O91-58ORDINANCE NO. O91-~8 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, REGARDING THE RAY FLOW PROPERTIES (SW CORNER OF OLD BOYNTON ROAD AND KNUTH ROAD) AMENDING ORDINANCE 80-19 OF SAID CITY BY REZONING A CERTAIN PARCEL OF LAND MORE PARTICULARLY DESCRIBED HEREIN, FROM COUNTY RM/SE (MULTIPLE-FAMILY RESIDENTIAL WITH A SPECIAL EXCEPTION FOR A DAY CARE CENTER) TO R-3 (MULTIPLE-FAMILY RESIDENTIAL); AMENDING THE REVISED ZONING MAP ACCORDINGLY; PROVIDING FOR A BUILDING HEIGHT LIMITATION OF TWO-STORIES; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, the City Commission of the City of Boynton Beach, [orida has adopted Ordinance No. 80-19, in which a Revised ;oning Map was adopted for said City; and WHEREAS, the City Commission of the City of Boynton Beach, 'lorida, is simultaneously herewith adopting an Ordinance ~nnexing a parcel of land more particularly described herein into Lhe City limits of said City; and WHEREAS, Ray F. Flow, the property owner, has heretofore Eiled a Petition with the City of Boynton Beach, Florida, to Section 9 of Appendix A-Zoning, of the Code of , City of Boynton Beach, Florida, for the purpose of 7ezoning a certain parcel of land consisting of approximately 66 acres located within the municipal limits of said City, said y being more particularly described hereinafter, from (Multiple Family Residential District with a Special ~xception for a day care center) to R-3 (Multiple Family .ial), which requests that the 2.66 acre parcel be removed ~rom the boundaries of the RM/SE to allow for the processing of ~he rezoning application; WHEREAS, the City Commission deems it in the best interests )f the inhabitants of said City to amend the aforesaid Revised ~oning Map as hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE ~ITY OF BOYNTON BEACH, FLORIDA, Section 1: The following lity of Boynton Beach, Florida, THAT: described to-wit: land, located in the Tract 53, less the South 260.00 feet thereof of the Subdivision of Section 19, Township 45 South, Range 43 East, According to the Plat thereof recorded in Plat Book 7, Page 19, Public Records of Palm Beach County, Florida. Containing 2.66 acres more or less. ~e and the same is hereby rezoned R-3 (Multiple-Family Residential). Section 2: That the aforesaid Revised Zoning Map of ~he City shall be amended accordingly. Section 3: Development of the property shall be limited to two-stories. Section 4: All ordinances or parts of ordinances in ~onflict herewith are hereby repealed. Section 5: Should any section or provision of this )rdinance or any portion thereof be declared by a court of :ompetent jurisdiction to be invalid, such decision shall lot affect the remainder of this Ordinance.
