Herb Suss, citizen of Boynton Beach, stated that public records show that the
Commissioner from District ! was absent 11 times in one year, including agenda
meetings, one special meeting, and regular meetings. He was on the short end of 4 to
1 votes. Mr. Suss felt that this Commissioner was shirking his responsibility and asked
for his immediate resignation and requested reimbursement of his salary for those 11
absences. He expected the Commission to set up the same criteria for their absences
as they do for the advisory boards. He believed that the Commissioners should be
docked salary and expense money when they are absent from a meeting.
Billy Warrayat, owner of Qwik Stop Grocery, was concerned regarding the loitering
around the store and asked for assistance.
Louis Nobile, 1409 SW 17th Avenue, had a complaint regarding the disposal
container that an existing medical facility proposes to place behind his home. He
wondered why it would be placed at that location since it will attract rodents and create
odors.
Mayor Broening advised Mr. Nobile that staff would contact him regarding his
complaint.
Richard Valentino, 1410 SW 17th Avenue, distributed copies of an area map to the
Commissioners. A medical office building plans to place 10' x 23' waste receptacles
behind his property. These receptacles could contain medical wastes and they would
attract rodents. He suggested that that they be moved to where the existing
dumpsters are located.
City Manager Bressner said that Public Works Director .left Livergood would look into
this situation,

Vice Mayor Ferguson reminded Mr. Suss that he had been absent from three meetings
of the Library Board.
Commissioner McCray wished everyone a safe, healthy, and prosperous New Year. He

Catalina on Sunday, .lanuary 19th, at 7:00 p.m. The ticket price is $30.

civility and he did not want to move away from that direction.

Commissioner McKoy prefaced his nomination by stating that it was important that
everyone understand the Boards' roles and every segment of the community should be
represented. He nominated Sergio Casaine, Jr. as a regular member of the Planning &
Development Board.

Presentation to the Links of Boynton Beach and Hops Restaurant
for their participation in this year's fund raiser by Pepper Adair of
the American Heart Association, Police Chief Marshall Gage, and
Fire Chief William Bingham
Pepper Adair, American Heart Association, reported that the Heart Walk raised
$165,000 and City employees raised $28,000. The Police Department had a charity golf
tournament at the Links and Ms. Adair presented Joe Sciortino, Golf Course Director,
with a plaque of appreciation.
Mr. Sciortino accepted the plaque and shared it with Police Chief Gage since the
tournament was his idea.
Ms. Adair also presented a plaque of appreciation to Fire Chief William Bingham, who
accepted on behalf of Noel Martinez, the Hops Restaurant representative, who was out
of town.
Chief Bingham explained that over 30 Boynton Beach firefighters and paramedics acted
as hosts, waiters, dishwashers, and bartenders at Hops for this fundraiser.

Color Guard and the Boynton Beach Fire Rescue by Kim Kelly of the
Ocean Avenue Merchants and Friends
There were no representatives of the Ocean Avenue Merchants and Friends present.
Mayor Broening explained that the Ocean Avenue Merchants held a special event in
December and the money raised was donated to charity. He thanked Kim Kelly, the
Ocean Avenue Merchants, and the Police and Fire Departments.

A. Motion for reconsideration of Proposed Ordinance No. 02-062
Motion
Commissioner McCray moved to reconsider proposed Ordinance 02-062.
McKoy seconded the motion that carried unanimously.

City Attorney Cherof read proposed Ordinance 02-062 by title only.
Lee Wische, 1302 SW 18th Street, stated that the referenced land is across from
Hunters Run and consists of approximately 30 acres that is zoned industrial. The
property has been vacant for at least 30 years with no revenue coming to the City. Mr.
Wische said that the zoning throughout the country is going to mixed use and it is time
to change the classification of this property. He felt that the City, the builder, and
Hunters Run would all be winners and he urged the Commission to approve it.
Bob Ensler, 26 Woods Lane, wanted to make South Congress Avenue a better place
to live. This item was turned down at the last Commission meeting. He presented a
petition containing 1,132 signatures in favor of this rezoning. This petition is marked
Exhibit A and is attached to the original minutes on file in the office of the City Clerk.
Mr. Ensler thought that the Commission was doing a good job with redevelopment in
the City but nothing was happening in District :[. He asked for approval of this item.
Alvin Newman, 49 Bristol Lane, said that he was president of one of the
associations in Hunters Run and president of the Presidents' Council there. All 23
association presidents voted in favor of the project. He believed that it would beautify
Congress Avenue and he requested approval.
Bob Kirchenbaum, 4 Sutton Drive, stated that he is in business full-time. He
previously represented 30 warehouses in 22 cities in industrial areas. He felt that he

knows industrial areas and the South Congress Avenue corridor is not an industrial
area.
Bonnie Miskell, 222 Lakeview Avenue, West Palm Beach, asked whether the
decision would be made at tonight's meeting. Mayor Broening answered that it would.
Motion
Commissioner McCray moved that proposed Ordinance No. 02-062 be approved.
Mayor Ferguson seconded the motion.
Vice
Commissioner McKoy commented that the applicant did not have legal representation at
the last Commission meeting and he wanted to give them that opportunity tonight.
City Attorney Cherof told the Commission that the approval of the ordinance on second
reading would be deferred to the next Commission meeting.
Commissioner McCray withdrew his motion.
Mayor Broening acknowledged that there were a large number of petitioners in favor of
this; however, this is a governance issue. The Commission should decide whether it is
best for the City and he said that he would reserve his comments on this for the next
meeting.
Commissioner McCray wanted to state for the record that the Commission needs to give
fair representation to the entire City of Boynton Beach.

City Manager Bressner explained that in the past, the City Commission was asked to
consider allocation of funds from the Police Department Forfeiture Donation Funds.
These funds are derived from confiscated property. He said that since 1998, funds

All programs that are considered for funding are geared towards are geared toward
working with youth and dealing with drug interdiction activities. The Police Department
evaluates these requests; however, since public dollars are used, Commission approval
is required.
Police Chief Marshall Gage reported that two to three times a year the Police
Department is approached by agencies requesting funds for youth activities. He could
only recall one that was turned down and that was from an organization that
specifically excluded any residents outside of Lake Worth. The Police Department is
required to give back 15% of all confiscated funds to anti-drug or youth oriented
programs. Boynton Beach gives much more. He stated that he receives accolades
from the community regarding the JTC program.
:In answer to a question by Commissioner McCray regarding the balance of funds in the
forfeiture account, Chief Gage reported that there is $41,000 in that account and $90-
$100,000 in the federal forfeiture account.
Stephanie HcKoy, 69 Citrus Park Lane, explained that the funds that are requested
would be used for program services that directly serve the students in the Juvenile
Transition Program. They would be used to defray the costs for stipends, books,
special projects, field trips, transportation, and event tickets.
There were numerous inaccuracies printed in recent articles in the newspapers. She
was grateful for the opportunity to provide factual information. The 990 form that the
newspaper talked about that was submitted with the grant application reflected
projected figures. The actual and official 990 that was submitted to the :[RS, dated
September 6, 2001, is public knowledge. The Juvenile Transition Center is a 501-C
non-profit corporation and everything that is done is public knowledge. The newspaper
article stated that Commissioner McKoy and she owned the JTC, which they do not.

The organization has a board of directors that is the governing body and oversees every
aspect of that program.
The article implied that there are financial inadequacies and inconsistencies with their
current funding source. She is not aware of any concerns that the Workforce Alliance
has regarding their financial practices. The .]TC is in compliance with all state and
federal audit requirements. The Workforce Development Board staff conducted a full
financial and program investigation. Tt was determined that the Juvenile Transition
Center did not misappropriate funds or commit fraud.
Regarding the grant process, the .]TC's contracts are reimbursed contracts. That means
that money must be fronted by the organization and receipts must accompany the
invoices submitted. There is a 30 day turn-around time. Ms. McKoy submitted a data
sheet for the record. This is labeled Exhibit B and is attached to the original minutes on
file in the office of the City Clerk.
Terrence Pereira, 7692 Colony Lake Drive, is a volunteer chaperone for 3TC. They
provided an academic safe haven for 51/2 years in the community. The money goes to
the youth of the community. They take the youth on college tours and encourage
education. He submitted into the record a letter from Police Chief Gage. This is
marked Exhibit C and is attached to the original minutes on file in the office of the City
Clerk. Mr. Pereira also read a letter from his granddaughter, one of the program
participants, who stated that she has profited greatly from the program and the
learning environment.
Charmaine Lucien stated that she has been with the program for four years and it
was a great help to her. It is an educational and fun program. She had an opportunity
to go on tours and job searches on the computer.
Vernon Blake, 84 Baytree Circle, is a volunteer with .]TC. He submitted a letter into
the record from School Superintendent Arthur .]ohnson, dated December 6, 2002. This
letter is marked Exhibit D and is attached to the original minutes on file in the office of
the City Clerk.
Vanessa Hatcher said that she has been in the program since July and is getting
assistance with math. She believed that the program should continue.
Ms. Hatcher's mother stated that ITC was a positive program for her daughter. Her
attitude and their relationship have improved. The program keeps kids off drugs and
off the streets. Her daughter is now looking forward to attending college.
Terrence O'neal has been in the program from the start and it has kept him off the
street and out of trouble. He plans to attend the University of Central Florida.

Louise Bradley-Gadsen, 171 NE 18th Avenue, said that the program helped her
granddaughter. ]~t is a good program and she hoped that it would continue.
Cheresa Bradley stated that the program helped her with her education and asked
the Commission not to take the money away from the program.
Kenneth Howard said that the program is well supervised. ]~t teaches rules and the
participants have responsibilities in order to receive a stipend. It improved his child's
overall reading skills and attitude.
Cheryl Mathis, 360 NW 16th Court, has three boys in the program and it has
brought up their math scores. It is a supervised program. The youth are exposed to
college campuses and it really makes a difference.
Tami Gooden, scholarship recipient, has been in the program for three years.
There are teachers to assist the youth, educational field trips, and college tours. She
said that without this program, life would not be the same.

Commissioner McCray moved to approve the money for the .1TC program.
Ferguson seconded the motion.

Commissioner McCray said that any time we can do something positive for the City and
our youth, we should.
Vice Mayor Ferguson was very impressed with everyone who spoke. He did not feel
there was any question regarding the value of the program. The only questions deal
with the financial situation. He suggested that an independent audit be conducted.
Commissioner Weiland said that there has never been a question regarding the
program. His concern is the operation of the program. There was not enough
information regarding the program in the back-up from the December 17, 2002
Commission meeting. ]~t was brought to his attention prior to the election that there
were feelings in the community that the program was not operating properly. He was
asked to look into it but decided to wait until after the election so that it was not a
political issue. He felt that now was a good time to ask for answers to questions.
Commissioner Weiland stated that he had several pages of information from City staff
and articles from both the Palm Beach Post and the Sun Sentinel. :In his opinion, there
are differences of how the money is spent. He felt that the Commission should know
how the program is operated. He received conflicting information on the hours of
operation.

He said that he spoke to a lady from the Workforce Development program and she
stated that her records show that officials there have been concerned about the
Center's financial reporting, its operational practices, and nepotism issues.
Commissioner Weiland also had a question regarding the numbers on the tax return, as
they do not seem to match. He felt that there was a need for an outside independent
audit to see whether the program is being operated properly.
Some of the information received states that the program provides services to all
residents of the area while other information states that the program is geared towards
African Americans, Haitians, and Spanish people.
He thought that the City should adopt a policy so that they know how all programs are
operated before any programs are eligible to receive funding.
Commissioner McCray said that he did not recall seeing a letter from the Workforce
Development Board and wanted to know the name of the person Commissioner
Weiland spoke to. Commissioner Weiland said that he did not state that he had a letter
from them.
Mayor Broening asked Ms. McKoy whether she provided responses to the questions
from the Workforce Development Board. Ms. McKoy stated that they provided an
independent audit.
Vote
A vote was taken on the motion to approve the funds. The motion failed 2 to 2 with
Vice Mayor Ferguson and Commissioner Weiland dissenting.
Motion
Mayor Broening passed the gavel and moved to approve subject to a
independent accounting bill of health. The motion died for lack of a second.

City Manager Bressner stated that staff has been providing information regarding the
operation of the .1TC to the Commission since December 19th. The auditors have
reviewed documentation, specifically the tax forms. They have verbally advised the City
that what was submitted was usual and customary.
City Manager Bressner reported that he had reviewed the files of the 3TC from the past
five years. He did this to ascertain whether there was any cause for concern in the
operation of the 3TC. He found only one incident and that was one field trip that was
administratively denied by City staff. The City oversees the .]TC. The hours of
operation are as stated in the application for the Community Development Block Grant

program which was provided to the City Commission. The hours of administrative
activity at the Hester Center are more than the hours of operation for the .1TC.
Mayor Broening stated that members of a civilian review board reviewed the request to
HUD and found it to be a beneficial operation.
When asked who the auditors were who reviewed this, City Manager Bressner said they
are the City auditors (Ernst & Young).
Commissioner McCray reiterated that Mrs. McKoy had stated that there was an
investigation done by the Workforce Development Board and they found no problems.
A recess was declared at 8:35 p.m. and the meeting resumed at 8:45 p.m.

Dick Hudson, Senior Planner, presented the highlights of the staff report. Normally, the
lot size for a PUD must be five acres. However, if it is found to be beneficial to the
community, a lesser area for a PUD would be in compliance with the Comprehensive
Plan. This project meets all policies in the Comprehensive Plan. The projected starting
price for homes is $110,000. ]t is one of the few detached single-family developments
that have come into the City this year; therefore, there is a market for it and staff
recommends approval.

Dick Hudson, Senior Planner, explained that this was part of the first round of
amendments for 2003. Following the hearing tonight, it would be sent to the
Department of Community Affairs for their review. When it comes back from them, the
City could adopt it, adopt it with changes, or not adopt it. Mr. Hudson said that they
are changing objective 1.12, which deals with hurricane evacuation in that area, and
they are adding two definitions.

Dick Hudson, Senior Planner, explained that this would change the land use to mixed
use and would change the zoning to mixed use-low intensity. This classification allows
up to 40 dwelling units per acre. :[t is consistent with policies and with the Federal
Highway Corridor Plan and staff recommends approval.
Hike Fitzpatrickf 175 SW 2nd Street, felt that in exchange for the rezoning, the City
should receive 200 feet of land for greenspace parallel to the railroad. He felt that the
reason the land is so valuable now is because of investments made by the citizen
taxpayers - water utilities, FP & L infrastructure, the :[ntracoastal bridge, and the :[-95
interchange. He believed that the pay back to the City should be 200 feet along the
FEC Railroad.
Mayor Broening thought that what Nr. Fitzpatrick was talking about was a site plan
issue. He did not believe there were any conditions that the City could impose on a use
issue.
Nr. Hudson said that Mayor Broening was correct.
Charles Siemon, Siemon & Larson, Planners and Planning Lawyers, said that
the appropriate place for greenspace would be in the front as there would be parking
by the railroad to buffer the noise. There is no plan yet. However, the success of the
project depends on creating an attractive, desirable address and that depends on urban
greenspace (heavily landscaped areas and attractive sidewalks).

heard at the same time. However, because the applicant is requesting PUD zoning and
a master plan is required to be adopted at the same time as the zoning, the rezoning
was delayed.
Staff had some concerns regarding this project:
A market analysis, which is a new requirement by the City. This information
was received last week and staff believes it is adequate.
The area consists of 167 acres that is designated industrial. It is the largest
industrial area that is not in a planned industrial park. This project would
divide this single industrial area into two parts and there may not be adequate
buffering.
This project would eliminate more industrial land.
Mr. Hudson said that staff does not recommend approval of the project.
Carol Thompson, Economic Consultant, explained the approach used in their data
and analysis report.
Bill Weitsma, agent for the applicant, did not see this as a contiguous parcel of
industrial land because the canal divides the property to the south of the project. They
would be willing to add trees to 35th Avenue to make it a tree lined corridor to the park.
The buffer to the south begins with the canal and becomes a 60' buffer. The buffer
along Congress Avenue varies between 30 to 40 feet to the wall. There would be a 15-

foot landscape barrier along 35th Avenue and a 30-foot setback on the east property
line fronting Caloosa Park.
Mr. Weitsma stated that their study shows that there is a need for this housing. There
is an over supply of industrial land in the City. He felt that there was a lack of demand
for industrial land and a strong demand for residential property.
Mike Fitzpatrick, ~.75 SW 2nd Street, explained that at the Planning & Development
Board meeting, there were two reasons given for the need for this project - to increase
the tax base and to meet the housing demand. He believed the additional taxes would
amount to an extra $75,000 and that would only cut his taxes by $5. He would rather
not have the project. Mr. Fitzpatrick wanted the land to remain industrial and perhaps,
in the future, it could be annexed into Caloosa Park. He felt that there was a continual
increase in the population but not in recreational land. Tn his opinion, this project is a
mediocre development and urged the Commission to follow staff's recommendation and
not approve it.
Bob Ensler, 26 Woods Lane, stated his desire to make South Congress Avenue a
nice entrance into the City. He presented a petition with over 1,000 signatures
supporting the project. This petition is labeled Exhibit E and is attached to the original
minutes on file in the office of the City Clerk. According to Mr. Ensler, the 1989 back-up
to the Comprehensive Plan shows that the industrial designation for land along
Congress Avenue was inappropriate and that the zoning should be addressed.
Mr. Ensler did not believe that the County had the money to purchase this property for
a park. Tf the land were to remain industrial, this zoning would allow manufacturing
facilities, towing companies, brick and stone building facilities, etc.
He did not see any reason to treat this project any differently than the Motorola site
where they just received approval for 500 residential units in the middle of an industrial
area.

developers, we would not have any greenspace remaining. He wondered what the rush
was to approve more projects on Congress Avenue. He would rather see greenspace,

Vice Mayor Ferguson thought it was short-sighted to get rid of this industrial land. The
City needs to keep some industrial land.

Mayor Broening thought that the area was rife with high end housing and there is a
need for medium priced housing, which this project provides. He believes that the
market determines what is right for the people. A large percentage of the industrial
property in Boynton Beach is storage and warehouses and they do not provide many
jobs.
Commissioner Weiland felt that putting residential in the middle of the industrial land
could cause the residents to complain regarding noise.

Dale Sugerman, Assistant City Manager, distributed a detailed chronology of the
revocable license agreement. This is marked Exhibit F and is attached to the original
minutes on file in the office of the City Clerk.
Mr. Sugerman explained that the City granted a license agreement allowing Jordan
Wrecker Service to fence in a public right-of-way containing four active public utilities.
This was to provide Jordan Wrecker protection from vandals. The agreement states
that they could not store vehicles on the right-of-way. They have continued to park
vehicles there. After numerous requests to remove the vehicles, staff is requesting the
revocation of this license agreement because of the violation.
When asked by Commissioner Ferguson whether there are other businesses that store
vehicles there, Mr. Sugerman replied that the alley is only specific to Jordan Wrecker
Service.
Commissioner Weiland reported that he also contacted the company so they would not
jeopardize their license agreement. He feels that the City has worked with them but
still feels that they should work with them further. This business provides
approximately 20 jobs. He also pointed out that many of these vehicles are not owned
by Jordan Wrecker but are vehicles towed by them. ]~f the City needed to move these
vehicles and they were damaged, the City would be responsible.
Assistant City Manager Sugerman said that it was very, very unusual for the City
Commission to grant to a private property owner the ability to fence off a pubic right-
of-way, a utility easement, or an alleyway. They did so in this case to help protect the
property from vandals. However, it was taken over as a storage area. Only two of the
utilities are controlled by the City. The other utilities are owned by the gas and phone
companies and they could come after the City if we allow this condition to exist.
He explained that from time to time, the City does abandon alleyways and splits the
property with adjoining property owners but not when current utilities are there. The
City could not vacate the alley because of the utilities.
l~n answer to a question posed by Commissioner McCray on whether they are still being
vandalized, the owner of Jordan Wrecker Service said that they were not.
City Manager Bressner explained that staff would rather not recommend termination of
the agreement. However, utilities break and they seem to break after hours and the
City needs to get in there. There is also a concern regarding oil from vehicles leaking
into the ground. The purpose of the license agreement was to provide security. It was
very clear in the agreement that they signed that they could not park vehicles there.
The company did not respond to the City's requests to remove the vehicles. However,

if they can agree to follow the terms of the agreement and they do not park vehicles
there, he would not have a problem with staff withdrawing the request for revocation.
Bob Robinson from .lordan Wrecker Service, explained that there is a constant
shuffling of cars because of their growth. Unfortunately, because of their growing pains
over the past year, he could not be everywhere at once. They have had meetings with
their employees and will have another one to let everyone know they cannot park in
this alleyway. They have taken corrective measures and have installed cameras. He
was very sorry and agreed not to park there in the future.
Vice Mayor Ferguson asked whether the Mayor would entertain a motion to table this
item to the second meeting in February.
City Attorney Cherof explained that this was the first time that the City granted the
ability to fence in a public right-of-way. This was a test type of agreement and it failed.
The agreement provides for a 90-day termination and he recommended that the
Commission exercise their right to terminate the agreement but with the understanding
that if they are satisfied with compliance over the next 80 days, they would rescind
their revocation.
When questioned regarding whether 3ordan Wrecker had made a good faith effort to
comply, Assistant City Manager Sugerman stated that his recommendation had been to
revoke the license because they saw vehicles parked in the right-of-way every day.
There were phone calls made, personal visits, and letters, none of which resulted in the
clearing of the alley. They are happy that this business is a thriving business but they
have to protect their utility easements. He said that he would report all findings to the
City Commission on April :[st.

VIII. CITY MANAGER'S REPORT:
A. Follow-up Report on 2002 Holiday Parade
City Manager Bressner explained that in the agenda package there was a follow-up
report concerning the 2002 Holiday Parade that had been requested at a previous
Commission meeting. Staff is requesting Commission input on the parade venue.
There were concerns raised by the Commission regarding the parade venue and time.
Overall, staff felt that the venue on Congress Avenue was a good one for safety
reasons. There were logistical issues that caused some difficulties for some participants
of the parade. Regardless of where the parade is, he suggested that the Mayor and
Commissioners watch/judge the parade from the viewing stand and then enter the
parade immediately before Santa Claus at the end.
Commissioner McCray felt that the Commission represents the constituency and should
have more input. He suggested that they revisit this as a group.
City Manager Bressner would welcome input from the Commission. He said that the
date (day of the week) and time for the parade is critical and decisions on these must
be made soon.
Commissioner Weiland believed that the early starting time was the reason for the
lower number of parade entries.
Commissioner McKoy felt that there should be input from the community also.
City Manager Bressner will get input from the parade participants and will give their
concerns to the Commission at the second meeting in February.

JOINT USE EASEMENT AGREEMENT
THIS AGREEMENT entered into this._/__~of_ ~-~ . 2002, by and
between LAKE WORTH DRAINAGE DISTRICI', a Special Taxing District in the State of
Florida, whose mailing address is 13081 Military Trail, Delray Beach, Florida 33484,
hereinafter referred to. as "DISTRICT", and WOOl. BRIGHT CORP. OF BOYNTON
BEACH, a corporation existing under the laws of the State of Florida, whose mailing
address is 9776 South Military Trail, Suite O2, Boynton Beach, Florida 33436, hereinafter
referred to as 'LAN DOWN ER".
WHEREAS, LANDOWNER is the owner of certain property located in Palm Beach
County, Florida, adjacent to the DISTRICT'S Lateral Canal No. 26; and
WHEREAS, DISTRICT owns, controls and maintains that canal identified as Lateral
Canal No. 26, which is upon and within that property owned by LANDOWNER; and
WHEREAS, the parties desire to enter into a Joint Use Easement Agreement over, on
and upon that property ('hereinafter referred to "Easement Area") as more particularly
described on Exhibit 'A" attached hereto and made a part hereof.
NOW, THEREFORE, for Ten Dollars ($10.00) and other good and valuable
considerations, received by each party from the other, it is hereby agreed as follows:
1. The above recitals are true and correct and incorporated herein by reference.
2. LANDOWNER shall, concurrently with the' execution of this Joint Use
Easement Agreement, execute and deliver to the DISTRICT an exclusive Easement over, on
and upon that property as more particularly described in Exhibit "B~, subject to the terms
and conditions of the subject Joint Use Easement Agreement..'

3. LANDOWNER shall install landscaping pursuant to the plans prepared by
Everett H. Jenner, AIA, for Job No. 20006 - Woolbright Medical Bui%ding, and approved by
DISTRICT February 14, 2002.
4. LANDOWNER shall be responsible for obtaining the necessary permits from
the appropriate governmental agency for the construction of the project.
5. LANDOWNER shall indemnify and hold harmless the DISTRICT for any and
all damages that may be caused by the DISTRICT to the landscaping, whiie exe~s, ising
responsibilities and obligations of the maintenance of its drainage system.
6. LANDOWNER agrees to indemnify and hold the DISTRICT harmless of ar~
from any and all liability which the DISTRICT may or could sustait~ as a ~esult
LANDOWNER'S use of the Joint Use Easement Area, including but not limited to, dama§e
or injury to the public or to the Canal structure itself.
7. LANDO%~'NER shall insure the DISTRICT against any and all liabilities by a
general liability poli~y naming the LAKE wORTH DRAINAGE DISTRICT as an additional
named insured in the amount of ONE MILLION DOLLARS ($1,000,000.00), and that such
insurance policy shall be kept in full force and effect during the term of this Agreement and
the expenses of same shall be borne by LANDOWNER or its successors and/or assigns. Proof
of such covera§e shall be delivered to the DISTRICT within (30) days prior to the annual
, renewal date of the policy. In the event LANDOWNER allows said insurance policy to
expire, this Joint Use Easement Agreement shall be terminated, and there will be a fee of
THREE HUNDRED DOLLARS ($300.00) to have said Agreement reinstated.
8. DISTRICT shall have the right to approve in writing the successors and assigns
of transfer of any rights ol conditic~ns contained in this Joint Use Easement Agreement, which
approval shall not be unreasonably withheld.
9. Notices in conjunction with this Agreement shall be sent by mail to the

development. According to Chapter 1, Article V, of the Land Development
Regulations, the formula for single family homes is applied towards the
calculation of the Park and Recreation Facilities Impact Fee as follows:

20. Staff recommends the removal of the prohibition of patios and decks to allow X

21. To insure affordability the developer shall consider the benefit of a shared X

landscaped area for the entire project.
22. Below ground utilities are encouraged. However, above ground mechanical X

Mission Statement: The Juvenile Transition Center will strive to mitigate
juvenile delinquency and youth violence by providing educational enrichment, self-
sufficiency, and personal development activities to its participants in an effort to enhance
the quality of life for the entire community.
Vision Statement: The Juvenile Transition Center's vision is to have it's
students demonstrate their academic achievement by enrolling in a College or University,
enlisting in a branch of the military or becoming gainfully employed to generate positive
productive citizens.
STATISTICAL PROGRAM DATA
From 1997-1999 88% of the JTC's students showed an increase in reading or
math grades evidenced by their report carcks or pre-post test results.(Approx. 80
Changing Hostility Into Literacy, Logic, Optimism & Universal Tranquility
(CHILLOUT) youth were served)
From 199%2002 22% of the JTC's seniors have enrolled in a College or
University. (approx. 9 of 41 combined seniors)
From 1999-2002 50% of the JTC's students have been reported as entered into
the workforce. (approx. 12 of 24 combined age-appropriate students)
Students served to date is approximately 185, which includes a total of three
programs:
,/ (CHILI, OUT) was an afterschool program that provided tutoring and
mentoring 8-18. Requirements: Application
ff Youth Excelling Scholastically (YES) was a 5-week summer program that
provided educational enrichment and job training skills to I4-18 year olds.
Requirements: Must meet income guidelines & application
,/ Encouraging Students Through Education, Employment 8: Mentoring
(ESTEEM) the current program, is a year-round after school program
designed to inspire and provide teens 14-18 with the strategies necessary
to meet their goal of attending a College/University. Requirements: Must
meet income guidelines & application
Other incentives include: Monetary Stipends, Daily snack, Weekly Mall Gift
Cert~cates, Public School elective credit (Reading or Mathematics), Educational
Field Trips, Scholarships, dob Opportunities, Positive Community interaction
(Holiday Card Creation, Preparing and Giving away fruit baskets to area nursing
homes, Mentors, FCA T, SAT, ACT prep tests, etc.
The JTC is a 501(c) 3 non-profit organization funded through donations. Please feel free

Bound Program. This is a partnership between the Palm Beach County Schools and the

The ~Tuvenile Transition Center has successfully assisted in reducing the number of
dropouts in the Palm Beach County School 5ysq'em by providing basic skills instruction in
the areas of English and Mathematics. I am also pleased that the current Encouraging
Students Through Education, Employment & Mzntoring (ESTEEM) has helped many of our
students achieve their educational goals.
The Palm Beach County School District will assist in offering a maximum of two elective
credits to students attending the selected schools, who successfully complete the

Revocable License Agreement
Chronology
Jordan Wrecker Service verbally asks the City Engineering
Department for permission to fence the easement running
between two of his parcels.
Engineering Department responds in writing that permission
cannot be given due to two active utility lines running within
the alleyway.
City Manager and a member of the Commission do a site
inspection. Ask the Development Department and the
Assistant City Manager if the fencing request can be
accommodated.
Assistant City Manager provides City Manager with details of
the use of the alleyway for utility services, and expresses
concern that if the alleyway were fenced, it would be used to
store wrecked vehicles. Offers to contact property owner to
further explain the situation, and a more detailed outline of
why the verbal request was denied. The Assistant City
Manager calls the Vice-Mayor to explain the reasons. The
Vice-Mayor suggests that he is only trying to help this local
business keep vandals from getting onto his property. He
suggests that if the alley is abandoned, or if the private
property owner is allowed to fence the alleyway, that there
should be a clear restriction against the storage of wrecked
vehicles or broken-down equipment.
A formal memorandum on reasons why not to vacate the
alley is issued by the Assistant City Manager.
The City Manager asks the Assistant City Manager to work
with the Legal Department to draft a License Agreement for
Jordan Wrecker Service that would allow the fencing of the
alleyway, but would contain a provision prohibiting parking or
storing equipment or vehicles. This License Agreement is
being offered due to the property owners desire to keep
vandals out of his place of business.
Draft License Agreement prepared and shared with Jordan
Wrecker Service. License Agreement contains provisions

prohibiting storing or parking of vehicles and equipment
within the alleyway.
Draft License Agreement is revised with two changes. The
length of the agreement is doubled, and. the cost of the
License Agreement is dropped from $600.00 per year to
$1.00 per year. The provision about not storing any
equipment or wrecked vehicles survives the revision.
Nov. 20,2001
City Commission approves the License Agreement with
Jordan Wrecker Service. The provision about not stodng
any equipment or wrecked vehicles is in the approved
version of the final agreement.
December 2001
through
January 2003
Jordan Wrecker Service stores wrecked vehicles and broken
down equipment on the alleyway on a regular basis.
A number of verbal warnings are given to Jordan Wrecker
Service about the violation of the License Agreement.
October2002
In preparation for the annual renewal of the License
Agreement, a formal inspection is conducted of the site.
October29,2002
Jordan Wrecker Service put on formal notice that they have
been in continuous violation of the License Agreement. They
are formally asked to remove all vehicles and equipment
from the alleyway.
October29,2002
through
January 2003
Continued violations by Jordan Wrecker Service, despite a
number of verbal and written warnings about the possibility
of loss of their License Agreement.
November2002
City Commission agenda item prepared to have the City
Commission consider revocation of the License Agreement.
January 7, 2003 City Commission action scheduled on the revocation.

Please work with legal to prepare a draft license agreement for the use of the Alley ROW by the
adjoining property owners. Per your memo of 9/10/01, the terms should reflect unrestricted
access to the area by the City for maintenance which means a prohibition against parking or
storing equipment or vehicles on the Alley ROW. The term of the license agreement should be
no more than five years with two five year renewals. In addition, the license agreement should
contain a provision that the City may terminate the license agreement at any time with 90 days
notice. This way if there is a violation of the agreement, we cancel. Because we have active
utilities in the Alley ROW, an alley vacation is not recommended.
