Mayor Broening called the special meeting to order at 6:30 p.m.
Presentation of Proposed Resolution No. R02-155
City Attorney Cherof provided a brief explanation of the special Commission meeting and the
annual fire rate resolution.
The purpose of this special meeting of the City Commission is to complete the
formalities required for the City to levy and collect a non-ad valorem assessment to fund
fire protection services for the coming fiscal year.
The resolution being considered by the Commission at this special meeting, Resolution
R02-155, when adopted, will levy the annual fire assessment rates for property assessed
for fire protection services for the upcoming fiscal year 2002-2003 and will provide for
collection of those assessments.
The revenue collected by the fire assessment is allocated to and will only be used to
fund fire protection services and no portion of the revenue will be used to fund
emergency medical services.
· The Commission is not acting tonight to create the fire assessment program.
The fire assessment program was created last year by Ordinance 01-34, which was
adopted on July 11, 2001.
Section 2.08 of Ordinance 01-34 requires the Commission to adopt an annual rate in
order to levy the assessment. Resolution R02-155 accomplishes that requirement.
The preliminary fire assessment rates were adopted by the Commission on July 2, 2002
by Resolution R02-114. Those preliminary rates are the rates reflected in the TRIM
notices sent out by the property appraiser.

The Commission will now conduct a public hearing to hear comments and objections
before they vote on Resolution R02-155. Notice of the public hearing has been provided
in the TRTM notices and by publication.
The annual fire assessment rates set forth in the resolution, which the Commission will
now consider, are subject to amendment this evening; however, the Commission can
only amend to reduce the rates. The Commission cannot increase the rates over the
amounts that were set forth in the TRTM notice.
City Attorney Cherof read proposed Resolution No. R02-155 by title only.
IlL Staff Overview
City Manager Bressner explained that the proposed resolution sets the rate for multi-family
residential units at $42, down from the current rate of $58 and that the rate for single family
homes would remain at $70. Rates for commercial properties would be approximately 19%
lower than last year, industrial properties would be approximately 29% lower, and institutional
and nursing home properties would be approximately 21% lower. The projected revenue would
be $2.4 million.
Fire Chief Bill Bingham made some comparisons with 13 other cities that use this assessment.
The average assessment for multi-family units in other cities is over $95, while Boynton Beach
is proposing $42. Single-family rates average approximately $100 in other cities and our
proposed rate is $70. Chief Bingham explained that every one of the cities used some type of
tiered approach ( for rates other than res/dent/a/). Lauderdale Lakes and Coral Springs use 100
square foot tiers as opposed to various tiers Boynton Beach and other cities use.
Vice Mayor Weiland asked whether other cities put a cap on commercial rates in terms of
square footage. Chief Bingham replied that they do and some go beyond the 50,000 square
foot cap.
Commissioner Fisher asked whether other cities have the "sunset" clause similar to Boynton
Beach. Chief Bingham said that some have reduced their rates considerably since conception.
He does not know of any that have the "sunset" clause; however, he cannot say for certain that
they do not. Boynton Beach's ordinance last year set a date certain of seven years.
Mayor Broening asked whether the $2.4 million in revenue is to provide for debt service for
bonds. City Manager Bressner explained that the revenue is to be used for construction and
site work for stations #2 & #4 and includes the architectural and engineering services. It also
includes the initial staff for fire station #4 for fire suppression personnel only. We are
projecting $2.4 million in revenue but are projected to spend over $6 million because of prior
balances.
~V. Public Hearing
Dom Desiderio, 2755 S. Federal Highway, distributed an information packet to the
Commission, which is attached to the original minutes on file in the office of the City Clerk. He
said that the City must follow the law regarding the fire assessment and the law says that you

can only access real property and not EMS services. He did not think those figures could be
separated.
He said that last year every Commissioner except one said that we have to charge the people
who do not pay, which alluded to condominiums and multi-family units. Now the City is
proposing to reduce the rate for multi-families.
Mr. Desiderio pointed out that in Lauderdale Lakes, everyone pays the same amount per 100
square feet for commercial property and there is no discrimination. He does not oppose the fire
assessment; however, he did not think it was equitable the way it is figured in Boynton Beach
as he believed it gave big business a break. For instance, he said that the Boynton Beach Mall
pays .017 a square foot and Manor Care pays more at .21 a square foot while his business,
Atrium Place, pays almost .15 a square foot. He thinks the Commission is looking out for big
business and not the small ones and he is subsidizing big business.
Alice Otis~ 203 SW 13u* Street, said that last year she paid a greater rate than a warehouse
with comparable square footage and a warehouse could have flammable items inside. Now the
warehouse rate is going to get lower while her rate is the same. She does not understand why
all the rates are being lowered except for single-family. She feels that Boynton Beach should
put the fire assessment to a referendum. She does not think it is equitable.
Bob Foot, 760 E. Ocean Avenue, #507, said he has moved from a house to a condominium
at Coastal Towers. He believes that the risk of fire at Coastal Towers is as great or greater than
in a single-family home. He is glad that there will be a fire station east of the tracks and he
supports the fire assessment.
Brian Edwards, 629 NE gth Avenue, is in full support of continuing with the assessment.
As there was no one else who wished to speak, Mayor Broening closed the public hearing.
V. Commission Action - Approval of Annual Rate Resolution for Fire Assessment
Commissioner Fisher questioned why multi-family units were reduced by $16.
Jim Ness, Deputy Fire Chief, explained that some records received from Palm Beach County
were inaccurate. Some of the properties that were shown as single-family homes were actually
multi-units. Therefore, the number of multi-units increased and brought the cost per unit
down.
Vice Mayor Weiland's first concern was the lack of progress in the last year. The main reason
for the fire assessment was to provide a fourth fire station to reduce response time. Over the
last year, he has heard talk of locating property in the northeast section of town and west of
the tracks because of a high call rate to Village Royale on the Green. He suggested a larger
central station to accommodate both the north and south sections rather than two stations and
believes this idea deserves attention.
He does not believe the assessment is equitable across the board with multi-family and single
family. A fire in a third floor multi-unit facing the water would be more difficult to get to and
put out than a fire in a single-family house.

Vice Mayor We/land could not understand how the cost of the EMS and the fire suppression can
be separated. He wondered where the money was going to come from for the EMS.
He said that whenever the question was asked regarding why there is a cap for big business,
the answer has been to have an incentive. He said that he would not vote for this assessment.
Commissioner Ferguson's said that the original objective was to get a station in the southeast
quadrant, east of Federal Highway, in order to cut the response time down to four minutes.
The second part of the proposal was to then move station #! from City Hall to the northeast
section. His objective is to get the southeast fire station finished first. With the $5.1 million we
now have, he believes we could refurbish station #2, build station #4, and purchase a new fire
truck. This would take about a year; therefore, he does not believe there is a need for an
assessment this year.
Commissioner Fisher asked whether our priorities have changed regarding locations of the fire
stations.
City Manager Bressner said that the City ~s concentrating on the southeast quadrant to build
station #4 but is also looking at property in the northeast quadrant.
Vice Mayor We/land stated that staff had changed direction because at one time we were
looking at moving station #1 before building #4. Then, in the last few months, there was a
turn of direction where staff was concentrating more on the south end of town (bui/ding stat/on
Commissioner Fisher said it was his understanding that our priority a year ago was a station in
the southeast quadrant, refurbishing station #2 and then evaluating the time sequences before
moving station #1. Therefore, our priorities have not changed.
Chief Bingham said that that nothing has changed with our plan. Last year staff came to
Commission with data showing that in the far southeast and far northeast sections, we had
responses sometimes approaching 9, 10 and 1! minutes. Our goal was to begin with placing a
station in the southeast section while simultaneously looking for land in the northeast section
for a future station.
Chief Bingham explained that available land for stations is at a premium. We are cautiously
optimistic regarding one piece of land in the southeast section. After the new station is built,
we are planning to move the personnel from station #2 into that station so that station #2
could be renovated. After the southeast station is completed and station #2 is renovated, we
will look at the statistics in the northeast section of the City.
Vice Mayor Weiland asked to see copies of previous minutes where discussion on response
times of 9, l0 and 1! minutes took place. He only remembered 7-8 minutes being mentioned.
He suggested property next to the Texaco station on South Federal Highway as a possible fire
station site. It happens to be in a county pocket.
City Manager Bressner explained that this parcel is too far south in terms of response. The idea
is to have a station in the general area of Golf Road to provide adequate response time.

Chief Bingham said that there were certain criteria needed to maintain maximum efficiency.
They are not in favor of placing a station on the edge of the City because it would only cover
half of the area it should. They are looking for property that is in the proximity of SE 23rd
Avenue to allow access to the western part of the City. They also need to be close to
Woolbright Road so that they can access 1-95.
Commission Fisher was concerned that if we do not charge an assessment this year, next year
the citizens may need to pay more.
Mayor Broening felt that it was the Commission's job to adopt or not adopt a final rate
resolution for fire assessment for this year, The Commission must provide adequate public
safety, He resented hearing implications tonight that there was some collusion between big
business and members of this Commission. Mayor Broening congratulated this Commission and
staff for addressing a very tough issue, He believed that the methodology that was used met
the test, He asked for a motion to approve the rate as proposed by staff,
Commissioner Fisher moved to approve the rate as suggested by staff in proposed Resolution
No. R02-155. Commissioner McCray seconded the motion. City Clerk Prainito called the roll
and the motion passed 3-2 with Vice Mayor Weiland and Commissioner Ferguson dissenting.

The state's high court up-

meant to cover the govern-
ment's expense of providing
emergency medical services

In 2000, the 4th District
Court of Appeals ruled that
while cities could assess prop-
erty owners for fire protection,
they could not do so for EMS.
The distinction was that fire
protection has a direct effect on
property, but paramedics and
ambulances serve individuals,
not properties.

SERVICE SPECIAL ASSESSMENTS
Notice is hereby given that the Town Council will conduct a public headng to consider reimpos-
lng fire rescue special assessments for the provision of fire protection services and to impose
solid waste service speCial assessments for the collection of solid waste within the Town of
Southwest Ranches for the Fiscal Year beginning October 1, 2002. Fire rescue special
assessments are being imposed on all property town-wide while the solid waste service spe-
cial assessments are being imposed only on single-family residential properties town-wide.
The public hearing will be held at 7:00p.m. on September 13, 2002, at the South Broward
Drainage District meeting room, 6591 SW 160th Avenue, Southwest Ranches, Flodda, for the
purpose of receiving public comment on the proposed assessments. All affected property own-
em have a dght to appear at the h~adng and to file written objections with the Town Council
within twenty (20) days of this notice. If a person decides to appeal any decision made by the
Town Council with respect to any' matter considered at the headng, such pemon will need a
record of the proceedings and may need to ensure that a verbatim record is made, including
the testimony and evidence upon which the appeal is to be made. In accordance with the
Americans with Disabilities Act, persons needing a speCial accommodation or an interpreter to
participate in this proceeding should contact the Town Clerk's Office at (954) 434-0008 at least
seven (7) days prior to the date of the hearing.
The assessment for each parcel of properly will be based upon each pamel's classification
and the total number of billing units attributed to that parcel. The following tables reflect the
proposed fire rescue assessment schedule and proposed solid waste service assessment.
