WHEREAS, pursuant to the provisions of Chapter 13 of the Code o4
Ordinances of the City of Boynton Beach, Florida, pertaining to garbage,
trash and weeds, and the provisions of the City Charter of said City and the
General Laws of the State of Florida, a recent periodic survey of the City has
been conducted and a report submitted to the Mayor of the municipality des-
cribing a certain parcel of land located within the municipal limits of the City
whereon conditions constituting nuisances as defined in said laws exist; and
WHEREAS, supporting data regarding the existence of subject
nuisances has been submitted to the City Council at a regular meeting and
the Council has thoroughly considered said report and supporting data relative
thereto; and
WHEREAS, the City Council has found, as a fact, that a prima
facie case has been established showing the existence of nuisances, as define
in the above and foregoing Laws, on the parcels of land more particularly
described hereinafter,
NOW, THEREFORE be it resolved by the City Council of the
City of Boynton Beach, Florida, as follows:
1. That rluisances as defined in Chapter 13 of the Code of
Ordinances of the City of Boynton Beach, Florida, and the
Laws of the State of Florida, exist on the parcels of land
situated within the municipal limits of the City of Boynton
Beach, Florida, and more particular]ydescribed as follows:
Lots 53 and 54, DEWEY'S SUBDIVISION, a subdivision of
the City of Boynton Beach, Florida, according to the Plat
lhereof on file in the office of the Clerk of the Circuit Court
in and for Palm Beach County, Florida, recorded in Plat
Book 1, Page 37 public records of Palm Beach County, Florida.
Nature of nuisance: Excessive growth of weeds, trash and
garbage, and low land requiring fill and bulkheading, all O~odent
which presently constitutes breeding grounds for mosquitos,/harbc
and a detriment to the health, safety and welfare of the
inhabitants of the City of Boynton Beach, Florida.
2. That the City Clerk of the City of Boynton Beach, Florida,
is hereby directed, within five days from date hereof, to
forward written notice as prescribed by Chapter 13 of the
Code of Ordinances of the City of Boynton Beach, Florida,
to the last record owner of the parcels of land hereinabove
described.
