AGREEMEN?
2IIIS AGR~EMENT, made amd entered into this 16th day of
December, 1926, by and between the Town of Boynton, Florida.
hereinafter termed the Town, and the tt, 0. Nutting 0ompan~, here'-'
inafter termed the Laboratory.
WHEREAS, the Town will have under construction certain
bituminous pavements, the Town desires to employ said Laboratory
to re.st and inspect the materials used in the bituminous wearing
surface and to inspect and supervise the operations of the plant
of the contractor in the manufacture of the bituminous wearing
~surface mixture and to furnish a certain amount of street inspec-
tion of the bituminous wearing surface.
WI~NESSETH, the laboratory agrees to establish at the
of work to be done., a field laboratory, equipped to ~ake the

paving mixture. This field laboratory will be in charge of
competent and experienced asphalt chemist~, who .will make analysis
tests of all shipments of m~terials used by the contractor

~he Laboratory will issure daily reports covering
all analysis and inspection and any ct'her information that may
be of value.
Prior to the beginning of actual construction, the
Laboratory will make .tests and investigations of the materials
proposed for use by the contractor and wi-Il submit to the Town
of the authorized Engineer, a detailed preliminary report. Such
tests and investigations are to be conducted only on materials
delivered to the 'Laboratory by the Engineer or contractor, act-
ing under instructions of the Engineer. Ail samples will be
forwarded to the Laboratory prepaid and properly marked to per-
mit of indentification.
The inspection cnmtemplated for in this agreement
does not include the inspection of grsding or construction of the
rock base.
It is understood that the Laboratory is to complete
the inspection and tests of all such contracts awarded under this

mixture.
It is understood by both parties that either party may
Cancel this agreement upon sixty days notice; this notice to be ·
writing and to become effective sixty days from date thereof.
The Town agrees to give the Laboratory ten days notice,
to the date the asphalt chemist is to report. The Laboratory

Should the 2own notify the Laboratory that work is to
~[iScontinued for a period of seven days or more, the Laboratory

Notice of discontinuation of the work is to be given in writing
and five days in advance of the date chemist ie Sue to be re-
leaseA. The Town agrees to give the Laboratory seven days
written notice when work is to be resumed. The Laboratory
agrees to have its chemist reoort at the desired time or as
soon thereafter ss possible.
In consideration of faithful performance of said in-
spection and testing the Town,v agrees to pay said ~aboratory at
rate of Two (2~f') Dents per square yard for all pavement
)eoted under this contract.
It is agreed by the Town that payment will be made
the Laboratory not later than the tenth of each month for
services rendered ~uring the previous month.
