Private Governmental / Institutional land use categories, if approved as such
in a planned industrial development; provided, however, that all of the above mentioned
zoning districts are shown on the Future Land Use Map within the Industrial land use
category.
3.1.2 Light Industrial (M-l) Zoning District
A list of allowable uses consistent with the Comprehensive Plan is indicated in tabular
format as an attachment (see Exhibit "B" - Table 1 Uses Allowed in the M-1 Zoning
District). The following chart indicates the building setbacks (front, sides, comer side and
rear) required in the M-1 zoning district. All measurements area expressed in terms of
feet.

Note: Where lots abut a residential area, the corresponding side and/or rear
setback shall be a minimum of thirty (30) feet.
3.2 Infrastructure
3.2.1 Public rights-of-way
The study area contains several .[~ublic roads. The roadways are identified as follows:
Congress Avenue, Southwest 30~' Avenue, Southwest 14th Place, Southwest 13th Place,
Southwest 35th Avenue, Thor Drive, and Neptune Drive.
The Lake Worth Drainage District administers the L-28 Canal to the north and the L-30
Canal to the south. These canals run in an east-west direction. In addition, an extension
of the L-30 Canal exists parallel to the C.S.X right-of-way and to Interstate 95. The
C.S.X. Railroad right-of-way is also located within the study area and runs in a north-
southwest direction. Any work conducted near or within any of the LWDD canal areas
requires review and approval from the District. This could require a property owner to
set aside private property for drainage purposes. The degree of land to be set aside for
the district would be determined upon the type and scope of proposed developmentI.
Nestled between the C.S.X. Railroad right-of-way (to the east) and the extension of the
LWDD Canal (to the west) is a portion of vacant industrially-zoned land. According to
the most recent tax map, this portion of the land is used as a 110-foot wide Florida Power
and Light easement.
3.2.2 Potable Water
The Biscayne Aquifer is the sole source of potable water in Palm Beach County.
According to the Boynton Beach Utilities Department, there are three (3) water
distribution mains and one reuse main which could service the three (3) vacant parcels.
An eight (8)-inch ductile iron pipe (DIP) water main is located 10 feet east of the east
right-of-way line of Congress Avenue. A 12-inch DIP water main is located 15 feet north
of the south right-of-way line of Summit Drive2. It is probable that the Utilities
Department would require the set aside for an easement as a prerequisite for the
development of the vacant parcels.
3.2.3 Sanitary Sewer
There are three (3) sanitary sewer facilities available within the study area. Two (2) of
which are public, namely Lift Station 610 and Lift Station 602. The third lift station is
located at Caloosa Park and is considered a private station). A 36-inch DIP sanitary force
main is located 10 feet west of the west right-of-way line of Congress Avenue.
3.2.4 Public / Private Utilities
According to the Sunshine State One Call Center, the following utilities have service in
the immediate area: (1) Adelphia Communications Corporation, (2) Florida Power &
Light, (3) MCI Telecommunications, (4) Bell South, (5) Palm Beach County Traffic
Operations, and (6) City of Boynton Beach Utility Department3
4.0 EXISTING LAND USES WITHIN (M-I) STUDY AREA
4.1 Developed Parcels
Within the study area, a number of projects may have been built on parcels that could
have been joined together via unity of title or other means of amalgamation. The data
reported in the attached charts / tables however, may not reflect current conditions and
may report each parcel as individual lots. This report will not identify each parcel in
great detail but rather will aim to provide a general overview of the entire area and to
expose its unique qualities. As previously mentioned, there are over 61 parcels in the
study area, including Caloosa Park, which is owned by Palm Beach County (see Exhibit
"B" - Table 2 Parcel Control Number by Acreage). In 2001, according to City records,
the total assessed value of all.61 properties in the study area was $71,249,372 with an
average of $1,168,022 per property.
The largest individual lot in size within the study area is Caloosa Park, which is over 58
acres in area. Palm Beach County Parks and Recreation Department maintains and
provides funding for Caloosa Park. Caloosa Park has a Recreational (R) land use
classification and is zoned Recreation (REC). The park is home to picnic pavilions with
snack bars / grilling facilities, an exercise path, a little league baseball field, softball
fields, football/soccer/rugby fields, basketball courts, tennis courts, and roller blade
hockey rinks. Over three (3) acres of the site is comprised of lake / water area. There is
consideration to expand Caloosa Park in the future by assembling it with approximately 5
acres of the 15-acres vacant parcel to the west; however, no official contact has been
made between Palm Beach County and the property owner (see Exhibit "C" - Letter from
Tim Granowitz to Eric Johnson). If the owner sold a portion of the property and the
acquisition was successful, it would reduce the vacant 15-acre industrial parcel to a 10-
acre lot.
In the northeast comer of the study area, the Board of Public Instruction has assembled
three (3) large lots, totaling over 40 acres of land. This property, with a Public & Private
Governmental / Institutional (PPGI) land use classification and Public Usage (PU) zoning
district represents the 2aa largest parcel in the study area. Built in 1976, the Adult
Vocational Training Center originally operated as an educational center for veterans of
the Vietnam War. In 1998, the Center was converted into a fully operating public high
school (South Technical Community High School), which is home to 800 children,
grades 9 through 12. Currently, during non-school hours, South Technical Community
High School offers continuing education programs and English Speakers of Other
Language (ESOL) classes. Mr. James Kidd, Director of the South Technical Education
Center anticipates that the enrollment in the fall of next years' traditional daytime classes
will be apprOximately 1200 children'*. Buses from the South Technical Community High
School are stored on-site at the South Area Transportation Compound, which shares the
southern portion of the Board of Public Instruction property. The Compound stores
between 170 to 200 buses each day for schools located in Boca Raton, Delray Beach, and
Boynton Beach.
The study area is also home to the Bellsouth Service Facility, Tire Kingdom, Sterling
Records Management, Guardian Storage, and the former distribution center for the
United Parcel Service (UPS).
4.2 Occupational Licenses
Staff has identified all the occupational licenses within the study area and conducted field
reconnaissance to verify the status of each business. For example, it was discovered that
some businesses were nonexistent, operating without licenses, or operating with expired
licenses. For easier record keeping, each business in the City is traditionally assigned a
number consistent with the federal government's Standard Industrial Classification
System (SIC). In the mid-1990's, the SIC was converted into the North American
Industrial Classification System (NAICS). City Staff in the Occupational License
Division subsequently assigned a classification category to each licensed business
operating in the study area consistent with the NAICS. It is important to realize that a
single business may possess more than one (1) or more occupational license. For the
purposes of this study, staff segregated each license into nine (9) different categories (see
Table 3 - North American Industrial Classification System). These nine (9) categories
best exemplify the industry type of each business that is currently licensed in the study
area. The itemized list of industries is as follows: Construction, Manufacturing,
Wholesale Trade, Retail Trade, Transportation & Warehousing, Personal & Professional
Services, School & Instruction, Auto Services, and Other (not mentioned). Each
industrial category used in this study is consistent with the categories and / or sub
categories of the NAICS.
According to current City records, 204 occupational licenses have been issued for
businesses currently operating in the study area (see Exhibit "B" - Table 3 2002
Occupational Licenses NAICS). A conclusion of the exercise is that the study area
contains a homogenous mixture of industries. The major sectors were Construction,
Manufacturing, Wholesale Trade, Transportation & Warehousing, and Personal &
Professional Services sectors, which accounted for over 88% of all the licenses issued.

The sector that possessed the most licenses was Manufacturing, with over 20% or 41
licenses. Following closely behind was Personal & Professional Services, which ranked
second :with 39 licenses or 19.1% of the total businesses. Both the Wholesale Trade
sector and the Construction sector each had 38 licenses or 18.6%. Excluding Auto
Services with 6.9% of the licenses, the number of remaining licenses in the other sectors
was insignificant.
Out of the 204 current licenses, 61 licenses or nearly 30% of them were issued for
businesses located along Congress Avenue. The number and types of businesses along
Congress Avenue shared both similar and differing characteristics with the entire study
area. A similar trend within the entire study area was that the most popular industrial
sectors included Construction, Manufacturing, Wholesale Trade, Transportation &
Warehousing, and Personal & Professional Services. Unlike the entire study area
however, a majority of the businesses along Congress Avenue are engaged in Wholesale
Trade activities (26.2%) rather than the Manufacturing sector. In fact, 42.1% of the
Wholesale Trade licenses were for businesses located along Congress Avenue. Unlike
the entire study area, which contained the most licenses in the Manufacturing sector, this
sector accounted for only 4.9% of the licehses along Congress Avenue. Interestingly,
over 66% of the licenses issued within the Retail Trade category were for businesses
located along Congress Avenue. HoWever, the number of businesses engaged in Retail
Trade in general was insignificant within the entire study area.
During field reconnaissance, it was revealed that there are approximately five (5)
businesses currently operating without occupational licenses. Their industry sector
classification is unknown at this time.
4.3 Vacant Parcels
There are a number of vacant industrially-zoned parcels along Congress Avenue in
Boynton Beach, Delray Beach and Boca Raton. In the study area however, there are
currently three (3) vacant parcels. Each vacant lot is identified by an asterisk in Table
(see Exhibit "B" - Table 2 Parcel Control Numbers by Acreage). Characteristics shared
between all three parcels is their frontage on Congress Avenue, their Industrial (I) land
use classification, and Light
Manufacturing (M-l) zoning district
designation.

A request for a land use amendment /
rezoning has recently been submitted to
the City for the first vacant parcel. This
property is not only the largest vacant
parcel but also is the third largest parcel
within the entire study area. The land
use amendment request is to change its
land use classification from Industrial (I)
to High Density Residential. This vacant parcel is located along the southern boundary
of the study area and is over 30 acres in size (see highlighted bold and italicized entries in
Exhibit "B" - Table 2 Parcel Control Numbers by Acreage). This property has an
assessed value of over $1,169,000. The lot also has almost 1,440 linear feet of frontage
on Congress Avenue. A lake occupies a large portion of the interior. During the
development review process, the parcel would be required to comply with drainage codes
and demonstrate its ability for legal positive ouffall. Evidence suggests that the subject
vacant property is a subdivided parcel of a larger tract and since the. on-site lake contains
an outfall, then a Master Drainage Permit may. exist. If it is found that no such Permit
exists, the subject property will have to execute an Environmental Resource Permit.
When developing the lot, a viable option would be for the lake to function both as a
retention area for the control of storm water as Well as a serving as a focal point (fountain
/ entrance element) for aesthetic purposes.
The second vacant parcel is over 15 acres in size. This property fronts on Congress
Avenue and is also located along Southwest 35th Avenue. It is immediately to the west of
Caloosa Park. As previously mentioned, Palm Beach County Parks & Recreation is
considering expanding Caloosa Park to the west (by purchasing a portion of this
property) but at this time, no plans for land acquisition have been formally approved or
finalized. This parcel has a total assessed value of $1,562,288.
The third vacant parcel, located near the northwest comer of the study area is comprised
of four (4) individual lots under multiple ownership. All lots are rectangular in shape and
have a total area of less than five (5) acres. The two (2) westernmost lots front on
Congress Avenue and the two (2) easternmost lots function as a drainage area. These two
(2) eastern lots form the northernmost extension of an active drainage easement (08-43-
46-05-00-000-7011). The largest lot of the four (4) is 2.70 acres and has an assessed
value of $409,563. Collectively, all four (4) lots have an assessed value of nearly
$550,000. Staff recently met with private developers interested in constructing office /
warehouses for this vacant property.
5.0 EXISTING USES OUTSIDE THE STUDY AREA
The study area lies within the Southwest Sector of the City as defined by the
Development Atlas of Boynton Beach, Floridas. This section of the study identifies and
describes some of the existing land uses in the immediate vicinity of the subject study
area (see Exhibit "A" - Map 2 Buffer 1000 feet). The vicinity of the study area can
generally be described as possessing commercial, residential, industrial, and civic land
uses.
5.1 North of the (M-1) Study Area
The northern boundary of the study area abuts the south right-of-way line of the Lake
Worth Drainage District (LWDD) L-28 Canal. Immediately north of the canal is a
residential development (Golfview Harbor). Golfview Harbor has a Low Density
Residential (LDR) land use classification and is zoned R1AA. Golfview Harbor Estates
is a 200-acre residential community that consists of various housing types (i.e.
townhouses, single-family homes, garden apartments). Northwest of the study area is the
site of the future 98-1 Boynton-Delray Elementary School. This new elementary school
is scheduled for an August 2002 opening. The new elementary school will accommodate
a 970-student capacity, within the 109,096 square feet of buildings. The school will be
located at 3015 South Congress Avenue and will serve students from both the Boynton
Beach and Delray Beach areas6.
5.2 South of the (M-l) Study Area
When analyzing and recommending
future policies for the study area, it is also
important to recognize the existing pattern
of development to the south and the City
of Delray Beach's respective officially
adopted policies. The City of Dekay
Beach's policies and regulations
inherently impact the study area because
of their close proximity with each other.

30 Canal. This canal separates the southern
boundary of the City of Boynton Beach from
the northern border of the City of Delray
Beach. Immediately south of the L-30 Canal
is the South County Regional Waste Water AviewoftheRegionallKasteIKaterTreatrnentFaeility.
Treatment Facility. According to the City of
Delray Beach Comprehensive Plan, this property has a Community Facility-Public
Building (CF-P) land use classification and is zoned CF (Community Facility).
Excluding this CF-P land use classification of the South County Regional Waste Water
Treatment Facility, the vast majority of properties along the east side of Congress
Avenue, south of the study area in the City of Delary Beach have a CMR designation (see
Exh~it "A" - Delray Beach Future Land Use Map). This designation is applied to
properties that are developed or to be developed, in order to accommodate a mix of
industrial, service, and commercial uses. According to the City of Delray Beach's
Comprehensive Plan, this may be accomplished in the development of existing parcels
through a '~planned concept", similar to the City of Boynton Beach's planned zoning
districts (Planned Industrial Development and Planned Commercial Development). This
philosophy and pattern of development for the properties along Congress Avenue in
Delray Beach are both consistent and compatible with the City of Boynton Beach's
current Land Development Regulations and Comprehensive Plan regarding the study
area.
5.3 East of the (M-l) Study Area
East of the study area is the west right-of-way of the C.S.X. Railroad. East of the C.S.X.
Railroad is the Interstate 95 right-of-way. These two transportation routes separate the
study area from the Southeast Sector of the City of Boynton Beach.
5.4 West of the (M-l) Study Area
The western boundary of the study area abuts the east right-of-way line of Congress
Avenue. West of Congress Avenue are developed residential land uses (Hunter's Run
PUD). The Hunter's Run development has a Low Density Residential (LDR) land use
classification and PUD zoning district. Nestled within the Hunter's Run PUD, is newer
residential development known as the Isles at Hunters Run. This project also has a Low
Density Residential (LDR) land use classification and is zoned PUD. The Hunter's Run
PUD is a 470+/- acre master planned residential community with an overall density of 5.4
dwelling units per acre. Home prices reach as high as $500,0007.
North of Hunter's Run and northwest of the study area is developed recreational facilities
(Boynton Beach Community Center) with a Recreational (R) land use classification and
Recreation (REC) zoning district. North of the Community Center is vacant commercial
property and immediately north of that is developed commercial property (Manor Care).
The Manor Care property has a Local Retail Commercial (LRC) land use classification
and is zoned Community Commercial (C-3). This 180-bed facility provides skilled
nursing, subacute short term care, and respite stays. The facility's subacute unit called
MedBridge, provides 24-hour complex medical care that targets those who are recovering
from illness, injury or surgery8
5.5 Other Developments
Collectively, the City of Boynton Beach contains an array of industrially-zoned property.
Quantum Park at Boynton Beach is a Planned Industrial District located approximately
one-quarter (1/4) of a mile east of Congress Avenue in the Northwest Sector of the City
of Boynton Beach. Quantum, which broke ground in 1985, occupies approximately 550
gross arcres.
As previously mentioned within Section 3.0 EXISTING CONDmONS, the Industrial (I)
land use classification allows for the Planned Industrial District (PID) zoning district as
well as the Light Manufacturing (M-I) zoning district. The Motorola property is zoned
Planned Industrial District (PID). The Motorola Development of Regional Impact (DRI)
is located just south of Gateway Boulevard on the east side of Congress Avenue.
However, excluding the Motorola complex the study area represents the northernmost
component of a 19-mile linear stretch of industrially-zoned property (with isolated points
of interruption) situated along the east side of Congress Avenue that reaches as far south
as Yamato Road in Boca Raton (Congress Avenue terminates at its southernmost point at
Yamato Road).
The current businesses and land uses found within the study area are very similar to those
types of activities currently in operation along Congress Avenue from the LWDD L-28
Canal, to south of Yamato Road in Boca Raton. This pattern of development is
characterized by a majority of operations engaged in industrial / commercial types of uses
(office/warehouses) on the east side of Congress Avenue and commercial / residential
uses on the west side of Congress Avenue.
6.0 ANALYSIS
In general, one of the traditional principles of urban planning includes land use planning
and specifically the separation of incompatible land uses. Through the City of Boynton
Beach's police powers, zoning codes have been enacted as the legal toot to regulate land
development so that compatible land uses are achieved. Likewise, an objective of the
City's Land Development RegulatiOns is to separate and/or buffer incompatible land
uses, such as residential uses from heavy commercial or industrial uses.
6.1 Industrial Land Use Policy (Comprehensive Plan)
A number of City policies and regulations have been promulgated to encourage more
industrial property and businesses to support the local economy. For example, the City of
Boynton Beach Comprehensive Plan Policy 1.19.2 (June 2000) states the following:
"The City shall provide continued effort to allow for industrial acreage which can accommodate
the approximate industrial employment which has been projected in the Future Land Use Element,
and prohibit conversion of land designated "Industrial" on the currently adopted Future Land Use
Map unless such conversion would generate a range of employment choices for current and future
residents, provide goods and services of regional importance, and retain regional fiscal and
economic significance".
The Industrial land use classification allows for both the PID zoning district as well as the
M-1 zoning district (see Exhibit "B" - Table 4 Land Use Designation and Zoning
District). This policy has a profound impact on future development on the vacant parcels
proposed within the study area. As previously mentioned, the vast mai ority of properties
located within the study area have an Industrial (I) land use designation pursuant to the
City's Comprehensive Plan. Unless substantial justification exists that support land
conversion at this location, staff would not support a request for land use amendment or
rezoning found to be contrary to this Comprehensive Plan policy. In support of master
planning of industrial lands, the Comprehensive Plan Policy 1.19.4 states the following:
"The City shall continue to encourage and enforce the development of industrial land as industrial
parks or concentrated industrial areas in order to maximize the linkage between complementary
industries".
Likewise, this policy also has important implications on the study area because of its
inherent promotion of industrial development in the City. The City of Boynton Beach
Land Development Regulations allow for all contiguous land (25 acres or more) with an
Industrial (I) Land Use Designation to be eligible for consideration as a Planned
Industrial District (PID). At present, the City's Comprehensive Plan Policy 1.15.3
mandates that,
"For commercial / industrial projects over 10 acres, not more than 50% of the net acreage shall be
devoted to commercial uses. For commercial / industrial projects of less than 10 acres, there shall
be no limitations concerning the mix of commercial and industrial uses. Any commercial /
industrial projects with an area of 20 or more acres shall require approval as a Planned Industrial
District".
The intent of the PID is to provide a zoning classification for light industrial development
that will better satisfy current demands for light industrial (M-l) zoned lands by
encouraging development which will reflect changes in the technology of land
development and relate the development of land to the specific site and to conserve
natural amenities. Because of its current size, this policy has a direct impact on only the
30-acre vacant parcel adjacent to the Hunter's Run Planned Unit Development. Provided
the request complies with all code requirements, this parcel could conceivably be rezoned
to PID without amending the Future Land Use Element of the Comprehensive Plan.
Current policy mandates that if a property owner requested to subdivide the property so
that the property size would be under the minimum land area required to rezone to PID,
thereby circumventing the rezoning process, then that property must be platted, thereby
complying with Chapter 5 of the Land Development Regulations.
6.2 Zoning and Planned Industrial District (PID)
Land Use classifications and zoning codes can be amended to keep pace with changing
market demands and evolution of commerce. As a general mle, heavier industrial uses
are more accepted in the M-1 zoning district than in the PID zoning district. To keep
pace with an evolving industry, the PID zoning district will allow more flexibility in
terms of light industrial / commercial type uses than the M-1 zoning district. These
scenarios are achieved through the master plan review and use approval processes. The
following table is a comparison of required building setbacks between the M-1 zoning
district and the PID zoning district:

district are conventional in that they requite bUilding setbacks; however, the PID zoning
district requires a periphery buffer requirement of 25 feet in width (40 feet if it abuts a
residentially zoned district). Both zoning districts have a 60% threshold on maximum lot
coverage.
6.3 Residential versus Industrial
According to most recent citywide estimates, there are approximately 37 vacant
industrially-zoned parcels for a total of 192 acres. Out of 37 total parcels, 13 or 35% of
them are over two (2) acres in area. Of the total vacant industrial property remaining in
the City, 52.5 acres or 27.6% is located within the study area. About 69% of the total
industrial space in the city is in warehousing storage and distribution, generally
recognized as a strong niche of the Palm Beach County (and South Florida, generally)
industrial markets. The current high vacancy rate for the Boynton Beach market is the
combined effect of the state of the economy and high level of new construction occurring
over the past few years. Unless difficulties with market absorption persist, in which case
the issue can be revisited; those vacancy rates do not imply the oversupply of industrial
land. Conversely, over the past few years, the city's leadership and many citizens have
expressed concern about oversupply of multi-family apartment housing in Boynton
Beach. Indeed, the rate with which new rental units keep coming to the market has been
exceptionally high. The recently built residential rental projects combined with those
currently under construction will account for a total of 2,370 units or 2,599 units if the
Marina project is included (see Exhibit "B" - Table 5 New Rental Housing
Developments). In addition, according to the Comprehensive Plan, there still remains
seven (7) vacant residentially-zoned properties. If each property were built-out pursuant
to its respective maximum allowable density, there would be an additional 1,758 dwelling
units (see Exhibit "B" - Table 6 Build-out Residentially Zoned Property March 2002).
This estimate, coupled with all new apartment projects totals an additional 4,357 dwelling
units.
The residential growth within the city creates high demand for new and better services.
Land use decisions have fiscal impacts. Nationally, studies have shown that except for
high-density multi-family developments, residential uses generally have a net negative
fiscal impact on municipal budgets, even though the property tax per acre may be higher
for residential uses thart commercial uses. This means that the revenues generated by
residential uses tend to be lower than the incurred expenditures in terms of municipal
services9. In general, staff has the position that future apartment units should be steered
toward a downtown concentration with the provisions for higher densities and
redevelopment efforts. Staff supports additional multifamily units in the Federal
Highway Corridor Redevelopment Area, in and near the Central Business District, where
high residential densities will promote revitalization of the downtown and encourage
increased opportunities for use of transportation alternatives to the automobile.
Finally, the conversion of the industrial use to the residential use will eliminate
employment opportunities associated with industrial uses. The employment generation

rate by industrial uses vary from approximately eight (8) employees to 24 employees per
acre.
6.4 Aesthetics
Unlike newer industrial development elsewhere in the City, the study area contains a mix
of buildings / signage that do not share similar or compatible design characteristics. This
is due to a variety of reasons, including but not limited to a lack of codified design
standards for the M-1 zoning district in the Land Development Regulations. An
inconsistent building design theme has occurred in the study area because achieving
higher design standards was not a priority when these older projects were reviewed and
received approval. As previously mentioned, a common characteristic shared by the
three (3) currently vacant parcels is that they all possess frontage on Congress Avenue.
Recommending the creation and adoption of special rules / regulations regarding
aesthetics for those industrially-zoned properties fronting on major arterials is endorsed
by the City's: Comprehensive Plan. The Comprehensive Plan specifically addresses this
matter with the following passage:
"This is a highly visible corridor which l~es across the street from a low-density residential
development; therefore, approval of site plans along this frontage should include strong
consideration of aesthetics. In particular, garage doors and loading areas should not be permitted
to face Congress Avenue. Since the City's zoning regulations allow certain retail uses and
services related to home improvement (hardware, furniture, tile and carpet stores, for example), it
is expected that a large portion of this frontage will develop for these types of uses. In order to
enhance this area as a home improvement and design district, the City's zoning regulations should
be examined to determine whether other similar retail goods and services should be permitted on
industrial parcels which front on thoroughfares. Promoting home improvement and design uses
along this frontage would provide a low-intensity commercial use which would avoid the aesthetic
problems which often accompany both industrial uses and conventional strip commercial
development".

higher scrutiny and therefore, should adhere to stricter design guidelines than for those
properties that do not front on the major thoroughfares. The City recognizes Congress
Avenue as a major entrance into the City. The City has addressed this concern by adding

language in the Land Development Regulations pertaining to aesthetic concerns along
major arterials. For example, pursuant to Chapter 9 of the City's Land Development
Regulations, due to the "high degree of visibility" of Congress Avenue (and other roads),
no overhead doors shall face the right-of-way and all industrial buildings shall be
designed in such a manner so as to disguise their typical warehouse appearance. This
design criterion has an impact on the type and appearance of new development in the
area. New language is recommended to further enhance faqade appearances and signage
along Congress Avenue. For example, the Comprehensive Plan Objective 1.21 states
that,
"The City shall adopt the land development regulations to prevent signs which are hazardous or
aesthetically obtrusive".
Directly west of Congress Avenue, opposite the study area are residential homes of the
Hunter's Run PUD. The setbacks of the PID zoning district are designed to require
increased distances between a building and the front property line (in this case, along
Congress Avenue). For example, if a building were to be constructed along Congress
Avenue in accordance with the M-1 zoning district standards, then said building would be
required to be at least 15 feet from the front property line. If that same building were to
be constructed along Congress Avenue in accordance with the PID zoning district
standards, then said building would be required to be setback at least 30 feet from the
front property line (double the distance requirement for the M-1 zoning district).
Furthermore, the PID zoning district requires a periphery greenbelt 25 feet in width. No
buildings or vehicular use areas such as parking lots or loading zones (excluding
accessways for traffic and freight) could be placed in this landscaped area. Furthermore,
an important factor to consider is that contemporary site designers feel it is necessary to
have buildings and more importantly, parking areas to be as visible from the roadways as
possible; so therefore, as a consequence, a majority of the new development proposals
often have the parking areas in front of the respective building. Pertaining to all zoning
districts, if a vehicular use area, such as a parking lot directly abuts a right-of-way, then a
landscape buffer seven (7) feet in width is required. In the M-1 zoning district, the
parking areas could be as close as seven (7) feet to the Congress Avenue right-of-way. In
the PID zoning district model however, the parking area would have to be at least 25 feet
away from Congress Avenue in order to make allowance for the required PID perimeter
buffer.
7.0 CONCLUSION
The study area is a well-defined area with real boundaries. Its concentration of similar
uses provides opportunities that could maximize linkages between complementary
industries. The industrial uses are consolidated and should remain intact without
interruption. As a result of this analysis, staff is making five (5) recommendations that
will attempt to retain and curtail the conversion of industrially-zoned property to
dissimilar land uses. In general, residential land uses are considered to be incompatible
with industrial land uses and should not be mixed together.
In addition, the recommendations aim to satisfy the expectations of all stakeholders of the
project by instituting changes that will keep up with market demands while promoting
better design standards for the subject area. For example, this can occur by the
development of the vacant properties as planned industrial developments such as the PID
zoning district. This will result in increased control of future uses in the study area.
Rather than allowing all permitted uses on the largest parcels in the study area (which
tend to be heavier industrial uses), the process of Use Approval in the PID zoning district
could be applied in the study area. Properties with a PID zoning district classification in
the study area would have the same Use Approval process as other Planned Industrial
Developments, such as in Quantum Park. In the study area, a developer would request a
Use Approval subject to review by the Planning & Development Board and by City

public notices as part of the rezonmg process. A list of approved uses can be approved
by the Planning and Development Board for each PID master plan and then ratified by
the City Commission. Acceptable uses for a PID include not only traditional light
manufacturing and warehouses but also ancillary uses such as office, retail, restaurants,
day care, hotels, and motels.
New design standards should be implemented for those industrially-zoned properties that
abut maior arterials. Although the Community Design Chapter 9 of the Land
Develop~nent Regulations addresses the exterior appearance of buildings to achieve
compatibility with each other, staff recommends that additional language consistent with
the Comprehensive Plan be added to the Land Development Regulations. The intent is to
eliminate the inconsistent design theme that has occurred over time. Facade treatments
and architectural enhancements should be emphasized for those structures that are also
visible from residential neighborhoods to ensure the preservation of property values for
adjacent uses. This would affect the two (2) vacant parcels adjacent to Hunter's Run
PUD. New and proposed industrial buildings that front on major arterials, such as the
smallest vacant parcel along Congress Avenue, should possess similar design standards
that are endorsed by the intent of this study and its endorsement of a consistent design
theme and Sign Programs. The PID zoning district may also provide for the unified
development of industrial and commercial projects. Site design flexibility is inherent in
the PID zoning district. For example, required parking may be calculated based on the
number of employees rather than square footage of the development. The PID zoning
district also requires additional space to be set aside for the perimeter buffer, more so
than the M-1 zoning district. Through attrition, these appropriate design standards will
eventually eliminate inconsistent or incompatible signage and phase in preferred designs.
Many projects in planned developments in the City have incorporated Sign Programs that
are designed to enhance the overall appearance of all signage within that development.
The purpose and intent of sign programs as specified by the Land Development
Regulations is to encourage continuity for signage in the PID, while allowing for
flexibility with respect to type, color, number, location, and design of signs. Presently,
the sign program could be applied to those parcels that are at least 15 acres in size and
eligible for rezoning to PID. 'All new development and its respective signage would be
reviewed for consistency between each other and the sign program.

Changes to zoning regulations and the Comprehensive Plan will ensure that future
development occurring along the Congress Avenue corridor will include
architectural/appearance enhancements and uses that would not be detrimental to adjacent
residential properties. Amendments to Land Development Regulations would be
processed within approximately four (4) months, and the amendments to the
Comprehensive Plan would take approximately eight (8) months to ten (10) months to
process. The five (5) recommendations are outlined, in Section 8.0
RECOMMENDATIONS.
8.0 RECOMMENDATIONS
#1. Retain Industrial Land
Only Industrial, Recreational, or Public & Private Governmental / Institutional
land use classifications are currently present within and appropriate for this area.
At present, abundant vacant residential land still remains in the City. This
includes the 90.86 acre conversion of industrial land to mixed use (maximum
1000 units) in the Quantum Industrial Park. Therefore, staff is in the opinion that
sound land use planning policies suggest that no additional industrial land should
be converted to residential uses until all the residential properties are developed,
unless justifying circumstances out weigh the value of industrial land and land use
compatibility is maintained.
Consistency between Comprehensive Plan and Land Development
Regulations (parcel size)
Strengthen and clarify the language in the Comprehensive Plan regarding the PID
zoning district and its relationship with the industrial land use classification.
Presently, the City's Comprehensive Plan Policy 1.15.3 mandates that any
commercial / industrial projects with an area of 20 acres or more shall require
approval as a PID. Staff recommends that the minimum size requirement be
reduced to 15 acres. The text amendment to Comprehensive Plan Policy 1.15.3
would read as follows:
Any commercial / industrial projects with an area of gO 15 or more acres shall require approval as
a Planned Industrial District.
According to Chapter 2, Section 7.C. of the Land Development Regulations, the
minimum land area necessary for a planned industrial development is 25
contiguous acres. Modifying the Land Development Regulations so that the
language in the Regulations is consistent with the Comprehensive Plan will
rectify this discrepancy between the two. The code (text) amendment to Chapter
2, Section 7.C. of the Land Development Regulations would read as follows:
C. MINIMUM LAND AREA FOR PID. The minimum land area for a planned industrial

If the above-referenced text amendments were applied, it would affect the two (2)
largest vacant parcels by requiring them to be rezoned and developed as PID's.
#3. Require Planned Industrial District (PID)
Requiring all eligible properties to be rezoned to the PID zoning district
designation. The PID zoning district allows more flexibility in terms of the
permitted principle and accessory uses. A planned zoning district requires a
master plan, thereby, preventing the City from initiating the recommended
rezonings. Instead, staff recommends that the Comprehensive Plan policies be
endorsed that recommend / require the use of planned industrial developments or
particularly, the PID zoning district.
#4. Design Standards
New design standards should be implemented for those properties within M-1
zoning district / PID zoning district that abut major arterials. Chapter 21, Article
IV, Section 8.B. of the Land Development Regulations should include the study
area to be as being eligible for sign programs. The code (text) should be amended
to read as follows:
8. Those industrially-zoned properties on the east side of Congress Avenue from the Lake Worth
Drainage District (LWDD) L-28 Canal south to the LWDD L-30 Canal.
Additionally, all proposed auto intensive uses that directly abut major arterials
(such as Congress Avenue) should be well buffered so that they are not visible
from residential areas. A viable option for additional buffering in the study area
can include increasing the size of the landscape buffer strip width adjacent to
rights-of-way (more than the standard seven (7) foot wide landscape strip).
#5. Extend Time for Notice of Intent
Extend the Notice of Intent for at least eight (8) months to continue the limitations
on development within the study area during implementation of the study
recommendations. In addition, staff further recommends that the NOI be
amended to also allow the vacant properties to be developed if rezoned and
developed as a PID where consistent with applicable city regulations. This would
allow the immediate implementation of recommendation #3.

of the park (shown in Attachment) in order to develop additional football/soccer
fields, parking and a restroom. This property as a whole is noted in your letter as
"Exhibit 3: PCN 08-43-46-05-00-000-3030" and located in the "South Congress
Avenue Industrial Corridor" which is slated for eventual development.
While no contact has been established to date between the Parks and Recreation
Department and the landowner, it is anticipated that the owner will be contacted in
the future.
