City Manager Bressner began the agenda review at 4:00 p.m. He announced that Maurice
Rosenstock, a regular member of the Planning & Development Board, had sent a resignation
letter. However, since it arrived after the agenda deadline, the opening for the Board would
not be considered until the first Commission meeting in .lanuary.

City Manager Bressner distributed an item that he requested be added under £ommun/ty and
Spec/a/Even~s. The item pertains to awards for the "Decorating with Lights" contest.

Mayor Broening questioned this proclamation and felt that it would be setting a precedent to
have a proclamation for someone's birthday.
City Manager Bressner thought that someone's 75t~ birthday was a milestone and recognizing it
adds to the community and family.
After discussion, it was the consensus of the Commission to leave this item on the agenda and
add language to the proclamation to include Ms. Tillman's community service.
VT. A. Amending the Motorola DRZ/Master Plan to allow retail, commercial,
and 500 residential units on 48.1 acres of the 87.4-acre site (Proposed Ordinance
No. 02-061)
Hike Rumpf, Planning & Zoning Director, explained that this was a public hearing for the
adoption of the DR:[. The City Commission would be asked to amend the original development
order for the DR:[ to change the uses. The current use is office/industrial and the change would
be to add residential and commercial uses. :[f it is approved, there would be a new
development order with conditions. The DR:[ is one large piece of property. Any specific
changes would be under a site plan request. Regarding the traffic issue, the City received a
letter from the Palm Beach County Traffic Division and is waiting for approval from the D.O.T.

Mr. Rumpf explained that there was no new schedule yet for this project. The item would be
returning to the Technical Review Board.
VTT. B.1. Award the bid for "PURCHASE OF ONE NEW AND UNUSED PORTABLE,
TRATLER MOUNTED, SELF-CONTAZNED VACUUM UNTr," Bid #078-2821-02/C3D, to
VACUUM SOURCE, ZNC. of Greer, South Carolina in the amount of $24,950 (Tab/edat

City Manager Bressner stated that this item should be removed from the table and removed
from the agenda at the Commission meeting since this item was being re-bid.
VTZ.G. Approve a donation from Federal .lustice Forfeiture funds in the amount of
$4,000 to Glades Central High School Criminal .lustice Academy
Police Chief Marshall Gage explained that there are a couple of high schools in the County that
have Criminal Justice Programs and they survive based on assistance from the local law
enforcement community. They assist in getting kids to go in the proper direction and are a
long-term investment. This is the first time in the last seven years that the City has contributed
to this particular program.
VTT.H. Approve a donation from monies received from Local Confiscated Funds to
the 3uvenile Transition Center, Tnc. of Boynton Beach, in the amount of $4,000
~[t was the consensus of the Commission that this item would be pulled from the consent
agenda for discussion and COmmissioner McKoy would recuse himself at the Commission
meeting.
X~T.B.4. Proposed Ordinance No. 02- Re: Amending Article
Pensions for Police Officers, Chapter 18 of the Boynton Beach Code of Ordinance;
allowing participants in the DROP to change their method for the crediting of
earnings
The title of the proposed ordinance will need to be changed from "crediting of earnings" to
"crediting of investment earnings."
VII. D. 1. Motion to pay court ordered judgment to ,lose Mass, 'plaintiff, in the
amount of $17,678.96
At the request of Vice Mayor Ferguson, language will be added to the title of this item to reflect
the amount of the original claim.

Commissioner McCray said that he was concerned regarding a situation at Congress Middle
School where citizens were picketing. He was not aware of what the problem was.
City Manager Bressner mentioned that there was an article in the newspapers regarding the
Boca Raton water situation and he requested that Bob Kenyon from the Utilities Department
speak to the Commission.
Bob Kenyon, Deputy Utilities Director, said that he did not know exactly what happened in Boca
Raton but they did have bacteria in their water. He explained that there are a couple of things
that our Utilities Department does to prevent this from happening. Disinfectants are changed
once or twice a year and Boynton Beach has water plants on both ends of the system. The City
tests samples and monitors them weekly. He stated that this situation could happen here but it
is unlikely. Boynton Beach has an aggressive program and testing is over and above what is
required.
Regarding the filter problem, Mr. Kenyon explained that the problem has not been identified or
solved. They are still working on it. However, it is a cost issue and not a quality of water issue.
Filters are usually changed four times a year and now it is every five days.
