O92-36ORDINANCE NO. 092- AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING THE TEXT OF THE SUPPORT DOCUMENTS OF THE FUTURE LAND USE ELEMENT OF THE COMPHEHA"NSIVE PLAN IN CONNECTION WITH APPLICATION NO. 16, PLANNING AREA 1.A; SAID TEXT AMENDMENT WILL ALLOW THE CONTINUATION OF THE SINGLE FAMILY (R-1AA) ZONING DESIGNATION; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AUTHORITY FOR CODIFICATION; AND PROVIDING AN EFFECTIVE DATE. of Boynton Beach,! WHEREAS, the City Commission of the City Florida has adopted a Comprehensive Plan and as part of said Pla~ a Future Land Use Element by Ordinance 89-38 in accordance wit~ the Local Government Comprehensive planning Act; and i Christopher Cutro, agent for the City of Bo!rnto~ W~EREAS, Beach, Florida has applied to amend a portion of the Suppo~ Documents of the Future Land Use Element entitled Land Us~ Problems and Opportunities, Planning Area No. 1, Area 1.a.; and I WHEREAS, the procedure for amendment of the Comp'rehensive Plan as set forth in Chapter 163, Florida Statutes, has beer followed; and WHEREAS, after public hearing and study, the City Commissio~ deems it in the best interest of the inhabitants cf said City tQ amend the text of the aforesaid Support DocUments of the Futur~ Land Use Element of the Comprehensive Plan as adopted by the Cit~ herein. NOW, T~EREFOI%E, BE IT ORDAINED BY Tku~ CITY CO~4ISSIOW OF 'r~ CITY OF BOYNTON BEACh, FLORIDA, THAT: Section 1: The portion of the Support DocUments cf the Future Land Use Element entitled Land: Use Problems and Opportunities, Planr~ng Area 1, Area 1.a. is here_by amended b~ deleting the words and figures in the strike-through type as Commercial land use category, if approved as a marina/boat storage use as a Planned Commercial Development. These parcels occupy one of the few sites in the City where marina/boat storage uses could be located with minimal impacts on surrounding uses, and without requiring the dredging of a new channel in Lake Worth. Development of these parcels should comply with the site design guidelines set forth in the Coastal Management Element. The vacant lots in Lakeside Gardens which lie along the north side of Dimmiek Road should be construed to be in the High Density Residential land use category, if approved for single-family attached housing or an adult congregate living facility, with a 2-story (25 foot) maximum height, in accordance with the site design guidelines set forth in the Coastal Management Element. ~he ~ema~e~ --e~ --~he --Sa~es~e --8a~e~s ~-pa~ee~s-~-~h~s-s~s~-~e~-wh~eh ~he---~e~---~e~a~e---a~---a~ea---a~e Section 2: That all ordinan~ ~r m~r~ m~ ~=~= Section 4: Authority is hereby granted to codify said ordinance.
