AN ORDINANCE OF THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA
REZONING A CERTAIN PARCEL OF LAND WITHIN
THE CITY OF BOYNTON BEACH, FLORIDA FROM
R-2, (DUPLEX RESIDENTIAL), TO PU (PUBLIC
USAGE), LIMITED TO USE AS A DAY CARE
CENTER OR SCHOOL, PROVIDING FOR
APPROPRIATE NOTATIONS ON THE OFFICIAL
ZONING MAP; PROVIDING A CONFLICTS
CLAUSE; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING AUTHORITY TO CODIFY; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Boynton
Beach, Florida, has adopted a Comprehensive Plan by
Ordinance 89-38 in accordance with Chapter 163, Florida
Statues; and
WHEREAS, Christopher Cutro, Planning Director of
this City, has heretofore filed a Petition with the City of
Boynton Beach, Florida, pursuant to Section 9 of Appendix A
Zoning, of the Code of Ordinances, City of Boynton Beach,
Florida, for the purpose of implementing the recommendations
in Planning Area 2.c of the Land Use Problems and
Opportunities Section of the 1989 City of Boynton Beach
Comprehensive Plan by rezoning a certain parcel of land
within the municipal limits of said City, said property
being more particularly described hereinafter,
(Duplex Residential) to PU (Public Usage),
a day care center or school; and
WHEREAS, after public hearing
consideration of the recommendations

best interest of the inhabitants of said City to rezone the
property.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMI~ISMION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. The following described land, located in
the City of Boynton Beach, Florida, to wit:

southeast 1/4 of southwest 1/4 of
southeast 1/4 of Section 9, Range 43

North 100 feet of south 140 feet of east
30 feet of westerly 748 feet of
southwest 1/4 of southeast 1/4 of
Section 9, Range 43 east, and Township
45 south, of the Public Records of Palm
Beach County, Florida.
Containing .40 of an acre, more or less,
and subject to easements and rights of
way record.

day care center or school.
Section 2. The City administration shall make an
appropriate notation on the City's Official Zoning Map
indicating the rezoning, pending the adoption of a revised
Official Zoning Map.
Section 3. That all ordinances or parts of ordinances
in conflict herewith be and the same are hereby repealed.
Section 4. Should any section or provision of this
ordinance or portion hereof, any paragraph, sentence, or word
be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the remainder of this
ordinance.
Section 5. Authority is hereby granted to codify said
ordinance.
Section 6. This ordinance shall become effective
immediately upon passage.
