Mayor Marchese called the meeting to order at 6:00 P. M.
The Invocation was given by Rev. Douglas Davis, followed by
the Pledge of Allegiance to the Flag led by Commissioner
Olenik.
AGENDA APPROVAL
Commissioner Weiner wished to make a correction on page 2
under Consent Agenda, Development Plans (Bertoli's
Restaurant) as this request was denied by the Planning and
Zoning Board as well as the Community Appearance Board.
This item was removed from the Consent Agenda and placed
unde~ Development Plans as Item 1.
City Manager Cheney added the following bills under Approval
of Bills: $2,079,925.80 for payment of Shooters' property,
$9,885.32 for the Catalina Center, $126,837.23 to the Solid
Waste Authority, and $69,872.56 to Diversified Drilling.
City Manager Cheney wished to delete under Consent Agenda,
Item C.1. the Resolution regarding Amending Pay Plan and
adoption of job descriptions. Also under Consent Agenda, he
requested that Item D. 1 (Boynton Lakes Plat No.6A) be
deleted as the applicant did not appear at the Community
Appearance Board meeting.
Vice Mayor Hester wished to make some comments after the
City Manager's Report.
Mayor Marchese wished to add an item under Legal, Other, Re:
Procedure Relative to Boards. Under New Business he wished
to add an item a request from Burt Reynolds relative to the
City of Boynton Beach.
Vice Mayor Hester moved to approve the agenda as corrected
and amended. Motion was seconded by Commissioner Weiner and
carried 5-0.
ANNOUNCEMENTS
Mayor Marchese explained the procedure for those in the
audience who might wish to speak on some item on the agenda
or on another topic not listed on the agenda.

1. Status Report from Civil Service Chairman
Don Balmer, Chairman of the Civil Service Board, came for-
ward to give his annual report of the activities of the
Board during the year. He reported this had been a busy
year. The Board has continued to meet on the second
Wednesday of each month. As of October 1, there were 728
employees in the City. During Fiscal Year 1987/88 there
were 178 employees hired and processed, and 1424 applica-
tions were received. Civil Service examinations were given
for entrance positions to 308 people and 87 current
employees who took promotional examinations for a total of
395 examinations. This happended during 37 test date which
were monitored by the Board and administrated by the
Personnel Department. There was one Civil Service Hearing
during the Fiscal Year. This was a hearing on a terminated
employee, and the City was upheld in this case.
Mayor Marchese thanked Mr. Balmer and the Board members for
a job well done.
2. City Hall will be closed December 23rd and December 26th
for Christmas and January 2nd for New Year's Day

CITY MANAGER'S REPORT
1. Bond Money for the Purchase of the Shooters Property
City Manager Cheney stated that the bond money for the pro-
per{y just south of Shooters was sold at 7.2305 percent
interest and the average on that day was 7.5 percent. He
noted that the City was able to sell below average.
2. Auction held on December 20, 1988
The City sold many bicycles and some other items which
brought $1,800 into the City. This money will go into
General Fund as Miscellaneous Revenue.

3. Opening of the Library
The Library opened on Monday with no real problems. The
City is happy with the new checkout counter. There are some
complaints about parking, but these will continue as long as
work continues in that area. Curbing was installed this
date and the additional parking lot is being worked on.
Additional money will be put in, and the old Library has
already begun to be demolished on the inside. The work of
all the volunteers, Friends of the Library, Garden Club,
Library Board, and all the employees from various
Departments was appreciated. The move went smoothly and the
Library opened on the 19th as scheduled.
4. Water Outage in Hunter's Run
City Manager Cheney had numerous telephone calls from resi-
dents of Hunter's Run about the unscheduled water outage
which occurred while the residents were trying to get
dressed for work. City Manager Cheney explained this was a
contractor related problem and the City was not responsible.
He further explained that when the City must turn off water

the residents are notified, and the outage is scheduled for
a time which will cause the least inconvenience for the
residents. The contractor was told not to turn the valve,
but they proceeded without contacting the City.
Mayor Marchese thanked City Manager Cheney and staff for the
fine job that was done in relocating the Library.
The City Manager's Report was accepted as presented.

the request for an amendment to the previously approved site
plan be denied noting the opinion of the City's Technical
Review Board. The Board also found that the requested
change was not in harmony with the character and aesthetics
of the shopping center.

dated December 6, 1988, recommended that arrangements be

G. Consider approval of Water Meters/Broward County Meter
Bid
William H. Sullivan, Purchasing Director, in his memorandum
dated December 12, 1988 recommended that the City use the
Broward County Water Meter Bid which is good through April
30, 1989.
H. Consider approval of repairs to Cushman Mowers - Parks
Department
William H. Sullivan, Purchasing Director, in his memorandum
dated December 14, 1988 stated that the lowest quote came
from Able Lawnmower Sales and Service of Lantana, Florida,
in the amount of $1,200.00 for reboring the engine block and
$1,400.00 for replacing the hydrostatic transmission.
As there was an attachment missing from the agenda packet,
Mr. Sullivan clarified for Commissioner Olenik that Able
provided the lowest quote.

Commissioner Weiner stated this was a wonderful gesture on
the part of this Club. She planned to go by and thank them
personally at their next meeting. City Manager Cheney
stated that this group makes a donation annually in appre-
ciation for the use of the Civic Center.

Commissioner Weiner to allow for discussion.
Mr. Golden stated that Mr. Rapaport was requesting approval
of an amended site plan to allow for as built elevation
changes. The TRB stated that they find the as built eleva-
tion changes inconsistent with the shopping center color
scheme. Mr. Annunziato stated that the Community Appearance
Board had also denied the request at their meeting held on
December 19th.
Burt Rapaport, agent for Bertoli's Restaurant was present
and stated that the Statutes require that the building be in
harmony with the surrounding environment. He pointed out
that he had not introduced any new colors into the shopping
center. He noted that in the beginning his business had
been very poor and he felt this was due to a lack of iden-
tity for the building. Since they had painted on the
checked band, customers were coming into the restaurant.
He felt that since this is an Italian restaurant, the red
and white is appropriate.
Mayor Marchese stated that Mr. Rapaport had an approved site
plan but chose to go ahead with color changes without appro-
val. He felt that if the restaurant provides good food that
is more important than any color scheme.

Redevelopment Plan for expanded redevelopment area
City Attorney Rea read proposed Ordinance No. 88-60 on
second and final reading, by title only:
"AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON
BEACH, FLORIDA, APPROVING AN AMENDED COMMUNITY REDEVELOPMENT
PLAN FOR THE CITY'S EXPANDED REDEVELOPMENT AREA; FINDING
THAT THE PLAN CONFORMS TO THE COMMUNITY REDEVELOPMENT ACT OF
1969, AS AMENDED; PROVIDING AUTHORITY TO MODIFY OR AMEND

Commissioner Olenik stated there was discussion last week
that the City Commission might have been in violation of
certain Statutes in putting this Plan up for ordinance
reading. He asked City Attorney Rea to elaborate on this.
City Attorney Rea stated that the Chairman of the Planning
and Zoning Board had given a legal opinion as to the
accuracy of the technique used by the City. He noted that

the Chairman had referred to the wrong section of the
Florida Statutes. He should have referred to the section on
the following page. Technically the City is amending the
original Plan and the land use as well. He felt that the
City had followed the appropriate Statutory requirements.
Commissioner Weiner noted that the Chairman of the P&Z Board
had asked the Planning Director to place an advertisement in
the newspaper for a public meeting on changes in the
Redevelopment Plan. She asked if the P&Z Board Chairman had
the right to do this. City Attorney Rea stated that
anything can be advertised, but he read the requirements
from the Statutes: "The governing body shall hold public
hearing on a proposed modification to the Community
Redvelopment Plan after public notice thereof by
publication." When the ordinances are advertised for second
reading, this is done.
Commissioner Weiner asked if the Chairman of the P&Z Board
was entitled to advertise and call for public meeting when
the P&Z Board is limited to finding consistency between this
Plan and the Comprehensive Plan.
City Manager Cheney referred to a memorandum from Mr.
Annunziato which addressed this issue. A copy of the
memorandum is attached as Addendum "C" to the original copy
of these minutes in the Office of the City Clerk. The P&Z
Board requested that the map of the area be printed in the
newspaper twice which would cost a total of $1,200.00. City
Manager Cheney asked if the City Commission wished to spend
this amount of money for the map ad. He further referred to
the workshop meeting established by the P&Z Board for
January 5th at 3:00 P. M. noting that the City Commission
was requested to join the P&Z Board at this meeting.
Mr. Annunziato stated that over the years the P&Z Board has
conducted public hearings regarding issues felt to relate to
the Comprehensive Plan. There is nothing which says that
Board can or can't advertise and call for public meetings.
A public hearing would require some advertising, and he felt
that if this was to be advertised, the map would be an essen-
tial part of the advertisement. Vice Mayor Hester felt that
the final decision was up to the Commission and the City
Attorney had stated that the action taken by the City
Commission was in order. Vice Mayor Hester saw no reason to
advertise.
Commissioner Mann wanted to know why the Commission was
pushing this issue without going through normal procedures.
He could not support this without having Planning and Zoning

review the Plan. City Manager Cheney stated this was normal
procedure for this action. They could go through some extra
procedures if so desired. Commissioner Mann wanted to know
if this had ever been done before, and City Manager Cheney
stated that this particular action had never come before the
Commission before. Commissioner Mann wanted to know why it
was the desire to circumvent the P&Z Board, and City Manager
Cheney replied this was not the desire as they were not
involved in the first place.
Vice Mayor Hester noted this was sent to the P&Z Board to
determine if they found the Plan to be consistent with the
Comprehensive Plan. The City Planner and staff made a
recommendation that it was consistent with the Comprehensive
Plan.
City Manager Cheney stated that in the next few months, the
City would be adopting a Comprehensive Plan. They have the
opportunity to change what is proposed in the Redevelopment
Plan again as the Comprehensive Plan is adopted. The old
Central Business District Plan can also be changed as part
of the Comp Plan. The Planning and Zoning Board will be
very involved with that decision process which will be
before them in the next several months. He further pointed
out that the other reason for taking action now is to move
into the area of Tax Increment Financing (TIF) which can be
done in December or wait until a later date and delay the
TIF for another year. Funding for the Redevelopment Area
has always been a problem. This is an opportunity to set
aside and designate some funds to help in this area to help
promote any plans adopted. The reason for doing TIF now is
to start the process for TIF.
Mayor Marchese commented that he had intended in no way to
bypass the P&Z Board. He had hoped they would understand
the situation. This was done legally, and changes could be
made.
As this was a public hearing, Mayor Marchese asked if anyone
wished to speak AGAINST the proposed ordinance.
Rev. Douglas Davis, 301 N.E. 13th Avenue, stated that he was
not against the development, but he wished to have an oppor-
tunity for more input. He was referring to Minority
Contractors and stated that the City has some very good
Minority Contractors. On the meetings of November 6 and 20
the size of the Redevelopment Plan had increased in volume.
They had not had enough time to study the Plan and they
wished to do so. He requested that the City Commission not
be in such a rush to sign the Plan, but to postpone action
to allow more input from the area.

Mayor Marchese stated the plan was not set in concrete, and
there would be more public hearings. He hoped that many
contractors would come forward with their ideas. He
further stated that this Plan can be amended, but he felt
that it was appropriate to take advantage of TIF at this
time. He stated that it was not the plan to spend money
foolishly, but to spend money for positive results. Input
would be received from everyone in the City.
Rev. Davis asked what type changes Mayor Marchese was
referring to. Mayor Marchese stated that many plans could
be brought forward. He referred to whether the buildings
should be highrises, one story structures, etc. These would
have to be discussed. Many ideas, plans and suggestions
would be evaluated. He was sure that Rev. Davis would con-
tinue to be involved in the process. Rev. Davis again
requested that the Commission not be in a rush to sign the
document, but postpone it for a time to allow more study and
input. Mayor Marchese stated that all they were considering
at this time was accepting an ordinance which would allow
them to move ahead. This would not sign anything in
concrete. No contracts were to be let. Rev. Davis wanted
the signing of the Ordinance to be postponed as well.
Wilda Searcy, 402 N.E. 13th Avenue, stated that in the
planning for her community she wanted to see some sidewalks.
She referred to conversations with the children who were
playing in the streets. She wanted to see sidewalks for
their use. She thought sidewalks were provided for in the
1988 budget, but they have not been installed. She referred
to trees in the street on N.E. Railroad Avenue and the fact
that cars have a problem turning. She felt her area was an
unfit place to raise children.
Mrs. Searcy was also concerned about the area at Seacrest
and the Canal and wanted to know when this area would be
inproved. She felt this area was dangerous for the children.
Vice Mayor Hester stated that he did not find the area an
unfit place to raise children. He did not feel that
sidewalks were essential to raising children. He felt the
responsibility for raising the children comes from the homes
they live in. Vice Mayor Hester was born in Boynton Beach
and he had been listening to Mrs. Searcy for 3½ year talk
about the problems in the City. He had never heard her say
anything good about the City. Vice Mayor Hester stated that
Mrs. Searcy had told him that the government had sent her
here to get this area straight and she agreed she was sent
to help. He noted that she had good points, but he did not
like to hear only negative comments about the City.

Mayor Marchese pointed out that the proposed Ordinance
included widening some of the streets, etc. He also pointed
out that the City has been putting in markers so the people
can see where the sidewalks would go. He felt that some
people might not want the sidewalks. He felt that if space
and money are available, sidewalks would be fine.
Mrs. Searcy then referred to correspondence she had with
Senator Lawton Chiles and telephone conversation with
Representative Dan Mica. She felt that the City had the
money now and asked why nothing was being done. Mrs.
Searcy felt that Boynton Beach was discriminating.
Mayor Marchese asked if anyone IN FAVOR would come forward.
John Corbett, 1301 N. Congress Avenue, 9330, stated that he
had an item coming up later on the agenda which related to
housing in the Redevelopment Area, and he was concerned that
if his plan was not consistent with that proposal if any
problems would be created. His plan mostly deals with
multi-family housing. He wondered about the legal issues
which might arise if his plan is not consistent with the
proposal. Mayor Marchese understood that if this
Redevelopment Plan is adopted, and then Mr. Corbett presents
his plan for review, it would be considered. Mayor Marchese
felt that the City wanted to pick the best plans. He con-
tinued that approving this Ordinance would not preclude
anyone from coming in and submitting a proposal. The Plan
is not set in concrete.
Mr. Corbett went on record as supporting the plan as he felt
it was a step in the right direction. He referred to the
short time frame for drafting the Plan and noted that
changes were probably forthcoming, and he felt that the
needs of the renter households living in the area had not
been adequately addressed. He feared an inconsistency in
the number of renter households that live in the area who
would be displaced and relocated and the new housing oppor-
tunities created for renter households under the Plan as
written. He suggested the Plan be amended in that respect.
As no one else wished to speak IN FAVOR or AGAINST the pro-
posed Ordinance, THE PUBLIC AUDIENCE WAS CLOSED.
Vice Mayor Hester agreed with the Plan from RS&H, but he had
talked with people in the area who would be directly con-
cerned with the Plan. He was of the opinion that perhaps
this should be tabled to allow time for discussing the Plan
with the residents and incorporate some of their ideas into
the Plan before adoption. He agreed with the Consultant on

the areas proposed for improvement, but he felt that more
discussion should be held with the residents. He did not
feel that the residents fully understood the Plan.
Mayor Marchese stated that adoption of the Plan would make
TIF money available. He did not feel that anyone had stated
that discussions with the residents would not continue. He
was concerned about the rumor which said that if the Plan
was adopted the City would have to spend millions of dollars
for water lines, etc. The water lines were to be replaced
no matter what decision was made on the Plan. The 2" lines
were a public safety issue and should go to 6" no matter
what decision was made on the Plan.
Commissioner Weiner understood from the beginning that the
reason for the haste regarding adoption of the Plan was to
establish a tax base in the Redevelopment Area in 1988. She
felt it was the desire to freeze the tax base before any
additional construction comes in. She referred to the
Kentucky Fried Chicken which could increase the tax base.
She was not in agreement with all the Plan, but she had been
assured that the Plan could be changed and public hearings
held prior to final adoption. She was in favor of the
Redevelopment Plan for those reasons.
Commissioner Olenik asked if this Plan were approved at this
time what would be the effective date of the tax rolls to be
used. City Manager Cheney stated that he and City Attorney
Rea had discussed this and referred the question to City
Attorney Rea. City Attorney Rea stated it would be effec-
tive now, but they would not be getting any revenue for
another two years (1990). City Manager Cheney stated that
it was their understanding that the base would be frozen as
of December 31, 1988, and the next assessement would be
December, 1989. The difference between 1988 and 1989 is the
increment and the millage the City would be collecting in
the fall of 1990 is the millage which will be based on the
increment is what the City would be getting. Commissioner
Olenik noted that any new project which received its
Certificate of Occupancy (CO) this year would be included.
City Manager Cheney stated that the date of value any tax
year is December 31st. Property is appraised throughout the
year, but it is alternate back to December 31st which is the
date of assessment. He did not feel there was much oppor-
tunity for an additional CO's this year as there were only a
few days left. Money would not be coming immediately, but
to postpone for a year would delay TIF for another year.
Commissioner Olenik noted that if the Plan is not approved
at this time, there could possibly be two projects in 1989 -

Fred and Joes and Kentucky Fried Chicken. If these two
receive their CO prior to December 31st they would be a part
of the December 31st tax roll.
Commissioner Mann stated that he saw the reasons for rushing
this project through as being: a) The City is allowed to do
it, and b) it is legal. He saw both reasons to be insuf-
ficient and very poor reasons for approving the Ordinance.
City Manager Cheney added that those were not the reasons
for acting now, but because of taking advantage of capturing
that increment of TIF now. There would be plenty of oppor-
tunity in the coming months with the adopting of the
Comprehensive Plan to make changes.
Commissioner Olenik stated that he was against adoption at
this time as he did not think the plan was visionary enough
and did not look far enough into the future. It also did
not make the statement which he felt should be made for this
area.
Commissioner Weiner moved to adopt proposed Ordinance No.
88-60 on second and final reading. The motion died for lack
of a second.
Mayor Marchese did not understand how the City Commission
could turn down a plan for revenue when the Plan before them
could be changed.
Workshop Meeting Scheduled by P&Z Board
City Manager Cheney asked what the Commission's desire was
in regard to the request by the P&Z Board to have a workshop
meeting on January 5, 1989 at 3:00 P. M. for the Commission
and the P&Z Board to discuss the Plan. There was some
discussion regarding the time and who proposed the meeting.
City Manager Cheney again read the memorandum (Addendum "C")
from Mr. Annunziato on behalf of the P&Z Board regarding the
workshop meeting. City Manager Cheney asked if the City
Commissioners wished to join the P&Z Board at the workshop.
Commissioner Mann was concerned about the way the invitation
came about.
Commissioner Olenik would be open to meeting with them, but
he was concerned that members of the community might not be
able to attend a meeting at 3:00 P. M. in the afternoon.
City Manager cheney stated that the time was established by
the P&Z Board and they would be meeting at that time and on
that date. Vice Mayor Heater was in agreement that the 3:00
P. M. time frame was not appropriate if public participation
was desired.

Mr. Annunziato stated that if the P&Z Board felt the
Commissioners were ameniable to meet with them, they might
find a more convenient time. He was willing to write back
to the Board and try to find a time to set up a meeting.
City Manager Cheney stated that it would not be appropriate
to attempt to establish another date unless the P&Z Board
came together to do so. He also pointed out there would not
be another P&Z Board meeting prior to the workshop date. He
did not want the City Commission to get into the middle of
the P&Z Board's discussion. After that time, the Commission
could look at the calendar and determine if another meeting
was needed.
Advertising
Mr. Annunziato then asked about what should be done
regarding the advertising for the P&Z Board Workshop
meeting. City Manager Cheney stated that the Board had
requested the map advertising and the City would proceed
with the advertisement.
City Attorney Rea recommended that since the motion to adopt
the Ordinance died for lack of a second, it might be tech-
nically more appropriate to make a motion to deny passage of
the proposed Ordinance and take a vote for clarification of
the record.
Vice Mayor Hester asked if it could be tabled, but City
Attorney Rea stated that technically the Ordinance was dead.
He just wanted to clear the record.
Commissioner Olenik moved that they reject Proposed
Ordinance No. 88-60 on second and final reading. Motion was

Mr. Golden explained the location of the property which is
now being used as an ACLF and was formerly a motel. The
main building can accommodate 20 beds and the two single
family homes would add an additional 10 beds. The P&Z Board
voted unanimously to approve the request.
Commissioner Olenik asked if there would be a fence
installed, but Mr. Golden stated this was not a requirement
for R-3 zoning.
As no one wished to speak AGAINST or IN FAVOR of the request
THE PUBLIC HEARING WAS CLOSED.
Commissioner Olenik moved to grant the request for con-
ditional use and site plan approval to allow for an expan-
sion of the existing facility by incorporating two adjacent
single-family residences and a change in parking lot layout
and design subject to all staff comments. Motion was
seconded by Vice Mayor Hester and carried 5-0.
There was some discussion regarding signs and the approval
process. Mr. Annunziato stated that the City Commission has
a chance at site plan approval time to review the sign pro-
posals. It was a feeling of the Commission that the issue
of signs coming before the Commission should be considered.
They felt that perhaps for a period of two years or so, the
Commission should take more of a part in sign approvals.
City Manager Cheney was looking into the approval process
and would bring something before the Commission at their
first meeting in January, 1989.

1. Procedure for Boards
Mayor Marchese read from the Procedure for Participation by
Board Alternates at Board Meetings dated 6/7/83 and asked if

the Commission felt this procedure should be followed or if
they wished to make changes. It was noted that there are
inconsistencies among the various boards. The 1983 proce-
dure is attached as Addendum "E" to the original copy of
these minutes in the Office of the City Clerk. Some Boards
follow the procedure of letting a member abstain from voting
when an issue before them might be construed as a conflict.
Other boards have the alternate sit in for that portion of
the meeting and have the regular member go into the audience
if he has a confict with voting on an issue.
Commissioner Weiner had some other items she wished to
discuss relative to boards. Mayor Marchese felt it was a
good idea to place this on the agenda for the next meeting,
and he requested that the City Manager do so. Commissioner
Olenik wished to discuss some other issues relative to board
participation at that time as well.
PUBLIC AUDIENCE
Parking Lot/Urban Design Plan
Michael Agnello, 4012 Shelldrake Lane, Boynton Beach came
forward to explain a situation which has come about
regarding the requirement for a new parking lot which
conflicts with the Boynton Beach Boulevard Urban Design Plan
proposal. A dentist who has his office in the building has
been cited by Code Enforcement for operating without a
license. In order to get a license the parking lot must be
brought up to standard. The use is grandfathered in and the
parking lot is currently packed gravel. The Code
Enforcement Board has given them 6 months to bring this up
to code. Mr. Agnello has hired an architect, an engineer, a
surveyor and lighting experts. He has been told he will
have to apply for a variance which will cost $400 for the
application. This variance is for his driveway which is the
only entrance off Boynton Beach boulevard. He wanted to
improve the parking lot, but if he does he may be told in a
few months to take it all out to come into compliance with
the Boynton Beach Boulevard plan. The dentist is concerned
about the liability of operating without a license, and Mr.
Agnello is afraid he will lose him as a tenant.
City Manager Cheney stated that Mr. Agnello had come to him
and talked with him about the situation. City Manager
Cheney stated that things of this nature come up from time
to time. He pointed out that Mr. Agnello has been requested
to do something which is in conflict with the implementation
of the Boynton Beach Boulevard plan. City Manager Cheney
felt that the Commission should understand that these type
problems were arising.

Commissioner Olenik wondered if it was time to give the
Urban Design Plan more consideration. If this plan was
approved in the near future, Mr. Agnello might be able to
wait and avoid the situation. He could probably request an
extension of time from the CEB.
City Manager Cheney felt this was probably a good time to
give the plan serious consideration. The Commissioners
agreed, and the Boynton Beach Boulevard Urban Design Plan
would be placed on the agenda for the next meeting of the
City Commission.
Sergeant Sheridan
Bob Fauser, 125 S.E. 6th Avenue, Boynton Beach, came forward
to speak about Sergeant Paul Sheridan. On October 19, 1988
Sergeant Sheridan got in trouble at the Tadpole Lounge in
Delray according to Mr. Fauser. The City found that
Sergeant Sheridan had used poor-judgment and displayed con-
duct unbecoming a police officer which reflected discredit
on the City of Boynton Beach. He received a "slap on the
wrist" - 3 days suspension without pay. Mr. Fauser referred
to three previous incidents involving Sergeant Sheridan and
questioned why he was still working for the Police
Department. A Lake Worth police officer investigated an
incident which took place in May, 1984 which involved
Sheridan. Sergeant Sheridan's police informant was shot to
death. The Lake Worth Police report stated that Sergeant
Sheridan was intoxicated. The City of Boynton Beach
cleared Sergeant Sheridan of any wrong doing, and the Lake
Worth Police officer went to the press and told them that he
stood by his version of the event of 1984. He also stated
that "Official Police misconduct is everyone's concern, and
should not be taken lightly or concealed by any agency or
citizen." Mr. Fauser felt this statement is true today as
well. He felt Sergeant Sheridan's conduct was a disgrace
and the fact that the City Manager continues to tolerate
such behavior after 4 incidents should be the concern of
everyone - Commission included. He wished everyone to know
that if Sergeant Sheridan's misbehavior drags the City
through a big financial mess, he will not be the only one
held accountable. He felt the responsible City Officials
who were aware of his record and chose to remain silent
would share the blame. This could be costly for the tax-
payer. He felt it was time for the City Commission to
become involved in investigating the situation. He referred
to the situation in Delray where the City Commission was
upset with the City Manager and held a special meeting.
As it turned out the Commission was satisfied and that was
the end of that. He referred to a law suit in which

Sergeant Sheridan got the City into a law suit in 1985 based
on the May, 1984 incident. The City settled out of court
for $225,000.00. Mr. Fauser was giving his opinion as a
taxpayer. He felt that Sergeant Sheridan was going to get
the City into a real jam. He saw Sergeant Sheridan as arro-
gant and felt that he learned nothing from his previous
mistakes.
Opening an Office for P.I.C. work for Youth
Wilda Searcy, 402 N.E. 13th Avenue, asked if a proposal had
been written to go into the P.I.C. program to open an office
to get work for the youth 14-21 years old in Boynton Beach.
She wanted to know if the proposal had gone to Mr.
Montgomery.
City Manager Cheney stated this had not been done, but
George Hunt, Assistant City Manager had been in contact with
Mr. Montgomery. Mr. Montgomery had not said he wanted to
open a program here. He had a broad open ended letter.
Assistant City Manager Hunt stated he had spoken with Mr.
Montgomery a couple of weeks ago, and he concluded that he
is willing to provide the City with part-time personnel
assistance. He would send some of his recruiters down if
the City would provide space. He did state that he has a
South County wide recruit problem, and proximity does not
seem to be at the root of the problem. The program needs to
be restructured, the incentives restructured, and he is not
certain that an office would improve the City's position or
his position as Program Director. He did extend the oppor-
tunity to take advantage of that. The City is studying its
own program and Mr. Hunt would take that to the Community
Relations Board prior to contacting Mr. Montgomery later in
the year. Mr. Montgomery has an office in Delray and the
recruitment problems they enountered are the same ones
Boynton Beach is experiencing.

B, Burt Reynolds Request
City Manager Cheney; Craig Livingston, President of the
Chamber of Commerce; and Mayor Marchese had been told of the
interest Burr Reynolds has in coming to Boynton Beach to do
some filming. If this is done Mayor Marchese felt that the
Police Officers must be Boynton Beach Police officers who
are off duty. All contacts and requests must come through
the City Manager's office. There had been some discussion
regarding obtaining permits, etc. Bethesda Hospital had
indicated a willingness to allow their helicopter pad to be
used for landing if the helicopter is removed promptly.
Mayor Marchese wanted to know if it was a desire of the
Commission to encourage further talks in this direction.
Commissioner Weiner had no objections as long as they go
along with the City's ordinances. She did not see any
financial gain for the City.
Vice Mayor Hester felt that discussions should continue as
something of this nature could give the City more impetus in
the County.
Commissioner Mann would encourage such talks, and he had no
objections.
Commissioner Olenik was receptive to the idea. He did not
understand why they were getting involved, but as long as
the Codes were not violated he was in favor.
Mayor Marchese felt that the City Commission should be
informed about any major occurrence in the City. He recom-
mended that the City Manager continue negotiations. City
Manager Cheney stated that they must get permission to land
the helicopter from him. Mayor Marchese wanted something
put in writing that City Manager Cheney was Mr. Reynolds'
point of contact in the City and no one else.
City Manager Cheney did not know when the filming would
resume. Commissioner Weiner noted there are ways to
encourage the film industry, if the City so desires this
type activity. There was further discussion.
ADMINISTRATIVE
A. City Ombudsman Report
City Manager Cheney stated this report was done at the
request of the City Commission, and covered activities which

had been ongoing since June, 1988. The report was mostly
statistical in nature and gave an indication of the concerns
in the City. Mr. Hawkins involvement in the City is also
spelled out in the report. The last page of the report is a
summary of activities. Wilfred Hawkins was present in the
audience.
Vice Mayor Hester was surprised that there were not more
complaints. He felt this might be an indication that the
City was doing something right in responding to the citi-
zens' needs.
Commissioner Weiner stated that Mr. Hawkins is remarkable.
The response to him has been very good. She felt that as
more people learned he is available, there will be more
people coming to him with their concerns. She felt the City
was fortunate to have such a person on its staff.
City Manager Cheney pointed out that word seems to be
getting out slowly. At the CRB meeting held in High Point a
few days ago, the residents were unaware of the information
number in the City although they get the City Newsletter.
Mayor Marchese was pleased with Mr. Hawkins and his rapport
with the people. The question was raised as to whether or
not these reports are provided in the Library. After some
discussion it was decided they are not but will be in the
future.
Commissioner Olenik had requested a report about a month
ago, and this was exactly what he had been looking for. He
felt that it might be good to have a quarterly report in
1989 so that any changes could be monitored. City Manager
Cheney stated there was no problem in doing so.

There was some discussion as Commissioner Mann felt he might
like more time to make his recommendation. It was pointed
out that Mr. Aguila, who is presently an Alternate on the
Board was eligible and well qualified to move up into the
regular position. There was some discussion also that if
Commissioner Mann did not make a recommendation at this
meeting, he would lose his opportunity to do so.
Commissioner Mann had thought that Mr. Aguila had already
been selected as a regular member, but was told that he had
not. There was further discussion regarding a Commissioner
having only two meetings to make a selection before it was
turned over to another Commissioner for recommendation.
Vice Mayor Hester did not feel it was right for anyone to
take away a Commissioner's right to make a recommendation.
He did not agree with the policy of allowing two meetings to
make a recommendation, but he would go along with it.
Commissioner Olenik moved to remove the item from the table.
Commissioner Mann seconded the motion which carried 5-0.
Commissioner Mann moved to appoint Jose' Aguila as a Regular
Member of the Planning and Zoning Board with a term to
expire in April, 1989. Motion was seconded by Vice Mayor
Hester and carried 5-0.
D. Consider request by Mayor Ralph Marchese for report on
Boat Club Park building uses and commitments
Mayor Marchese noted that he had attended the ceremony for
the Dedication of the Boat Club Park Building for the U. S.
Coast Guard Auxilary Flotilla 54. He stated that this
group does a tremendous job in getting communications to
those people out in boats, expecially those in trouble.
Peanut Island is blocked by buildings and there are "dead
spots" so it is difficult to get communications to them.
All those with Flotilla 54 are volunteers (all 53 people)
and they also teach boat safety and give boat safety exami-
nations. In teaching they go to various locations and must
carry all their equipment with them. Mayor Marchese
requested that the City Manager be directed to study the use
of the Boat Club Park building and make a determination if
the Flotilla 54 group could hold all their functions at

this location. He did not wish to exclude other uses of the
building, but that the schedule be worked out so that this
group could use the building as necessary. Commissioner
Olenik clarified that Mayor Marchese was saying this group
would have first rights to the building, and if they were
not using it, Recreation and Parks could use it. This was
not what Mayor Marchese was saying. He felt that some of
the functions taking place there now might be accommodated
at another site once the Multi-Purpose building is
completed. He was suggesting that the schedules be
rearranged so as not to interfere with the Flotilla 54
meetings. He felt that everyone could be accommodated with
the rescheduling. The group teaches two or three times a
week in various locations at the present time. City Manager
Cheney agreed that he would have a study conducted, but
suggested that it be brought back to the Commission at the
second meeting in January as the Director of Parks and
Recreation is on vacation. Commissioner Olenik was con-
cerned by some comments made at the dedication by members of
the Flotilla which sounded like the building was being given
solely to the Flotilla. He wanted to be sure this was not
so, and Mayor Marchese agreed this building was public pro-
perty. City Manager Cheney stated the building was built by
the Boat Park Club and the City obtained it with the stipu-
lation the building would be available to the Club when they
needed it.
OTHER
Information regarding development of the park near
Hunters Run
Vice Mayor Hester stated that at the last meeting something
came up in regard to development of the park near Hunters
Run. A statement was made regarding a house close to the
park, and he thought that it was stated the house was 3'
from the area. He wanted information regarding the house
which is closest to the park and what the distance is. City
Manager Cheney would check into the matter.

City Manager Cheney had sent in reservations quickly, as
space would not be available at the Hilton if they did not
go in early. He wished to know who would be attending.

the consistency review of the expanded area redevelopment plan
with the Comprehensive Plan for the purpose of conducting a work-
shop on January 5, 1989 at 3:00 p.m.
At the special meeting of the Board, held on December 15th,
1988, the Board took formal action, requesting that the City
Commission join them at the January 5th meeting.
Please forward this memo to the City Commission for their
information.

PROCEDURE FOR PARTICIPATION BY BOARD ALTERNATES AT BOARD MEETINGS
The following adopted outline is presented aS the proper role for
BOard Alternates and was adopted by the City Council on June 7, 1983:
1. City.Council Expectations:
Alternate will attend meetings so that they will be aware
of:
Board Procedure
Board Policy
Type of issues coming to.the Board for consideration
Nature of Board decisions
2. Procedure for Alternates:
When at
a meeting as an Alternate, the Alternate will:
Take a seat separate from the regular Board
seats, but in front of the room or close to
the meeting table
b. Not vote unless acting as a substitute for
a regular Board Member
Be given a limited opportunity, by the Chair-
man, to ask questions for information of the
Board and the Alternate
do
Be given a limited opportunity, by the Chair-
man, to make suggestions on issues that are
involved with the particular meeting
The Alternate will fully participate when a Board Member
is unable to attend or excuses himself from participation
on a particular issue. The regular Board Member must in-
dicate his reason for not participating in a matter and
the Chairman should excuse the regular Board Member prior
to the Alternate's participation. ~owever, if a regular
Board Member leaves a meeting without being excused, the
Alternate should participate in the Board deliberations.
If there is more than one Alternate present at a meeting,
the Chairman will select the Alternate to participate by
rotation, unless an alternate is appointed or elected to
Serve for ~ specific Regular Member.
