Commissioners of the Town of Boynton, Florida, was held
at the Town Hall of the ~own of Boynton, Florida, Tuesday

Commissioner Harry henson moved the adoption of
the following Resolution, to-wit:
WHEREAS, heretofore, the ~own Commission of the
Town of Boynton did, at a special meeting of such Uommission
held on the 2Wth day of October, 19~?, at the hour of 4:00
~. ~. of such day, pass anc adopt a ~esolution providing for
the sale of $50,000.00 of bon~s of saia Town bearing date
of October l, 1926. And,
WHEREAS, it has oecome necessary, since the passage
and adoption of such resolution, to c~nce~, out of and from
such authorized issue of $5OO,O00.O0 of bonds, the sum of
$18,~OO.O~ thereof issued for the purpose of refunding
~outstanding indebtedness of said Town. And,
WHEREAS, heretofore, the ~own Commission of the
Town of ooynton did decide to and provide for the issuance
of negotiable coupon bonds of the said Town of Boynton, such
bonds to 0ear date of October l, 1~6, bearing interest at
the rate of 6% per annum, payable semi-annually April i and

October 1, denomination of $1,uO0.oO each, and numbered
and payable as follows, viz: -
Numbered from I to 8~o inclusive.
Payable serially in numerical order
bonds on October i in each of the years 1931 to
1~40 inclusive, $20,u00.00 oonds on October 1
in each of the years i941 to 1948 inclusive,
$28,u00.O0 bonds on October l, in each of the
ears1946 to 1980 inclusive and
onds on 0cto0er 1, in each ~f t~e years
to 1958 inclusive. And,
WHEkEA~, there was appropriated the sum of
$?0,~OO.~O ou~ of and from such $500,000.00 bond issue
for the purpose of erecting, constructing, furnishing and
equipolng a pavillion or bathing establishment for the use
and benefit of said To~ of Boynton and the residents and
inhabitants thereof. And,
WHEREAS, the sum of $1EE,O00.O0 out of and from
such $500,000.00 bond issue, was appropriated for the purpose
of acquiring, opening, constructing and maintaining
promenades and play grounds within and for said Town. and,
WHEREAB, it is deemed advisable and to the oest
interests of the Town of Boynton and the in~a0itants thereof
that the sum of $28,000.00 appropriated for the purpose of
acquiring, opening, constructing an= maintaining parks,
promenades and play grounds within and for said '£own, do
be acquired in cash by said Town for the uses and purposes
for which such amount was appropriated. And,
WHEREA~, it is deemed advisable and to the best
interests of the Town of Boynton and the inhabitants thereof
that the sum of ~28,uOO.uO approp~iated for the purpose of
erecting public buildings within and for the use of the
said Town, to-wit, f~'the purpose of erecting, constructing,

furnishing and equipping a pavlllion or bathing establishment
for the use and benefit of said Town of ~oynton and the
residents and inhabitants thereof, do be acquired in cash
by seid Town for the uses and purposes for which such
ambunt was appropriated.
NOW THE~tEFORE, Be It nesoZved by the Town
Commission of the Town of ~oynton, in ~alm ~each ~ounty,
F~or&~a, that such resolution of the Town ~ommission so
passed and adopted on the 2Wth day of October, 192~, as
aforesaid, be, and the same hereby is, in all things repealed
and, in lieu thereof, be it resolved by the said Town
Commission of the Town of Boynton, as follows, to-wit:
1. That it is for the best interests of the
said To~n of ~oynton, the citizens, residents, inhabitants
and taxpayers thereof, that $50,000.00 of the $500,000.00
improvement bonds aforesaid do be sold at this time at such
price, for such sums and amounts as the Town Gommission
of the said Town of Boynton shall deem wise and to the
best interests of the said Town of ~oynton ana the inhabi-
tants, citizens, residents and taxpayers thereof. -
2. That, ou~ of and from t~e proceeds of the
sale of such $50,~OO.OO of improvement bonds of the Town
of Boynton, that $25,000.00 ~hereof do be used 0y the Town
Commission of the Town of ~oy~ton as it shall be deemed
best for the purpose of acquiring, constructing, opening
and maintaining parks, promenades and play grounds within
and for the said Town; and that the further sum of
$25,000.00 do be used by the Town Commission of the Town
of Boynton as it shall deem best for the purpose of erecting
public buildings within and for the use of the said
'£own, to-wit, for the purpose of erecting, construct!.ng,
I'urnishing and equipping a pavillion or oat~ing este.~lish-

ment for the use and benefit of the said Town of Doy~'~ton
and the residents and inhabitants thereof.
3. That the sa-le of $2U0,u00.UO of the $8:,U,OUO.u0
issue o~' bonds bearing date bi' October 1, i926, as aforesaiG,
has been advertised extensively anG 0ius were request;ed at
a meeting held for the sale thereof on the Zlst Gay
August, 1997, and that no bids were received therefo::..
4. ~hat the following bid L. H. Grist and Compnay,
received by the Town Commission on the 31st day of O.:tober,
192~, as follows, to-wit:

For $50,000 of your issue of $200,000 legally
issued bonds of the Town of Boynton, Florida dated (,:~tober
l, 1926 and bearing interest at the rate of ~% per a~l~xum
payable semi-annually, both principal anG interest p~yable
at the Seaboard National ~ank, New York City, and bei~'~g
in denomination of $1,~00.~0 each and maturing seriaJly
from 193l to 1955 inclusive without option of prior ~ymen~
of which we are to take $5~,~OO of ~he longest 0onas, we
will pay, upon delivery to us or our agent $950.~0
each $t,~OO bond.~
This ~id is made subject-to you furnishing ~As simul-
taneously with delivery of bonds a full anG complete ~ertifled
transcript of ali proceedings incident to, anG authoIizing
the issuance of said bonds, together with the unquali~'ied
final approving opinion of Messrs. Thomson, ~ood & h¢l~'fman
of New York ~ity.
As evidence of our good faith we attach her.i~to our
check for the sum of $500.00, said check to be held bli~ you
uncashed pending delivery of the bonds to us in accor,iance
with the terms of the above contract, and to be returned to
us immediately if for any reason the bonds can not be delivered
according to the terms of said contract. Said check -zo be
forfeited by us as full liquidated damages in the eve~'~t we
fai2 to carry out the terms of this contract.

issue of bonds bearing date of October l, 1926, in the
denomination of $1,o00.oO each, the numbers and maturities
of such bonds being as follows:
Bonds numbered 263, 264, 265, 266, 267, 268, payable
on October 1, 1948;
Bonds numbered 291, 292, 293, 294, 295 payable on
October 1, 1949;
Bonds numbered 319, 320, 321, 322,,323, 324 payable
on October 1, 195o;

payable on October l, 1951;
Bonds numbered 375, 376, 377, 378, 379, 380 payable
on October l, 1952;

at the price and for the consideration therein named, to-wit,
the sum of $950.00 and accrued interest for each $1,OO0.O0
bond.
6. That the attorneys for the Town of Boynton,
Messrs. McCoy & Finch, be, and they hereby are, authorized
and directed to procure the unqualified final approving opinion
of Messrs. Thomson, Wood & Hoffman, of ~ew York ~ity, upon
such bonds, and to request Messrs. ~homson, ~ooC & Hoffman to
submit final statement of their fees in regard to the
$500,U00.00 issue of improvement bonCs.
Commissioner Winchester seconded the motion for
the adoption of such resolution an~ upon being put to a
vote, the following vote was had thereon:

Thereupon, the Mayor presiding did declare such resolution
to be regularly passed and adopted.
Commissioner Benson moved that the following
Ordinance be placed upon its second andfinal reading:
ORDINANCE NO. 88
WHEREAS, heretofore and on the 7th day of
Septembjr, A. D. 1926, the Town Commission of the Town
of Boynton, in 'Palm Beach County, Florida, did pass and
adopt an ordinance providing for the issuance of $800,000.00
of negotiable coupon bongs of said Town, and which said
ordinance was entitled:
~AN ORDINANCE OF THE TOWN OF BOYNTON, PALM BEACH
COUNTY, STATE OF FLORIDA, ~t~IXING THE AGGREGATE
AMOUNT OF A PROPOSED ISSUE OF BONDS OF SAID TOWN,
IN THE SUM OF FIVE HUNDRED THOUSAND DOLLARS
($500,u~O.UO), TO BE ISSUED ~Y THE TOWN OF BOYNTON,
FLORIDA, FIXING THE DENOMINATION OP SAID BONDS
AND PLACE OF PAYMENT; PROVIDING FOR SAID BONDS
TO BE COUPON BONDS; FIXING THE RATE OF INTEREST;
THE PURPOSE FOR WHICH THE MONIES TO BE DERIVED
THEREFROM SHALL BE EXPENDED; FIXING THE TIME
WHEN SAID BONDS SHALL ~E PAYABLE; PROVIDING FOR
AND CREATING A SINKING FUND, AND INTEREST ASSESS-
MENT FOR MEETING AND DISCHARGING THE PRINCIPAL
AND INTerEST OF SAID BONDS; PRESCRIBING THE FORM
AND DENOMINATION OF SAID BONDS; PROVIDING FOR A
BOND OF THE TREASURER, ITS AMOUNT. CONDITIONS
AND APPROVAL; PROVIDING FOR A SEPARATE ACCOUNT
OF EACH BOND ISSUED, SHOWING THE NUMBER A/~D AMOUNT
0F BONDS ISSUED, THE RECEIPTS THEREFROM AND THE
DISBURSEMENTS OF THE PROCEEDS THJ~0F." And,
WHEREA~, ou~ of and from the said $500,~00.~0
negotiable coupon bonds, $18,oOo.ou thereof was for the
purpose of refunding outstanding indebtedness of the said
Town; such outstanding indebtedness being $18,~00.00 of
special improvement bonds of the said Town of ~oynton, Oeing
a part of a total authorized issue of $Z5,~00.00, which bonds
matured on October l, 1~7. And,
WHEREAS, the said $18,00~.00 of improvement bonds
aforementioned did mature and become payable on October l,
19~ such maturity being prior to and before the sale of
the $500,000.00 issue of bonds, or any portion thereof, and
before an~ funds were availab~ from ~he sale thereof. And,
WHEREA~, to prevent a default in such bonds, it
was necessary, deemed expedient and to be to the best
interests of ~he said Town of Boynton.to and there was ad-.
vanced or loaned from the general funds of the said Town
of Boynton ~he sum of $18,OOO.O0 for the payment of such
special improvement bonds so maturing'on October A, 19~7.
And,
WHEREAS, such $1~,OOO.OO special improvement bon~s
of the Town of Boynton were paid out of and from the general
funds of such Town at the time of their maturity, to-wit,
0ctobe~ l, 19~. And,
WHEREAS, $50,OO0.00 of the $8o0,O00.00 issue.of
bonds aforementioned have been sold and a portion of such
$So,oOO.oO so sold being the $18,OOO.OO of bonds issued
for refunding purposes as aforesaid. And,
WHEREAS, the examining attorneys, Messrs. Thomson,
Wood & Hoffman, advime that they cannot approve the validity
of the issuance of the $18,oOO.OO of bonds so authorized to
be issued for the purpose of refunCing such outstanding
indebtedness, for the reason that such bonds had been
paid out of and from the general funds of the Town of
Boynton, and such refunding bonds could not be issued for
the purpose of repaying to the treasury moneys which had
already been expended in payment and satisfaction of such
previous issue of bonds.
NOW THEREFORE', Be It Ordained by the Town
Commission of the Town of Boynton, in Palm Beach County,
Florida, that such $18,oo0.00 Of bonds so a~thorized to
be issued for the purpose of refunding outstanding indebted-
ness, being bonds numbered 257, 258, 259, 260, 261, 262,
286, 28V, 288, 289, 290, ~1~, ~1A,'315, $16, 317, 318, and
~A1, be, and the same hereby are, cancelled and that the
$500,000.00 issue of bonds be reduced, in consequence of
such Cancellation and in accord therewith, to the sum of
$482,000.00; and further, that such $18,000.00 of bonds
for'refunding purposes be stricken and cancelled from the
computation of $500,000.00 of bonds aa aforementioned.
B~ It Further Ordained that such $18,000.00 of
bonds so cancelled as herein provided shall be, by the
Town Commission of the Town of Boynton, destroyed, such
bonds so to be destroyed and cancelled as aforesaid, being
numbered and maturing as follows, to-wit:
Bonds numbered 257., 258, 259, 260, 261, 262,
maturing October 1, ~;
Bonds numbered 286, 287, 288, 289, 290 maturing
· October 1,
B~nds numbered ~13, ~14, ~15, 316, 317, 318
' maturing October 1, 1950;
Bond numbered 541 maturing. October 1, 1951.
'Be It Further Ordained that, save and except
for the cancellation and destruction of the $18,000.00
o~ bonds issued for the pumpose of refunding outstanding
indebtedness of the said Town of Boynton and the reduction
of such $$00,000.00 issue of bonds in the amount of
$18,000.00 as aforesaid, that said ordinance and all acts
and proceedings had in connection therewith and wi%h the
issuance of said bonds be, and the same hereby are, in
all things, fully ratified and confirmed.
Commissioner Winchester seconded the motion
and upon being put to a vote the following vote was had
thereon:

Thereupon, such ordinance was p~aced upon its second and
final reading and read in full.
Thereupon, Commissioner Benson moved that such
ordinance be passed and adopted as read. Commissioner
Winchester seconded the motion and t he following vote

passed and adopted.
