THIS AGREEMENT, w~de between the FLORIDA EAST
COAST RAILWAY COMPANY, a corporation organized and existing
under the laws of th~ State of Florida, party of the first
part, and the 'TOWN 0 BOYNTON, a ~mx~ipal corporation of
the State of Florida, party of the sJcond part.
W~T NESSETH:
That the said party of the first part, for and in
consideration of the covenants and agreement herein contained
to be performed and kept by the party of the second part, does
hereby give and g~ant unto the said pa~ty of the second part
the right and P~ivllege to use as an easement for street cross-
ing purposes only, that part of the right-of-way and property
of said Railway ComPany in Palm Beach County, Florida, at
the loc ations

In consideration of the g~anting of the easements
above described by the pa~ty of the first part to the pa~ty
of the second part, the party of the second part covenants
and agrees with the party of the first part as follows:
(1)
That said easements shall be used for road crossings
only, and no pipe, wire, rail or other line or structure shall
be placed in or on said right-of-way or easements without the
p~evious consent in writing of said Railway Company.
That the expense of opening and extending said
crossings over the right-of-way of the perry of the first
part, including any and all expense in connection with changes

in pole or wire lines, f~om' easterly ~ght-of-way line to
easterly end of ties and from westerly right-of-way llne to
westerly end of ties, and also any expense for grading,
paving, sidewalks and maintenance', except as to that part
of crossings between ends of reis, shall be borne and paid
for by said perry of the second part; and that all of said
work provided for and mentioned in this paragraph shall be
put in and maintained to the satisfaction of the Engineer
Maintenance of Way, of the party of the first'part.
(3)
That all costs of maintenance necessary or incidental
to the location of said easements and crossings over the
right-of-way of said party of the first pa~t from easterly
right-of-way line te easterly end of ties,and from westerly
end of ties to westerly right-of-way line, shall be paid for
or done by said party of the second part.
~.~ That said of the first part, may, at its
option, at~am~-~e hereafter put in, maintain and operate
and additional track or tracks over or across maid easements
and crossings.
(5)
That party of the second part shall not take any
action that will prev~nt or tend to prevent the operation of
trains over said crossings.
(6)
That party of the second party hereby grants unto
party of first Part all necessary permits for the installation,
constr~ paid and maintenance of any of the

facilities, work on fixtures, mentioned or contemplated in
and by this agreement, party of the first part to give said
party of the second party forty eight (&8) hours notice of
intention to perform my such installation, construction,
erection, repair and maintenance.
IN WITNESS WHEREOF, the said party of the first
part has caused this agreement to be signed in its name by
its Vice-President and its corporate seal .to be hereto affixed,
attested by its Assistant Secretary, and the party of the
second part has caused this agreement to be signed in its

sewers, stating 'in a general way what was to be done, the
limits within 'which said work was to be done, the materials
to be used, the grade to be established and the fills to
be made; and,
WHEREAs, the said Town Commission of the Town of
Boynt.c~, Florida, did, thereafter, cause the said Work of
the'construction of such system of sewers to be done by
contract in accord with its said resolution so passed and
'adopted on the Sth day of May, 1926, and in conformity to
and in accord with the plans, specifications, P~Ofiles and
estimates so adopted for the construction thereof; and,
W~EREAS, the construction of such system of sewers
is now entirely completed and a full and complete system
of sewers has been builded, c~st~ucted and completed within
such town in. accordance with such plans, specifications,
profiles and estimates so adopted, as aforesaid, and in
complete accord with the aforesaid resolution so passed and
adopted on the 8th day of May, 1926; all of which work was
completed on the 1st day of June, A. D. 1927; and,
WHEREAS, the total cost of the construction of
such system of sewer according to the plans, specifications,
Drofiles and estimates so adopted on the Sth day of May,

v~ding therefor, and passed and adopted on the 8th day of

2. That the Connnissi~ of the said ToWn of
Boyn~n, Palm Beach County, Florida,' do pay the seats and
expenses of construction and b~ilding of ~h.[~atem of
sewers, Which' is a complete System of sewe~'~ ~th eerti-
upon the liens thereof as authorized by the eharter of the
said To~n of Boynton and by the general laws of the State
of Florida.
3. That it is further detex-mined, adjudged and
decided that the total cost of the oonnt~uction of said
~stem of sewers is the sum of One ~andred Fifty-Seven
One thand~ed Ninety-Seven Dollars 'and Eighty-FoUr
Cemts ($157,197.84).
4. That it ~ further determined, adjudged and
decided that the sum of Sixty Thousand Dollars ($60,000.00)
is hereby apportio~d to and decided, adjudged and determined
to be paid from the General Improvement Fund of the Town of
Boynton, in Palm Beach County, Florida, upon and toward the
cost and expenses of s~ch ~k and imprOVement.
5. That it is further deteemined, adjudged and
~ecided that the lots, parcels, lands and pr~mises hereinafter
~d and against which assessments a~e herein made,

have been specially ~enefitted by the const~uction of
such system of sewers; and fttrther that the total amount
of such special benefits so derived is the sum of Ninety-
8even Thousand ~e Hundred Ninety-S.ven Dollars and Eighty-
Fou~ Cents ($97,197.84).
6. That the c~sts and expenses of said work so
to be Paid by such certificates of indebtedness or improve-
ment bonds predicated upon the lien thereof, .be, and the
same hereby is, aasessedJagainst and aport the 'properties
especially benefitted by such improvements in proportion
with the benefits derived therefrom, such special benefits
to be determined and pro rated according to the front footage
of the respective p~operties, lots, tracts and parcels of
land especially benefitted by such improvement.
7. That it is hereby further determined, adjudged
and decided that the Iota, tracts and parcels of land so
assessed as hereinafter set forth and designated, have been
especially benefitted by such improvements and have been
so especially benefitted in the amount and sums assessed
against them respectively as hereafter set forth; and fttr-
ther, that no other lands, tracts, parcels of land or pre-
mises withiu such Town of Boynton have received and special
benefit f~om such improvement.
8. That it is hereby f~rther determined and decided
that all the costs and expenses of construction of the said
system of sewers shall be assessed against the lots, tracts
and Parcels of land especially benefitted by such improve-
ments in proportion to the benefits which such lots, tracts

and parcels of land derived therefrom.
9. That the said assessments shall be paid in ten
equal installments and shall bear interest at the rate of eight
per cent (8%) per annum, payable semi-annually, with accrued
interest on all deferred payments unless paid within 30 days
after such assessments shall have been confirmed.
10. That it is hereby fUrther adjudged, decreed and
determined that each of the following described lots, tracts
or parcels of land so especially benefitted by the construction
of the system of storm sewers, d_rains or drainage hereinbefore
referred to respectively in the amounts herein assessed against
them and t~t said lots, 'tracts, parcel or parcels of land so
benefitted, respectively, be, and they hereby are, assessed the
amc~nts respectively set opposite the description thereof, which
said amounts are the amounts and sums which the respective lots,
tracts, or parcels of land have been especially benefitted by
the improvements, Viz; the construction of the system of storm
sewers, drains or drainage hereinbefore referred to, to-wit:
