THE C I TY OF BOYNTON BEACH, FLORIDA,
REGARDING APPLICATION NO. 3, PLANNING
AREA 4.H (LOTS ON S.E. 34TH AVENUE,
IMMEDIATELY WEST OF THE F.E.C. TRACKS)
AMENDING ORDINANCE 89-38 OF SAID CITY BY
AMENDING THE LAND USE ELEMENT OF THE
COMPREHENSIVE PLAN OF THE CITY BY
ADOPTING THE PROPER LAND USE OF CERTAIN
PROPERTY, MORE PARTICULARLY DESCRIBED
HEREINAFTER; SAID LAND DESIGNATION IS
BEING CHANGED FROM LOW DENSITY
RESIDENTIAL TO MEDIUM DENSITY
RESIDENTIAL; PROVIDING A SAVINGS CLAUSE;
PROVIDING REPEALING PROVISIONS; AND
PROVIDING AN EFFECTIVE DATE.
~REAS, the City Co~m~ission of the City of Boynton Beachs
Florida has adopted a Comprehensive Land Use Plan and as part
said Plan a Land Use Element by Ordinance No. 89-38 in accordance
with the Local Government Comprehensive Planning Act; and
~E~EREAS, the City Commission of the
Florida adopted as part of said Plan a

has heretofore requested the above mentioned Land
Use Element Amendment; and
WHEREAS, the procedure for amendment of a Land Use Element
of a Comprehensive Plan as set forth in Chapter 163, Florid~
Statutes, has been followed; and
~EiEREAS, after public hearing and study, the City Commissic
deems it in the best interest of the inhabitants of said City t¢
amended to reflect the following:
That the Land Use of the following described land shall
Medium Density Residential. Said land is more particularl~
described as follows:
West 64 feet of Lot 5, East 4 feet of
Lot 5 and West 59 feet of Lot 6, Lot 7,
Lot 8, Lot 9, Lot 10, Lot 11, Lot 12,
Lot 13, Lot 14, Lot 15, "Gulfstream
Estates, Plat 2, Replat, "according to
the Plat thereof, as recorded in Plat
Book 32, Page 114 of the Public Records
of Palm Beach County, Florida.
Containing 2.06 acres, more or less.
Section 2: That any maps adopted in accordance
with
the Land Use Element of said Comprehensive Plan shall be
amended accordingly.
Section 3: Ail ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 4: Should any section or provision of this
Ordinance or any portion thereof be declared by a court of
competent jurisdiction to be invalid, such decision shall
not affect the remainder of this Ordinance.
Section 5: This Ordinance shall become effective
immediately upon its final passage.
