Minutes 08-01-88 MINUTES OF THE SPECIAL CITY COMMISSION MEETING HELD AT PINELAND PLAZA, BOYNTON BEACH, FLORIDA, MONDAY, AUGUST 1, 1988 AT 7:30 P. M. PRESENT Ezell Hester, Jr., Mayor Leonard Mann, Commissioner Robert Olenik, Jr., Commissioner Peter L. Cheney, City Manager Betty S. Boroni, City Clerk Raymond A. Rea, City Attorney Mayor Hester called the meeting to order at 7:30 P. M. AGENDA APPROVAL Mayor Hester added "G. Process of Appointment to District 1" to the agenda. City Manager Cheney added "H. Discussion of Budget Workshop and Public Hearing Dates," as there would have to be some changes. Commissioner Mann moved, seconded by Commissioner Olenik, to approve the agenda with the additions. Motion carried 3-0. RECEIPT OF NOMINATING PETITIONS Betty Boroni, City Clerk, presented to the Commission the petitions of Ralph Marchese and Allen Wm. Martincavage as elandidates for the election of Interim Mayor at Large. The Commission accepted the petitions as presented. ELECTION PROCLAMATION Mayor Hester read the Proclamation, which proclaimed that a Special Election will be held on the 6th day of September, 1988 to elect a Mayor at Large to complete the unexpired term through March 30, 1989. The voting hours are between 7:00 A. M. and 7:00 P. M. on said date. The Proclamation further proclaimed that a Special Bond Election will also be held at the same time to vote for or against bonds in an aggregate principal amount not exceeding $2,500,000 for providing funds, together with any other a~ailable funds, to acquire a 10 acre parcel of land com- monly known as the Shooter's Property, such bonds to mature at such time or times not exceeding 30 years, as determined by the Commission, and to bear interest at a rate or rates not exceeding the maximum rate then permitted by law. T~e polling places were also designated in the Proclamationl -1- MINUTES - SPECIAL CITY COMMISSION MEETING BOYNTON BEACH, FLORIDA AUGUST 1, 1988 ACCEPT COMMISSIONER RALPH MARCHESE'S RESIGNATION Commissioner Mann moved, seconded by Commissioner Olenik, to accept the resignation of Ralph Marchese as Commissioner. MOtion carried 3-0. DECLARE VACANCY ON CITY COMMISSION Since Ralph Marchese resigned as Commissioner, Mayor Hester announced that there was a vacancy on the City Commission in District I. PROCESS OF APOINTMENTS TO DISTRICT Mayor Hester reminded the Commissioners that they would have tomorrow night (August 2, 1988) and August 16, 1988 to appoint someone to District I. If no one is appointed at that time, they would need to have a Special Election. City Attorney Rea advised that the Commission can accept applications, not have applications, or have a combination of both. The only requirement is that the appointee be an elector of the City, living within District I. The election* process is at the discretion of the Commission. Mayor Hester was on the Commission the last time they appointed someone. They had a list of five people, and he r~called that they picked the top three. Each one selected their top three, and a simple majority prevailed. Mayor Hester thought it took two meetings. Commissioner Mann recommended that they present the names they have at the Commission meeting tomorrow night (August 2, 1988). He had some names by petition, phone, and letter and was willing to accept names any way they came. Commissioner Mann thought the names could be placed before the Commission and they could discuss them tomorrow. They could vote at the meeting of August 16th. Mayor Hester was not going to take any phone calls. If they are interested, he felt they should write letters. If someone calls Commissioner Mann, and Commissioner Mann thinks they are qualified, Mayor Hester said that name could be brought up, but he thought everyone on the Commission should know who the people are. He elaborated. Commissioner Olenik referred to waiting until the 16th with a ithree member Commission. They waited until the last minute when he was appointed. If they wanted to appoint someone tomorrow, he said it would be fine, but they would need *three votes for one person. Commissioner Mann wanted to wait because he likes a three man Commission. It was decided this procedure would be followed tomorrow night (August 2, 1988). DISCUSSION OF BUDGET WORKSHOP AND PUBLIC HEARING DATE:: City Manager Cheney informed the Commission that the law was Changed and they could not have their first hearing prior to September 3rd. He Suggested dates for budget workshop meet- ings and public hearings. After discussion, the following dates were agreed upon: August 15, 1988 at 7:30 p. M. - Workshop for discussion of General Fund Budget August 25, 1988 at 7:30 P. M. - Workshop for presentation of miscellaneous budgets (Utilities, Gas Tax, Golf, etc.) September 12, 1988 at 7:30 p. M. September 22, 1988 &t 7:30 p. M. - Public Hearing on General Fund Budget - Public Hearing on General Fund Budget There was further discussion. City Manager Cheney informed COmmissioner Olenik that before the meeting is over on September 12th, the Commission will once again set a tenta- tive millage. At the meeting on September 22nd, the COmmission will have the same kind of hearing and will once again set a tentative millage and make final decisions on the budget adoption under a Resolution that they will have tm pass. M~yor Hester asked why the dates had M~nager Cheney said the City used to to be changed. City ' have 30 days to get the miillage to the County. That was extended to 35 days. They thien used to have 15 days on top of the 30 for the Tax Coillector to send out his notice to property owners. That is now 20 days, in addition to the 35, which ends up being the 24th of August.
