City Manager Bressner began the agenda review at 4 p.m.
V.A. 1. Boynton Beach Senior Little League team South Regional Champions,
currently participating in the Senior League World Series in Bangor, Maine
This announcement will be removed from the agenda and added to the September 3rd agenda
at which time a presentation will be made.
VI.A. & VI.B. Bethesda Memorial Hospital Physician Parking (LUAR 02-004)
V].C. Bethesda Hospital Rezoning (REZN 02-004)
There was discussion regarding how these cases would be handled. Items A, B, and C may
have to be heard separately. Vice Mayor Weiland said he would like to make a brief statement
at the Commission meeting before either side makes their presentation.
V~.E. The Residences at Marina Village (REZN 02-005)
It was noted that there were CRA conditions of approval; however, the applicant has agreed to
them.
VI.F. Caf~ La Notte (COUS 02-002)
Since there is a pending zoning matter on the same property, the review of this item may
become a moot issue. Therefore, it was noted that the Commission has the option of granting
an extension of the test period for this property.
When asked, Assistant Police Chief Matt Immler stated that there have been no violations at
Caf~ La Notte reported to the Police Department.
VII. B.2. Award the bid for "THE CONSTRUC1/ON OF INTRACOASTAL PARK," Bid
#048-2413-02/C.1D, to MCTEAGUE CONSTRUCt/ON COMPANY, INC. of Stuart,
Florida, in the amount of $1,943,440
City Manager Bressner explained that the apparent Iow bidder has questioned staff's
justification for not awarding the bid to them. They sent a letter to the City and would like an
opportunity to address the concerns raised in staff's report. The Commission may wish to table
this matter for two weeks to allow the contractor time to offer some information.

V:[T.C.3. Proposed Resolution Re: Authorizing an agreement with
Community Banner Services (CBS) to provide a minimum of 25 free banners,
designed and customized at the City's discretion
City Manager Bressner requested that this item be removed from the agenda because he wants
the Legal Department to review the agreement between the City and Florida Power & Light
Company.
V]:]:.C.7. Proposed Resolution Re: Approving two economic incentive
agreements with Robert Kal= for the Shipwreck Restaurant and for Booker T's
Restaurant
Commissioner Ferguson will pull this item at the Commission meeting and will suggest a
timetable.
V:[I.C.9. Proposed Resolution Re: Approving full release of surety, and
refund of cash bond in the amount of $13,954.42, for the project known as Lowe's
Vice Mayor Weiland questioned whether the landscaping between Lowe's parking lot and the
canal was finished. It was stated that Kevin Hallahan would provide an update on August 20TM.
VI~.E.2. The Residences at Marina Village (MSPM 02-005), 743 NE 1~t Avenue -
Request for Major Site Plan Modification to Phase 2 of the Marina project to add 48
residential units and commercial space, expand the parking garage, increase project
height and make related site modifications on 3.79-acres
Commissioner Ferguson will pull this item from the consent agenda for discussion.
V:[T.E.3. Vermeer Southeast Sales (NWSP 02-013), :t060 W. Zndustrial Avenue -
Request for Site Plan approval for a :t4,000 square foot light industrial facility in a
M-:L zoning district on a 4.32-acre parcel
The applicant requested that this item be pulled for discussion regarding the conditions of
approval. Vice Mayor Weiland will pull the item at the Commission meeting.
V:[I.F. Authorize the purchase of 7 parcels of land (9 different lots) from 7 private
property owners in order to construct a series of retention ponds associated with
the N.E. 7th to 10th Avenue Stormwater :Improvement Project
Vice Mayor Weiland questioned what would happen if the City cannot purchase the remaining
parcels. Assistant City Manager Sugerman explained that the City could use eminent domain
proceedings to acquire the other parcels if the property owners are not willing to sell. The City
needs all 14 lots for the project. This item could be pulled for discussion to show the location
of the properties.

VIII.A. Motion to allow a brief presentation on the Palm Beach County
Ordinance, which prohibits landscape irrigation between the hours of 9:00 a.m. and
5:00 p.m. in an effort to promote water conservation. The presentation will be
made after the agenda item Legal. B. Ordinances-Second Reading - Rates and
Charges Ordinance 02-045
City Manager Bressner explained that Palm Beach County has requested that municipalities opt
into this ordinance to promote uniformity.
ZX.G. Proposed Resolution No. R02-016 regarding authorizing the use of eminent
domain to acquire the public right-of-way necessary to develop the Boynton Beach
Boulevard Promenade and Riverwalk- Tabled on 01/15/02 (TBA)
City Manager Bressner explained that the City is having negotiations with the CRA regarding
sharing responsibility for the acquisition of this property. Acquiring this property would provide
for completion of the Boynton Beach Promenade, provide a clear view of the Intracoastal, and
provide a connection point to the Mangrove Park. He said there would be a status report
regarding this on September 17th,
XI[.B.1. Proposed Ordinance Re: Adopting the
Administrative Amendments to the 2001 Florida Building Code
Boynton Beach
City Manager Bressner said that Florida has approved a State-wide Building Code and allows for
some local revisions for administrative rules and regulations.
X/I.B.2. Proposed Ordinance Re: Amending Chapter 16, Section 16-61
of the Code of Ordinances to clarify regulations regarding boat launching and trailer
parking user fee at Boat Club Park
Recreation Director Wally Majors explained that this ordinance will require that the decal be
placed on the passenger side of the trailer rather than on the vehicle. This ordinance also
provides for the replacement of a decal.
XZ~:[.A. Authorize staff to proceed with the demolition of the Old Mangrove
Park High School (125 E. Ocean Avenue) at a cost not to exceed $250,000
When asked whether there would be a presentation, Director of Development Quintus Greene
said he would know on August 20th. Vice Mayor Weiland would like the City to support this as
they have done with other projects.
Other- Miscellaneous
City Manager Bressner distributed follow-up comments from the last Commission meeting and
an article from U.S. News & Wor/d Report regarding the future of water. He also distributed a
letter addressed to the City Attorney concerning a deed restriction that Bethesda Hospital is
proposing for the property that is proposed for rezoning.

Other - Atlantic High School
Vice Mayor Weiland stated that since the location of Atlantic High School affects some residents
of Boynton Beach, he was concerned that the City has never been officially contacted by the
City of Delray Beach or involved regarding the high school. ~[t was pointed out that when the
new school is built, boundary issues would be brought forward and that would be the time to
get involved.
There being no further business to be discussed, the Agenda Preview meeting properly
adjourned at 4:40 p.m.
