O92-34ORDINANCE NO. 092-3~ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, REGARDING APPLICATION NO. 20, PLANNING AREA 1.G (LOTS LYING BETWEEN BERNARD's (BENVENUTO'S) RESTAURANT AND VIA LAGO CONDOMINIUM, SOUTH OF LAKE STREET) AMENDING ORDINANCE 89-38 OF SAID CITY BY AMENDING THE LAND USE ELEMENT OF THE COMPREHENSIVE PLAN OF THE~ CITY BY ADOPTING THE PROPER LAND USE OF CERTAIN PROPERTY, MORE PARTICULARLY DESCRIBED HEREINAFTER; SAID LAND DESIGNATION IS BEING CHANGED FROM HIGH DENSITY RESIDENTIAL TO LOCAL RETAIL COMMERCIAL; PROVIDING A SAVINGS CLAUSE; PROVIDING REPEALING PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. WI{EREAS, the City Commission of the City of Boynton Beach,I Florida has adopted a Comprehensive Land Use Plan and as part of said Plan a Land Use Element by Ordinance No. 89-38 in aceordance with the Local Government Comprehensive Planning Act; and W~EREAS, the City Cormuission of the Florida adopted as part of said Plan a Documents of the Future Land Use Element City of Boynton Beach, portion of the Support entitled Section VIII Land Use Problems and Opportunities; and WHEREAS, the City Commission of the City cf Boynton Beach Florida elected not to amend the City's Official Zoning Ma pursuant to recommendations within said Section VIII. (Plannin~ Area 1, Area 1.G); and WHEREAS, Christopher Cutro, agent for the City of Boyntor Beach Florida, has heretofore requested the above mentioned Land Use Element Amendment; and W~V~S, the procedure for amendment of a Land Use Element of a Comprehensive Plan as set forth in Chapter 163, Florida Statutes, has been followed; and W~RREAS, after public hearing and study, the City Commissior deems it in the best interest of the inhabi~n~ ~ ~=~ ~.~ ~ That the Local Retail described Land Use of Commercial. Containing 1.66 acres, more or less, and subject to easements and rights-of-way record. Property Control $08-43-45-I5-03-000~0160 2: That any maps adopted in accordance with Element of said Comprehensive ~lan shall be amended accordingly. Section conflict herewith are hereby repealed. Section 4: Should any section or provision Ordinance or any portion thereof be declared by a competent jurisdiction to be invalid, such not affect the remainder of this Ordinance.
