Sec. 1. No cow, ox, bull, horse, mule, ass, hog,
sheep, goat, goose, duck or other live-stock shall be
allowed to run at large within the limits of the To~¥n.
Sec. 2. Any person owning, or having under his
possession or control any anima~mentioned in the pre-
ceding section, who s~all allow said animal to run at
large within the Tovn~, shall be fined not more than Fifty
Dollars ~
(.~80.00), or imprisoned not more than thirty days,
or shall be both fined and imprisoned.
Sec. U. It shall be the duty of the Narshal and all
other police officers of this Town, to take charge of all
such stock running at large within the Town, drive the
same to the public pound and ccnfine said stock therein.
If said stock is not released within five days, as ~.ere-
inafter provided in this Ordinance, it shall be the duty
of said officer to sell such stock at public outcry.
Notices stating the time and place of such sale and giving
a description of the stock shall be posted by the officer
in five conspicuous places in this Town, for five days
prior to said sale. The proceeds of said sale shall be
girst applied to paying the costs of impounding the stock
and selling the same, and any excess that may have been
received over the costs shall be returned to the' o~,naer or
person having had legal possess~.on at the time the same
was impounded. In case no such person can be found within
one year, such excess shall be converted into the Town
Treasury as an escheat.
Sec. 4. It shall be the duty of every officer taking
charge of stock as provided in the preceding section, to
serve a notice upon the owner or person having had legal
possession of said stock at the time the same was impounded,
if such owner or person can be ascertained, stating that
certain stock (fully describing same), has been found
r. unning at large within the limits of this Town; that said
stock has been impounded and is in the public pound of this
Town; that said stock will be released upon the payment of
the accrued costs; and that if Not released within five days
said stock will be sold as provided in this Ordinance.
Sec. 8. The owner or person having had possession
of said stock at the time the same was impounded, may at
any time prior to the sale thereof, demand a trial in the
Nayor's court with or without a jury, of the question of
fact whether said stock was running at large within the
Tov~n limits at the tim~ said stock was taken in charge by
the officer. The ~ayor shall have the same authority and
power concerning the trial of such causes as he has in
other causes. If the court shall determine that said
stock was running at large within the Town limits at the
time the same was taken in charge by the officer, then the
person demanding said trial shall pay all costs of said
trial. If the court shall not so determine, then the
costs shall be taxed against the Town.
Sec. 8. An officer taking a cow, ox, bull, horse,
mule or ass in charge shall be allowed Fifty Cents ($0~)
a day for keeping the same, and Twenty-five Cents (25~)
a day for keeping any other animal impounded under this
Ordinance.
The above Ordinance No. 19, having been read in full
at a ~'~ieeting of the To~ Commission of the To~ of Boynton,
Florida, held on the 6th day of December A. D. 1921, was
adopted and passed at a Regular Neeting of said Commission
held on the 20th day of December A. D. 19~l, and a copy
thereof posted at the front door of the Town Hall at
Boynton, Florida, on the ~lst day of December A. D. 19~1.
