Nuisances.
Sec. 1. No person, club, society, organization or
institution shall erect, ~eep, maintain or permit on his,
its or their property or on any property or in any place in
or under his, its or their possession or control, any nui-
sance of any kind, nature or description, which shall tend
to annoy the community or any portion thereof, or which
shall tend to injure the health or morals or peace of the
citizens of this Town. Any person or any member of any
club, society, organization or institution which shall vio-
late this Section shall be punished by a fine not exceeding
fifty dollars, or imprisoned not exceeding thirty days, or
shall be both fined and imprisoned.
Sec. 2. Any person aggrieved by the existence of a
nuisance as described in the preceding section, may file
a complaint, duly sworn to, with the Mayor, stating the
existence of such nuisance and its location, and if the
complainant shall know who is responsible for said nui-
sance, t~e name of such person shall be stated in the
complaint.
Sec. 3. Upon the filing of the complaint as pre-
scribed in the preceding section, the Mayor shall issue a
summons to the Marshal, commanding him to summon six
householde?s of the Town of Boynton, to meet at the plaice
'where said nuisance is said to exist, at a time to be
specified in the sun,nons. The Mayor shall also issue a
summons to the party said to be responsible for the nui-
sauce, commanding him to appear at the place where the
nuisance is alleged to exist, at the time the six house-
holders shall meet there.
Sec. 4. After viewing the premiees ~md hearing such
evidence as may be presented to them, the said six house-
holders shall render a verdict upon the question of Fact
whether the thing complained of constitutes a nuisance;
and if the jury shall determine that it does, the verdict
shall also state the name of the person responsible there-
for, if such person be kno~wn to the jury.
Sec. 5. Upon the rendition of a verdict declaring
the thing complained of to be a nuisance, the ~iayor shall
forthwith command the person responsible therefor to abate
said nuisance within twenty-four hours, and in case it is
not abated within the time specified, the ~ayor shall
command the said ~arshal to abate the 'said nuisance at
once. If the verdict does not state the name of the per-
son responsible for said nuisance, the ~arshal shall abate
said nuisance immediately upon the rendition of the verdict.
Sec. 8. Any person refusing or failing to abate a
nuisance as commanded by the Nayor, in accordance with
the provisions of this Ordinance, shall be punished as
prescribed in Section i of this Ordinance.
Sec. ~. It shall be the duty of the ~..~arshal to
compalin of all nuisances that may be brought to his
attention, and in case he shall fail to do so, he shall
be punished as prescribed in Section i of this Ordinance.
The above Ordinance No. 18 having been read in full
at a Meeting of the To~n Commission of the ?own of Boynton,
Florida, held on the 18th day of October A. D. 1921, was
adopted and passed at a Regular Meeting of said Commission
hled on the 1st day of November A. D. 1921, and a copy
thereof posted at the front door of the Town Hall at
Boynton, Florida, on the 2nd day of November A. D. 1921.
